About drinking water

This Law is directed to creation of the state guarantees of providing the population with drinking water;

determines the state requirements to control of quality of drinking water and its safety for health of the person, to protection of sources of drinking water and their use;

establishes legal, economic and organizational basis of rational use and ecological protection against pollution, contamination and depletion, and also functioning of systems of drinking water supply and relations of subjects in the field of drinking water supply.

Chapter I. General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

drinking water - the water answering on the quality in natural state or after processing (cleaning, disinfecting, addition of missing substances) to normative requirements and suitable for drinking and domestic needs of the person and (or) for use in production of food products;

standard rates of quality of drinking water (normative requirements) - set of the admissible indicators of chemical and microbiological (biological) composition and organoleptic properties of drinking water guaranteeing its safety and harmlessness for health of the person established by research methods and regulated by health regulations;

drinking water supply - the activities aimed at providing needs for drinking water of the population of Turkmenistan;

source of drinking water supply - water object or its part which contain the water meeting the established normative requirements in necessary quantity and are used (or can be used) for water intake in systems of drinking water supply with this or that technology of its processing;

centralized system of drinking water supply - complex of devices and constructions (water intakes, open and underground sources) for fence, preparation, storages of drinking water, its giving to places of expenditure, open for general use by physical persons and legal entities;

not centralized system of drinking water supply - the device and construction (well, well, the water purifier, spring, kyariza and another) for fence and preparation of drinking water without its giving to places of expenditure, open for general use by physical persons and legal entities;

autonomous system of drinking water supply - the device and construction (well, well) for fence and receipt of drinking water from underground sources with giving or without its giving to the place of expenditure, being in individual use (for the certain house, personal subsidiary farm or other separate object);

system of drinking water supply of the vehicle - the installations and the equipment placed on the vehicle for providing with drinking water passengers, crews and service personnel along the line the vehicle of passenger or other appointment;

system(s) of drinking water supply - the concept applied in this Law to exception of transfer of all systems in the presence of general regulations for centralized, not centralized, autonomous and on transport of systems of drinking water supply;

subscribers of centralized systems of drinking water supply - the physical persons and legal entities using drinking water from these systems and registered in accordance with the established procedure by the organizations of drinking water supply;

reliability of system of drinking water supply - property of system to provide certain mode (uninterrupted, hourly according to the schedule) supply of drinking water to consumers according to the established regulations of drinking water consumption and normative quality requirements of drinking water;

zone of sanitary protection - the territory (water area) including source of drinking water supply and water supply system and consisting of three belts on which specific modes of economic activity and protection of waters from pollution and contamination are set;

regulations of drinking water consumption - the settlement (average) amount of drinking water necessary for physiological and domestic needs of one person within a day in the specific settlement, on separate object or the vehicle in case of regular functioning of systems of drinking water supply, in case of violation of their functioning and in case of emergency situations, and also for production and economic needs of legal entities for the purpose of implementation of the activities provided by their charters and other regulating documents;

owners of systems of drinking water supply - the physical persons and legal entities having the property rights to the corresponding water supply system;

the organizations of drinking water supply (water users) - the legal entities performing operation of centralized or not centralized systems of drinking water supply;

users of systems of drinking water supply - the physical persons and legal entities using systems of drinking water supply in accordance with the established procedure for the purpose of receipt of drinking water for own needs or transfer to her other persons;

producers of drinking water are the users of systems of drinking water supply providing consumers with drinking water;

consumers of drinking water - the physical persons and legal entities spending drinking water for own needs;

limit of operational responsibility - the line of the Section of elements of systems of drinking water supply (water supply systems and constructions on them) on the basis of obligations (responsibility) for their operation established by the agreement of the parties;
