About procedure for publication and entry into force of official acts

The parliament of the Republic of Moldova adopts this law.

Art. 1. - (1) the Laws promulgated by the President of the Republic of Moldova resolutions of Parliament, presidential decrees of the Republic of Moldova, the resolution and the order of the Government, acts of the Constitutional court and Audit Chamber, regulations of the central industry bodies of public management, National Bank of Moldova of the National commission on the financial market, and also regulations on ratification, acceptance, approval of international treaties or accession to them together with the text of the agreement in state language, including texts of appendices and the documents attached to it, clauses and statements of the Republic of Moldova to the agreement made during the signing, ratification, acceptance, approval or accession, the regulations concerning suspension, denouncement or cancellation of international treaties, the order of the Minister of Foreign Affairs and European Integration which the effective date is brought to the attention of the public suspensions or date of cancellation of international treaties *, are published in the Official monitor of the Republic of Moldova **, published by the State news agency "Moldpres", in state language with the translation into Russian and other languages according to the legislation. In need of the Official monitor also other official acts are published.

(3) Official acts can be published in other periodicals only with reference to the Official monitor.

(4) the Laws promulgated by the President of the Republic of Moldova and decrees on their promulgation are submitted by the President within three-day term from the date of signing to the State news agency "Moldpres" for their publication in the Official monitor and to the Agency of legal information resources for their publication in the State register of legal acts of the Republic of Moldova. Other official acts specified in part (1) this Article, are represented for publication by the body which accepted or issued them to three-day time from the date of signing. Official acts are published in the Official monitor no more than ten days from the date of obtaining by their State news agency "Moldpres" in time, and in the State register of legal acts of the Republic of Moldova - in three-day time from the date of their publication in the Official monitor.

(5) the Official acts specified in part (1), become effective from the date of their publication in the Official monitor or in time, provided in the act. The official acts which are becoming effective in time, provided in the act, are published in the Official monitor in 10-day time after their acceptance. (6) Regulations about ratification, acceptance, approval of international treaties or accession to them together with the text of the international treaty in state language, including texts of appendices and the documents attached to it, clauses and statements of the Republic of Moldova made during the signing, ratification, acceptance, approval or accession the regulations concerning suspension, denouncement or cancellation of international treaties, the order of the Minister of Foreign Affairs and European Integration which the effective date is brought to the attention of the public suspensions or date of cancellation of international treaties are published in the Official monitor according to part provisions (4).

(7) in case of lack of the authentic text of the international treaty in state language for publication the text of its original in foreign language with the official translation on state language certified by the Ministry of Foreign Affairs the Ministry of Foreign Affairs and European Integration which accuracy is provided with the body responsible for the conclusion of the international treaty is submitted.

(8) Summaries of being of decisions and resolutions of the European Court of Human Rights, including their substantive provisions, on cases in which the Republic of Moldova acts as the defendant after entry into force of the specified decisions and resolutions are published in a month in the Official monitor of the Republic of Moldova.

(9) Complete texts of regulating documents in construction are published in special releases of the Official monitor of the Republic of Moldova, and orders on their approval - in the Official monitor of the Republic of Moldova according to the law.

Art. 2. - The international acts become effective after exchange of instruments of ratification or after transfer of the approved acts on storage to depositary according to rules of international law or in other procedure and other terms established by the finishing speaking parties.

Art. 3. - Official acts which contents are the state secret become effective from the date of their acceptance or in time, provided in the act, and are brought to the attention only of the interested organizations. If the state secret only separate Sections, Chapters, articles of the official act, in case of its publication contain these Sections, Chapters, Articles fall, and instead of them becomes dung: "The state secret".

Art. 4. - Amendments to the official acts published in the Official monitor are published in the same place by the State news agency "Moldpres" according to the written petition of the body which adopted or issued the relevant official act, in time no more than ten days from the date of submission of the petition. At the same time corresponding petition goes to the Center of legal information for publication of amendments to the State register of legal acts of the Republic of Moldova.

Art. 5. - (1) the Official monitor leaves with frequency at least once a week and consists of the following five parts:

part I - the laws, resolutions of Parliament, presidential decrees of the Republic of Moldova, acts of the Constitutional court and Audit Chamber, the international acts and reports of Office of the national lawyer;

part II - resolutions and orders of the Government of normative nature;

part III - regulations of the central industry bodies of public management and national bank of Moldova;

part IV - information on registration, suspension and the termination of activities of batches, other social and political and public organizations, and also business entities, information on application according to the law of insolvency proceedings of the companies and organizations;
