Regulations on qualification classes of judges of courts of Turkmenistan

1. This Provision determines procedure for assignment of qualification classes to judges of the Supreme Court, Arbitration Court, Ashgabat city, velayatsky, city and etrapsky courts of Turkmenistan.

2. For judges of courts of Turkmenistan six qualification classes are established:

the highest qualification class,

first qualification class,

second qualification class,

third qualification class,

fourth qualification class,

fifth qualification class,

3. Qualification classes are appropriated:

the highest qualification class to judges Supreme

first qualification class of court of Turkmenistan

second qualification class

third qualification class

first qualification class to judges of Arbitration Court

second qualification class of Turkmenistan

third qualification class

fourth qualification class

second qualification class to judges Ashgabat

third qualification class city and velayatsky

fourth qualification ships class

second qualification class to judges city and

third qualification class of etrapsky courts

4. Assignment of qualification classes to judges is made by the President of Turkmenistan on representation of the Chairman of the Supreme Court of Turkmenistan.

For the first time qualification classes are appropriated to the appointed judges within the first six months of work.

5. Terms of stay in each qualification class constitute:

in the fifth qualification class 3 years,

in the fourth qualification class of 5 years,

in the third qualification class of 5 years,

in the second qualification class of 5 years,

The term of stay in the first qualification class is not established.

To highly skilled judges taking into account work experience assignment of qualification class regardless of the class provided on post and also without respect for the sequence is allowed.

6. Judges to whom qualification classes are appropriated consist in them for life.

Deprivation of judges of qualification class can take place for violation of legality or making of the discrediting act, incompatible with their high rank, and also owing to the conviction of the court which took legal effect took place concerning them.

Deprivation of qualification class is made by the President of Turkmenistan on representation of the Chairman of the Supreme Court of Turkmenistan.

To the judges having qualification classes surcharges to official pay rates are established.
