About approval of the Procedure for representation and consideration of offers on forming of the list of the objects of state-owned property having strategic importance for economy and safety of the state

In pursuance of Item 2 of the resolution of the Cabinet of Ministers of Ukraine of 03.11.2010 N 999 "About determination of criteria of reference of objects of state-owned property to those which have strategic importance for economy and safety of the state" PRIKAZYVAYU:

1. Approve the Procedure for representation and consideration of offers on forming of the list of the objects of state-owned property having strategic importance for economy and safety of the state it (is applied).

2. To provide to department of management and reforming of objects of state-owned property submission of this order on state registration in the Ministry of Justice of Ukraine in the procedure established by the legislation.

3. To impose control over the implementation of this order on the first deputy of the Minister of Economic Affairs of Ukraine Bandurov V. V.

4. This order becomes effective from the date of its official publication.

Procedure for representation and consideration of offers on forming of the list of the objects of state-owned property having strategic importance for economy and safety of the state

1. This Procedure establishes the procedure of representation and consideration of offers on inclusion (exception) of the companies in (from) the list (list) of the objects of state-owned property having strategic importance for economy and safety of the state (further - the list).

2. Offers on inclusion (exception) of objects in (from) the list (list) are represented by authorized bodies of management signed by the head with the corresponding reasons concerning each company separately.

3. Reasons about inclusion (exception) of objects in (from) the list (list) shall contain information of authorized body of management on compliance (discrepancy) of activities of the company to criteria of reference of objects of state-owned property to those which have strategic importance for economy and safety of the state (further - criteria), the approved resolution of the Cabinet of Ministers of Ukraine of 03.11.2010 N 999 (further - the resolution).

Information of authorized body of management on compliance (discrepancy) of activities of the company to criteria shall contain determination of influence of the company on activities of the companies of the corresponding industry of economy, on industry in general and on the companies of other industries of economy.

3.1. In case of provision of offers concerning inclusion of the companies in the list of the reasons confirming compliance of activities of the company to criteria shall contain the following documents.

3.1.1. Confirmation of conformity of activities of the company to the criterion determined by the paragraph the second Item 1 of the resolution is information of authorized body of management on core activities of the company, ensuring integrity of the integrated power system with this company, and calculation of share of products, works and services (further - products) the companies for core activity in the nation-wide market of goods.

Calculation of share of products of the company in the nation-wide market of goods is perfromed based on information of the subjects of managing working at the corresponding market on products sales amounts (in natural or cost indicators) and information of bodies of the state statistics concerning export and import of the corresponding products in reporting year.

The share of the company in the market is calculated as ratio of amount of products of the company to the total amount of the market taking into account export volume and import.

3.1.2. Confirmation of conformity of activities of the company to the criterion determined by the paragraph third Item 1 of the resolution is information of authorized body of management that core activity of the company is implementation of transportation of chemical goods by bulk distribution lines and servicing of such pipelines, and calculation of share of products of the company for core activity in the nation-wide market of goods according to subitem 3.1.1 of subitem 3.1 of this Item.

3.1.3. Confirmation of conformity of activities of the company to the criterion determined by the paragraph the fourth Item 1 of the resolution is information of authorized body of management on core activities of the company and the item-by-item plan of exploration works approved by Public service of geology and subsoil of Ukraine and calculation of share of products of the company for core activity in the nation-wide market of goods according to subitem 3.1.1 of subitem 3.1 of this Item.

3.1.4. Confirmation of conformity of activities of the company to the criterion determined by the paragraph the fifth Item 1 of the resolution is information of authorized body of management that core activity of the company is production and conversion of minerals of nation-wide value which list is approved by the resolution of the Cabinet of Ministers of Ukraine of December 12, 1994 No. 827 "About approval of lists of minerals of nation-wide and local value", and calculation of share of products of the company for core activity in the nation-wide market of goods according to subitem 3.1.1 of subitem 3.1 of this Item.

3.1.5. Confirmation of conformity of activities of the company to the criterion determined by the paragraph the sixth Item 1 of the resolution is information of authorized body of management that core activity of the company is production of land and cartographical products (materials, information, data and so forth) and ensuring requirements of public administration with it, economies, defenses, sciences, cultures, educations and the populations of the country and calculation of share of products of the company for core activity in the nation-wide market of goods according to subitem 3.1.1 of subitem 3.1 of this Item.

3.1.6. Confirmation of conformity of activities of the company to the criterion determined by the paragraph the seventh Item 1 of the resolution is information of authorized body of management that core activity of the company is implementation of observations of hydroweather conditions, geophysical processes in the atmosphere, the analysis and generalization of the obtained data, active influences on hydrometeorological processes, providing with hydrometeorological information, forecasts and warnings of the dangerous and spontaneous hydrometeorological phenomena of public authorities, local government bodies and the population and calculation of share of products of the company for core activity in the nation-wide market of goods according to subitem 3.1.1 of subitem 3.1 of this Item.
