About approval of Rules of creation and maintaining the single state inventory of real estate in the Azerbaijan Republic

For the purpose of ensuring creation and maintaining the single state inventory of real estate in the Azerbaijan Republic I decide:

1. Approve "Rules of creation and maintaining the single state inventory of real estate in the Azerbaijan Republic" (are applied).

2. To the state Committee on property questions of the Azerbaijan Republic:

2.1. perform technical inventory count, assessment and capture on the single state cadastral registration of real estate real estate on all the territory of the country irrespective of pattern of ownership and once a year to submit the report on the done work to the President of the Azerbaijan Republic.

2.2. provide implementation of necessary actions in the direction of enhancement of conducting works of the single state inventory of real estate.

2.3. within the powers to resolve other issues following from this Decree.

3. Charge to the Cabinet of Ministers of the Azerbaijan Republic:

3.1. taking into account offers of the State Committee on property questions of the Azerbaijan Republic to resolve issues of financing of works on technical inventory count of real estate in the Azerbaijan Republic;

3.2. to prepare and provide to three-months time to the President of the Azerbaijan Republic the bill of the Azerbaijan Republic "About the single state inventory of real estate";

3.3. prepare and provide to the President of the Azerbaijan Republic offers on reduction of the existing legal acts to compliance with this Decree;

3.4. provide reduction of regulatory legal acts of the Cabinet of Ministers of the Azerbaijan Republic and the relevant central executive bodies according to this Decree and inform on it the President of the Azerbaijan Republic.

Rules of creation and maintaining the single state inventory of real estate in the Azerbaijan Republic

I. General provisions

1.1. These rules establish rules of creation and maintaining the single state inventory of real estate in the Azerbaijan Republic and govern the relations arising in connection with implementation of cadastral activities.

1.2. The single state inventory of real estate is the state information system consisting of the systematized set of data, documents, cartographic materials on the real estate taken on the cadastral registration.

1.3. Creation and maintaining the single state inventory of real estate represents establishment by the state of availability of the real estate units established by the legislation on the indicators brought in the single state inventory of real estate.

1.4. Subject of the single state inventory of real estate is all real estate located in the territory of the Azerbaijan Republic.

1.5. The single state inventory of real estate is property of the Azerbaijan Republic.

1.6. The single state inventory of real estate is constituted and kept by Service of the inventory and address real estate register under Committee on property questions of the Azerbaijan Republic.

II. Principles of creation and maintaining the single state inventory of real estate

4.1.2. implementation of works of the single state cadastral registration;

4.1.3. capture of real estate units on the single state cadastral registration.

V. Filing of application about capture of real estate units on the single state cadastral registration and carrying out primary research works

5.1. The application for capture of real estate units is submitted for the single state cadastral registration by the owner or person representing it based on the power of attorney approved in stipulated by the legislation procedure.

5.1.1. the surname, name, middle name and the applicant's address, and concerning the legal entity - full name and the address are specified in the statement;

5.1.2. the copy of the identity document of the applicant (state registration of the legal entity), and the original document confirming acquisition of right (availability) of the right to the real estate unit is enclosed to the application;
