In pursuance of provisions of parts (12) and (13) Article 23 and part (2) article 26 of the Law on electronic communications No. 241-XVI of November 15, 2007 (The official monitor of the Republic of Moldova, 2008, No. 51-54, the Art. 155) the DECIDES: NAREKIT Administrative board

1. Approve Regulations on the mode of general permission and issue of licenses to use of limited resources for provision of networks and services of electronic communications public, according to appendix.

2. Declare invalid the Regulations on the mode of general permission and issue of licenses to use of limited resources for provision of networks and services of electronic communications public approved by the Resolution of the NAREKIT Administrative board No. 10 of 28.08.2008, registered by the Ministry of Justice for No. 605 of September 10, 2008. (Official monitor of the Republic of Moldova, 2008, No. 174, Art. 498).

Regulations on the mode of general permission and issue of licenses to use of limited resources for provision of networks and services of electronic communications public

Chapter I. General provisions

1. This provision establishes types of networks and services of electronic communications, conditions of their provision, procedure for general permission and licensing, standard forms of the license, notification and the informative declaration.

2. The purpose of this provision is realization of provisions of the current legislation in the field of electronic communications for providing open entry to high-quality, modern and useful services of electronic communications.

3. The types of networks and services of electronic communications which are subject to the mode of general permission are specified in the list stated in annex 1 to this Provision.

4. The activities connected with provision of special networks and/or services of electronic communications and provision of networks and/or services of electronic communications only for own needs do not fall under the mode of general permission, an of person intending to provide exclusively this type of networks and/or services of electronic communications shall not give the notification provided in Item 7 of this provision.

Chapter II. Mode of general permission

Part 1. Procedure of general permission

5. The procedure of general permission assumes implementation of all actions necessary for realization of intention to initiate provision of networks and services of electronic communications public.

6. Subjects of the procedure of general permission are:

1) National regulation agency in the field of electronic communications and information technologies (further - the Agency) and;

2) the physical persons and legal entities registered according to provisions of the current legislation (further applicants).

7. Applicants who intend to provide networks or services of electronic communications public shall transfer to the Agency notification according to the standard form provided in appendix 2 to this Provision.

7-1. Notification contains acceptance by the applicant on itself responsibility for observance of conditions of general permission for provision of networks and/or services of electronic communications public and for authenticity of the submitted documents.

8. Notification shall be followed by the Card of the abstract description of networks and services of electronic communications public, according to the standard form provided in appendix 3 to this Provision.
