1. Approve the enclosed Regulations on procedure for conducting examination of the documents proving ensuring nuclear and radiation safety when implementing activities in the field of use of atomic energy and sources of ionizing radiation.
2. This resolution becomes effective since January 1, 2011.

1. This Provision developed according to the Presidential decree of the Republic of Belarus of September 1, 2010 No. 450 "About licensing of separate types of activity" (The national register of legal acts of the Republic of Belarus, 2010, No. 212, 1/11914), the Law of the Republic of Belarus of January 5, 1998 "About radiation safety of the population" (Vedamastsi Natsyyanalnaga to descent of Respubliki Belarus, 1998, No. 5, the Art. 25), the Law of the Republic of Belarus of July 30, 2008 "About use of atomic energy" (The national register of legal acts of the Republic of Belarus, 2008, No. 187, 2/1523), are determined the purpose, tasks and procedure for conducting examination of the documents proving ensuring nuclear and radiation safety when implementing activities in the field of use of atomic energy and sources of ionizing radiation, activities for the treatment of radioactive waste to designing and production of processing equipment and means of radiation protection (further - activities in the field of use of atomic energy and sources of ionizing radiation), and also the rights and obligations of customers of examination, the expert organizations and experts involved to conducting examination, Department on nuclear and radiation safety of the Ministry of Emergency Situations (further - Gosatomnadzor) regarding the organization of conducting examination.
2. In this Provision the following terms and their determinations are used:
examination of the documents proving ensuring nuclear and radiation safety when implementing activities in the field of use of atomic energy and sources of ionizing radiation (further, unless otherwise specified, - examination), - complex of the organizational, scientific and technical and expert and analytical events held for the purpose of independent assessment of level of nuclear and radiation safety of subjects to use of atomic energy and (or) radiation objects, radiation devices and installations;
the expert organization - the legal entity having special permission (license) (further - the license) in the field of use of atomic energy and sources of ionizing radiation regarding conducting examination of safety in the field of use of atomic energy and (or) sources of ionizing radiation;
the customer of examination - the legal entity who filed petition on conducting examination and submitting the documents which are subject to consideration to Gosatomnadzor.
Other terms are used in the values established by the Presidential decree of the Republic of Belarus of September 1, 2010 No. 450, the Law of the Republic of Belarus "About radiation safety of the population", the Law of the Republic of Belarus "About use of atomic energy".
3. Requirements of this provision extend to the relations arising in connection with conducting examination and are obligatory for accomplishment by subjects of examination:
customers of examination;
the expert organizations and experts involved to conducting examination;
officials and specialists of Gosatomnadzor.
4. The organization of conducting examination is performed by Gosatomnadzor.
5. The purpose of examination is determination of level of nuclear and radiation safety of the designed or operating subjects to use of atomic energy and (or) radiation objects, radiation devices and installations by comparison of the made project decisions and results of their realization to requirements of regulatory legal acts, including technical regulatory legal acts, in the field of ensuring nuclear and radiation safety.
6. Objects of examination are the examinations represented by the customer:
6.1. the documents proving ensuring nuclear and radiation safety:
subjects to use of atomic energy;
radiation objects, radiation devices and installations;
activities for the treatment of radioactive waste;
activities for designing and production of processing equipment and means of radiation protection;
6.2. project, design, technology and operational documentation of radiation objects, radiation devices and installations, objects according to the treatment of radioactive waste.
7. The main objectives of examination are:
assessment of conformity of the accepted project, design, technical and organizational solutions and results of their realization to requirements of regulatory legal acts, including technical regulatory legal acts, in the field of ensuring nuclear and radiation safety;
determination of completeness, sufficiency and justification of the organizational and technical approaches aimed at providing not exceeding of limits and conditions of safe operation, the set main limits of doses and admissible levels of radiation of personnel and the population, radioactive impact on the environment;
preparation of objective conclusion of examination of the documents proving ensuring nuclear and radiation safety.
In the absence of necessary regulatory legal acts, including technical regulatory legal acts, in the field of ensuring nuclear and radiation safety the specific project, design and technical solutions accepted by the customer of examination shall be confirmed with scientific research and are experimentally proved.
