About seed farming

This Law determines legal, economic and organizational basis of implementation of activities in the field of seed farming and is directed to regulation of questions of the organization and functioning of system of seed farming and the state control of production, procurement, processing, storage, transportation, realization and use of seeds of agricultural plants.

Chapter 1 General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) it is excluded

1-1) No. 435-V ZRK is excluded according to the Law of the Republic of Kazakhstan of 04.12.2015;

2) certification - establishment (confirmation) of compliance of physical and (or) legal entities to the status of the subject of seed farming;

4) agricultural plants - grain, leguminous, groat, feed, oil-bearing, essential oil-bearing, industrial, vegetable, medicinal, flower, fruit, berry crops, potatoes, grapes;

5) aprobator - the physical person which notified the relevant local executive body of the area, city of regional value, area, city of republican value and the capital on the beginning of activities for carrying out approbation of high-quality crops of agricultural plants;

6) monitoring tests - establishment of safety of signs of grade of agricultural plant and compliance of version to this grade;

7) original seeds - the seeds made by the author of grade of agricultural plant authorized by it-faced or originatory grades and intended for production of elite seeds;

8) seeds of the first, second and third reproductions - the subsequent reproduction of seeds of elite by years: the first year - primary seed, the second year - the second reproduction, the third year - the third reproduction;

9) approbation of crops - determination of high-quality qualities of crops of agricultural plants: varietal purity, high-quality typicalness, degree of contamination, defeat by diseases and vermin damages;

10) soil assessment - establishment of belonging of seeds to certain type, grade and their varietal purity by crops on special sites and the subsequent check of high-quality qualities on plants;

11) laboratory variety testings - establishment of belonging of seeds to certain grade and determination of varietal purity of seeds by carrying out the laboratory analysis;

12)   No. 184-VI ZRK is excluded according to the Law of the Republic of Kazakhstan of 05.10.2018;

12-1) State commission on strain testing of crops - the organization which is under authority of authorized body, performing examination and testing of plant varieties for patentability and economic usefulness;

13) strain changing - replacement of seeds with producers of the old, cultivated in production grades with the new, recommended for use grades, more productive or exceeding the replaced grades on hozyaystvenno valuable signs and properties;

14) strain renovation - replacement of seeds which high-quality and biological qualities worsened when using in production, the best seeds of the same grade;

15) high-quality typicalness - indicator of varietal purity of the cross pollinated agricultural plants;

16) grade originator - physical person or legal entity which provides preserving grade;

17) high-quality control - control of implementation of actions for determination of varietal purity of crops of agricultural plants and to establishment of belonging of seeds to certain grade;

18) strain testing - examination and testing of selection achievement for patentability and the economic usefulness which are carried out according to the procedure, established by the legislation of the Republic of Kazakhstan;

19) varietal purity - percentage of number of plants or stalks of the main grade to total number of plants or stalks of this agricultural plant;

20) superelite seeds - the seeds belonging to original, received from harvest of nursery of reproduction, conforming to requirements of national standards and other regulating documents in the field of seed farming and intended for production of elite seeds;

20-1) certificate on seeds - the document confirming high-quality and sowing qualities of original and elite seeds;

21) seeds - the generative and vegetative organs of plants used for reproduction of grade: actually seeds, fruits, parts of aggregate fruits, compound fruits, cones, saplings, bulbs, tubers, shanks, meristem and others;

22) quality of seeds - compliance of seeds to requirements of national standards and other regulating documents in the field of seed farming;
