ORDER OF THE GOVERNMENT OF THE RUSSIAN FEDERATION

About introduction of temporary quantitative restriction on import of ozone-depleting substances to the territory of the Russian Federation and procedure for its distribution and introduction of amendments to some acts of the Government of the Russian Federation

(as amended of the Order of the Government of the Russian Federation of 24.03.2014 No. 228)

According to article 8 of the Agreement on procedure for introduction and application of the measures affecting foreign trade in goods on single customs area concerning the third countries of June 9, 2009 and for the purpose of ensuring accomplishment of obligations of the Russian Federation under the Vienna convention on protection of ozone layer of March 22, 1985 and to the Montreal protocol on the substances destroying ozone layer of September 16, 1987. The government of the Russian Federation decides:

1. Establish from December 1, 2010 to December 31, 2010 quantitative restriction on import to the territory of the Russian Federation of the ozone-depleting substances specified in the list From Section 2.1 of the Single inventory to which prohibitions or import restrictions or export by the State Parties of the Customs union within Eurasian economic community in trade with the third countries and Regulations on application of the restrictions approved by the Decision of Interstate Council of Eurasian economic community of November 27, 2009 N 19 "On single non-tariff regulation of the Customs union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation" are applied (further - ozone-depleting substances), according to the list according to appendix.

2. Distribution of amount of ozone-depleting substances is performed between the participants of foreign trade activity who submitted in accordance with the established procedure applications to Federal Nature Management Supervision Service for import of ozone-depleting substances in proportion to amounts of the ozone-depleting substances imported by these participants in 20082009 years.

3. Provide to the Ministry of Natural Resources and Environmental Protection of the Russian Federation distribution between participants of foreign trade activity of amount of ozone-depleting substances according to Item 2 of this resolution and till November 25, 2010 to provide information on the specified distribution of amount of ozone-depleting substances in Federal Nature Management Supervision Service and the Ministry of Industry and Trade of the Russian Federation.

4. Provide to Federal Nature Management Supervision Service registration and issue to participants of foreign trade activity of allowing documents on possibility of import till December 31, 2010 of ozone-depleting substances in the amount distributed by the Ministry of Natural Resources and Environmental Protection of the Russian Federation within 3 working days from the date of receipt of information, the stipulated in Item 3 presents of the resolution.

5. Provide to the Ministry of Industry and Trade of the Russian Federation registration and issue to participants of foreign trade activity of licenses for import till December 31, 2010 of ozone-depleting substances based on granted according to item 4 of this resolution of allowing documents within 5 working days from the date of receipt in accordance with the established procedure of the statement on issue of such license.

6. To the Ministry of Industry and Trade of the Russian Federation to inform the Commission of the Customs union on introduction of the quantitative restriction provided by this resolution.

7. Approve the enclosed changes which are made to acts of the Government of the Russian Federation.

Changes which are made to acts of the Government of the Russian Federation

1. Ceased to be valid according to the Order of the Government of the Russian Federation of 24.03.2014 No. 228

2. In the list of the federal executive bodies authorized on approval of statements for issue of export licenses and (or) commodity import and execution of other allowing documents in the field of foreign trade in goods in cases, provided by regulations on application of restrictions on goods to which prohibitions or import restrictions or export by state members of the Customs union within EurAsEC in trade with the third countries, N 1567-p approved by the order of the Government of the Russian Federation of September 23, 2010 (The Russian Federation Code, 2010, N 40, the Art. 5121) are applied:

a) to add the name after the word of "representatives" with the words "within the competence";

b) Rostekhnadzor to exclude line item;

c) to add the column "The Name of Group of Goods to Which Prohibitions or Import Restrictions or Export Are Applied (the Section of the Single Inventory to Which Prohibitions or Import Restrictions or Export by State Members of the Customs Union within EurAsEC in Trade with the Third Countries Are Applied)" of line item Rosprirodnadzor with line item of the following content:

"ozone-depleting substances and products, them containing (1.1, 2.1)".
