1. This Instruction about procedure for provision and use of the customs declaration in the form of the electronic document is developed according to article 180 and 183 of the Customs Code of the Customs Union (further - the Code) and determines procedure for provision and use of the customs declaration in the form of the electronic document.
2. The customs declaration in the form of the electronic document (далееЭТД) is provided by the customs applicant or the customs representative to customs authority, competent according to the customs legislation of the Customs union to register customs declarations.
3. When making customs transactions with use of ETD, including in case of release of goods before giving of ETD according to article 197 of the Code, documents which are provided by the customs legislation of the Customs union (further - documents) are presented in the form of electronic documents and (or) documents on papers if other is not established by the customs legislation of the Customs union and (or) the legislation of state members of the Customs union.
4. Structures and the ETD formats are determined by the legislation of the Customs union and (or) the legislation of state members of the Customs union.
5. The procedure for information exchange of customs authorities with customs applicants and (or) customs representatives to making of the customs transactions connected with goods placement under customs procedure with use of ETD is determined according to provisions of Chapter 4 of the Code.
6. Features of provision, use and storage of ETD and documents, can be determined by the customs legislation of state members of the Customs union.
