1. Approve the Instruction about payment procedure of lump-sum allowances in case of death of the military personnel (persons liable for call-up) or receipt of bodily harms by them on duty according to appendix.
2. This order becomes effective after ten days from the date of its state registration in the Ministry of Justice of the Republic of Uzbekistan.

This Instruction according to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of April 30, 1996 N 168 determines payment procedure of lump-sum allowances (further - benefit) in case of death of the military personnel (persons liable for call-up) or receipt of bodily harms by them in case of fulfillment of duties of military service.
1. This Instruction is applied to the military personnel (persons liable for call-up) of the Ministry of Defence of the Republic of Uzbekistan passing:
compulsory military service;
military service in mobilization draft reserve;
military service under the contract;
military service as reservists;
military service as cadets (listeners) of the highest military educational institutions of the Ministry of Defence of the Republic of Uzbekistan.
2. In case of the death of the serviceman which occurred in case of execution of obligations of military service by him the benefit in the amount up to 50 monthly salaries of monetary pay of the dead is paid to members of his family.
In case of receipt of bodily harm by the serviceman (wounds, injuries, contusions) (further - bodily harms) in case of execution of obligations of military service by it, allowance payment is performed in the amount of:
in case of heavy bodily harms - to 25 monthly salaries of monetary pay;
in case of average weight bodily harms - to 10 monthly salaries of monetary pay.
3. The sizes of the benefit paid to contract servicemen of officer, sergeant and ordinary structures or members of their families are estimated from the size of the monetary pay consisting from salary on military rank and official pay rate without any increases and increases, on the date of death or receipt of bodily harms.
4. The sizes of the benefit paid to the military personnel undergoing compulsory military service, military service as cadets (listeners) of the highest military educational institutions or to members of their families are estimated from official pay rates without any increases and increases on the date of death or receipt of bodily harms, and passing military service as reservists and military service in mobilization draft reserve - from salary on military rank and official pay rate - position on which there take place charges.
5. The causal relationship of bodily harms with execution by the military personnel of obligations of military service is determined by the military-medical commissions according to the procedure, the established Regulations on medical examination in Armed Forces of the Republic of Uzbekistan on peace and wartime, the approved resolution of the President of the Republic of Uzbekistan of December 25, 2018 No. PP-4076 and Regulations on procedure for the organization and performing medical examination in Armed Forces of the Republic of Uzbekistan on peace and wartime (reg. No. 3147 of April 3, 2019).
6. The causal relationship of death of the military personnel or receipt of bodily harms by them with fulfillment of duties of military service is determined in cases:participations in fighting, execution of job responsibilities;
executions of alert (active service);
stays in the territory of military unit during the working hours established by daily routine or if it is caused by office need;
stays on official journey or on treatment;
followings to the duty station, treatments or back;
passings of military charges;
stays in captivity (except cases of voluntary surrender), in provision of the hostage or interned;
unknown absence, before recognition of the serviceman it is unknown the missing or announcements the dead in accordance with the established procedure;
to protection of life, health, honor and advantage of the personality;
assistance to law enforcement agencies in law enforcement and law and order;
other actions of the serviceman recognized by court made for the benefit of society and the state;
in other cases, stipulated by the legislation.
7. The military personnel is not recognized the acting as military service:
voluntarily brought themselves to state of drug, alcoholic or toxic intoxication;
the made socially dangerous acts provided by the penal legislation;
the committed suicide or attempt at suicide if the specified actions were not caused by disease state or bringing to suicide;
in case of stay out of arrangement of military unit on vacation, in dismissal or leave, and also in case of unauthorized stay out of arrangement of military unit or the duty station established outside military unit, except as specified stays in captivity, in provision of the hostage or interned, other actions recognized by court made for the benefit of society and the state.
8. If death of the serviceman or receipt of bodily harm by him came under circumstances, stipulated in Item the 7th this Instruction, the benefit is not paid to the serviceman or members of his family.
9. Allowance payment is made by the commander of military unit (the chief of organization) on the duty station of the serviceman.
10. For investigation of circumstances and causes of death, receipt of heavy bodily harms the decision of the top military commander of the military district and the official equated to it creates the special commission. The commission within 15 days makes investigation of circumstances and causes of death, receipts of heavy bodily harm.
