About permission of accomplishment of construction works
The parliament adopts this organic law.
(1) Subject of this law is the regulation of procedure for permission, approval and verification of project works, construction or demolition of structures and elements of arrangement according to documentation on town planning and arrangement of the territory, using system of regulating documents in construction for ensuring transparency and publicity in case of issue of administrative acts and creating favorable conditions for entrepreneurship.
(2) Requirements of this law are obligatory for receipt of construction permit of objects of any kind, category, assignment and type of property, except for military and secret sites for which special permission is drawn up.
For the purpose of this law the following basic concepts mean:
the chief architect - the head of local body of architecture and town planning appointed to position in accordance with the established procedure;
construction permit – the act issued by the issuer who allowed accomplishment of construction works on the basis and with observance of conditions of the town-planning certificate for designing and the developed and checked project documentation;
permission to demolition - the act issued by the issuer who allowed performance of works on complete or partial demolition of structure/element of arrangement;
the conclusion on connection to networks - the written instrument valid for one object which is issued to the applicant (customer) by the supplier (the owner of networks) in the form of specifications on connection to engineering networks for ensuring functioning of the constructed object;
the town-planning certificate for designing - the act of the regulating nature issued to the applicant (customer) by the issuer for acquaintance with the instructions and elements characterizing the legal, economic, technical and architectural and town-planning modes of object of the real estate/site, established by documentation on town planning and arrangement of the territory, resolving development of the project documentation;
the information town-planning certificate - the act of optional nature issued to the applicant (customer) by the issuer for acquaintance with the elements characterizing the legal, technical and architectural and town-planning modes of object of the real estate/site, established by documentation on town planning and arrangement of the territory, necessary in case of purchase and sale, leasing, crushing, breakdown, consolidation, separation, inheritance of the site intended for construction or for real estate object in which rebuilding project is provided, and also in case of receivership proceeding;
auxiliary structures, extensions - structures capital or temporality, intended for ensuring the activities accompanying the main functional activities / accommodation which, being located in the neighbourhood with the main structure, create complete functional unit. Treat category of auxiliary structures, extensions: summer kitchens, sheds, rooms for the cattle, warehouses, garages, greenhouses, pools, baths;
temporary structures - the permitted structures which according to documentation on town planning and arrangement of the territory, have the limited term of existence established by the issuer. Belong to the category of temporary structures: booths, stalls, pavilions, cabins, information panels and installations, hoods, pergolas or other similar objects;
the project documentation - text and graphical materials which contain technical and economic solutions on realization of investee in the amount established by regulating documents;
the issuer - executive body of local public authority;
construction works - complex of the operations performed by means of mechanisms, machines and labor power on construction, reconstruction, restoration or strengthening of structure;
works on demolition - complex of the operations performed by means of mechanisms, machines and labor power on complete or partial demolition of structure/element of arrangement;
the plan of laying of networks - the scheme developed by local body of architecture and town planning which reflects the most rational decisions on laying of outside engineering networks according to documentation on town planning and the conclusions on connection to networks;
engineering networks - water supply systems, sewerages, heat supplies, gas supply, electric utility service, electronic communications and other networks;
conceptual design - the graphical materials reflecting the creative idea of the architect regarding architectural concepts and placement of structure which can be realized afterwards in the project documentation. The conceptual design consists of the situational plan, the master plan, facades, color schemes, development of the site of frontal building;
the applicant (customer) - physical person or legal entity which intends to perform the activities falling under operation of this law;
construction queue - constituent part of construction complex which can be designed, constructed, accepted in operation and can autonomous be used before completion of all complex, or the constituent part of the project documentation including works on preparation of construction site.
