1. Approve the enclosed Rules of issue of permissions to burning in torches of associated and (or) natural gas.

2. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of issue of permissions to burning in torches of associated and (or) natural gas

1. General provisions

1. These rules of issue of permissions to burning in torches of associated and (or) natural gas (further - Rules) are developed according to the Law of the Republic of Kazakhstan of June 24, 2010 "About subsoil and subsurface use" (further - the Law) and the Law of the Republic of Kazakhstan of July 5, 1996 "About emergency situations of natural and technogenic nature".

In these rules the following concepts are used:

1) authorized body on studying and use the nedrgosudarstvenny body performing functions on realization of state policy and control in the field of geological studying, rational and complex use of subsoil and also other functions in the field of subsurface use established by the legislation of the Republic of Kazakhstan;

2) No. 1275 Is excluded according to the Order of the Government of the Republic of Kazakhstan of 8.10.2012 

3) authorized body in the field of oil and gas - the central executive body of the Republic of Kazakhstan performing forming of state policy, coordination of management process in spheres of the oil and gas, petrochemical industry, transportation of hydrocarbonic raw materials;

4) authorized body in the field of industrial the bezopasnostigosudarstvenny body performing management in the field of industrial safety;

5) utilization of associated and natural gas - all production actions directed to exception of combustion of gas on torches namely: use of gas for own technical and technology needs, development and electricity trading, conversion and sales of products of conversion of gas, pumping gas or products of its conversion in layer for storage, and also maintenance of reservoir pressure.

Other concepts used in these rules are determined by the Law of the Republic of Kazakhstan of June 24, 2010 "About subsoil and subsurface use".

2. Procedure for issue of permissions to burning in torches of associated and (or) natural gas

2. Permission to burning in torches of associated and (or) natural gas (further - combustion of gas) is issued by authorized body in the field of oil and gas in coordination with authorized bodies on studying and use of subsoil and industrial safety. 

Issue of permission to combustion of gas (refusal in issue) is performed by authorized body in the field of oil and gas within fifteen working days from the date of receipt of all necessary documents provided by these rules.

Failure to provide by the subsoil user all required documents provided by Items 7, of 8 and 9 these rules attracts suspension of consideration of the request from the moment of the notification of the subsoil user until their provision.

3. The subsoil user submits the application for issue of permission to combustion of gas according to form of 1 appendix to these rules with application of documents provided by Items 7, of 8 and 9 these rules depending on type of the asked permission to authorized body in the field of oil and gas.

4. The authorized body in the field of oil and gas after check of completeness and reliability of the submitted documents sends the project of permission to combustion of gas with necessary documents for review to authorized bodies on studying and use of subsoil and industrial safety.

5. Approval term in authorized bodies on studying and use of subsoil and industrial safety shall not exceed seven working days from the moment of receipt of documents.

6. After receipt of approval of authorized bodies on studying and use of subsoil and industrial safety the authorized body in the field of oil and gas issues permission to combustion of gas to the subsoil user.

In permission the amount of the burned gas and permission effective period are specified.

7. When carrying out testing of objects of well for receipt of permission the following documents are attached to the request:

1) the statement, according to form of 1 appendix to these rules, signed by the subsoil user and certified by seal the organizations;

2) the plans of testing of separate objects of well constituted by the subsoil user and approved with territorial authorities of authorized bodies on studying and use of subsoil and industrial safety.

8. In case of test operation of the field for receipt of permission the following documents are attached to the request:

1) the statement, according to form of 1 appendix to these rules, signed by the subsoil user and certified by seal the organizations;

2) form of data according to form 2 appendices to these rules.

9. In case of technology inevitable combustion of gas (in case of commissioning of processing equipment, operation of processing equipment, maintenance and repair work of processing equipment) for receipt of permission the following documents are attached to the request:

1) the statement, according to form of 1 appendix to these rules, signed by the subsoil user and certified by seal the organizations;

2) form of data according to form 3 appendices to these rules.
