1. Approve the enclosed Rules of submission by subsoil users of reports on carrying out transactions on subsurface use.

3. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of submission by subsoil users of reports on carrying out transactions on subsurface use

1. General provisions

1. These rules of submission by subsoil users of reports on carrying out transactions on subsurface use (further - Rules) are developed according to the subitem 33) of article 16 of the Law of the Republic of Kazakhstan of June 24, 2010 "About subsoil and subsurface use".

Rules determine procedure for submission by subsoil users to authorized body by studying and use of subsoil (daleeupolnomochenny body) of reports on carrying out transactions for subsurface use.

2. Transactions on subsurface use - the works relating to the state geological studying of subsoil, investigation and (or) mining, including connected with exploration and production of underground waters, therapeutic muds, investigation of subsoil for dumping of sewage and also on construction and (or) operation of the underground constructions which are not connected with investigation and (or) production.

2. Procedure for provision of reports on carrying out transactions on subsurface use

3. For subsoil users it is established the following types of the reporting on carrying out transactions under subsurface use (further - reports) in authorized body:

1) the information geological report following the results of six months (semi-annual report);

2) the information geological report following the results of year (annual statement).

4. Semi-annual reports on results of the performed operations on subsurface use in the contract area for the first half of the year of the current year go the subsoil user to interregional department of authorized body (further - interregional department) no later than July 15 of the current year.

The interregional department in case of submission of incomplete or false information by subsoil users in reports, within ten calendar days from the moment of their receipt returns the report on completion. The subsoil user within thirty calendar days submits modifed reports in interregional department.

The interregional department according to subsoil users constitutes summary reports on results of the performed operations on subsurface use in the territory subordinated to them for the first half of the year of the current year. Summary reports on results of the performed operations on subsurface use go interregional departments to authorized body by September first of the current year.

Within fifteen calendar days from the moment of receipt of the summary semi-annual report from interregional department the authorized body considers and directs it to storage in Republican fund of geological information of authorized body (further - geological fund).

5. Annual statements about results of the performed operations on subsurface use in the contract area go subsoil users to interregional department no later than January 10 of the following after accounting year.

The interregional department, in case of submission of incomplete or false information by the subsoil user, within ten calendar days from the moment of receipt of the annual statement returns it on completion. The subsoil user within thirty calendar days submits modifed reports in interregional department.

The interregional department according to subsoil users constitutes summary annual statements about results of the performed operations on subsurface use in the territory subordinated to them for accounting year.

Summary reports on results of the performed operations on subsurface use go interregional departments to authorized body by February twenty fifth of the following after accounting year.

Within fifteen calendar days from the moment of receipt of the summary annual statement from interregional department the authorized body considers and directs it to storage in geological fund.

6. For receipt of the construction license or placement of sea constructions the applicant sends to competent authority:

1) the statement, according to form of 1 appendix to these rules, signed by the subsoil user and certified by seal of the organization;

2) form of data according to form 2 appendices to these rules.

7. The competent authority returns the application without consideration in case of submission by the applicant not of complete data, stipulated in Item 6 Rules, within three working days. The term of consideration of the application with appendix of missing data is estimated from the moment of receipt of the repeated written address of the applicant by competent authority.

8. The competent authority after receipt of the statement within four working days sends them to authorized bodies in the field of environmental protection, use and protection of water fund, industrial safety, ensuring protection of frontier and civil defense which within seven working days agree on opportunity or impossibility of construction or placement around the specified geographical coordinates of sea construction.

9. The competent authority within four working days after receipt of answers from authorized bodies, stipulated in Item 8 Rules, considers the application and issues or also placement of sea construction refuses the construction license.
