According to the Federal Law "About Energy Saving and about Increase in Energy Efficiency and about Modification of Separate Legal Acts of the Russian Federation" Government of the Russian Federation decides:

approve the enclosed Rules of the treatment of production wastes and consumption regarding lighting devices, electric lamps, inadequate collection which accumulating, use, neutralization, transportation and placement can entail damnification of life, to health of citizens, harm to animals, plants and the environment.

Rules of the treatment of production wastes and consumption regarding lighting devices, electric lamps, inadequate collection which accumulating, use, neutralization, transportation and placement can entail damnification of life, to health of citizens, harm to animals, plants and the environment

I. General provisions

1. These rules establish procedure for the treatment of production wastes and consumption regarding lighting devices, electric lamps, inadequate collection which accumulating, use, neutralization, transportation and placement can entail damnification of life, to health of citizens, harm to animals, plants and the environment.

These rules are obligatory for legal entities (irrespective of form of business) and the individual entrepreneurs including exercising control of apartment houses based on the signed agreement or the rooms of the apartment house which signed with owners service provision agreements on content and repair of common property in such house (daleeyuridichesky persons and individual entrepreneurs) and also physical persons.

2. The concepts used in these rules mean the following:

"the fulfilled mercury-containing lamps" - the mercury-containing waste which is representing taken out of service and subject to utilization lighting devices and electric lamps with mercury filling and content of mercury percent 0,01 suffices;

"use of the fulfilled mercury-containing lamps" - application of the fulfilled mercury-containing lamps for production of goods (products), performance of works, rendering services or receipt of energy;

"consumers of mercury-containing lamps" - the legal entities or individual entrepreneurs who do not have license for activities on neutralization and placement of waste of the I-IV class of danger and also the physical persons operating lighting devices and electric lamps with mercury filling;

"accumulating" - storage by consumers of mercury-containing lamps, except for physical persons, the quantity of the fulfilled mercury-containing lamps permitted in accordance with the established procedure;

"the specialized organizations" - the legal entities and individual entrepreneurs performing the collection, use, neutralization, transportation and placement of the fulfilled mercury-containing lamps having licenses for activities on neutralization and placement of waste of the I-IV class of danger.

the place of primary collection and placement" - the place for preliminary collection and temporary placement of the fulfilled mercury-containing lamps before transfer to their specialized organizations for further collection, use, neutralization, transportation and placement;

"container" - the packaging reservoir ensuring safety of mercury-containing lamps in case of storage, pogruzo-unloading works and transportation;

"hermeticity of container" - capability of cover (body) of container, its separate elements and connections to interfere with gas or liquid exchange between the environments divided by this cover.

3. Legal entities and individual entrepreneurs according to these rules and other regulatory legal acts develop instructions on the organization of collection, accumulating, use, neutralization, transportation and placement of the fulfilled mercury-containing lamps in relation to specific conditions and appoint in accordance with the established procedure responsible persons for the address with the specified waste.

II. Procedure for collection and accumulating of the fulfilled mercury-containing lamps

4. Consumers of mercury-containing lamps (except physical persons) perform accumulating of the fulfilled mercury-containing lamps.

5. Accumulating of the fulfilled mercury-containing lamps is made separately from other types of waste.

6. Independent neutralization, use, transportation and placement of the fulfilled mercury-containing lamps by consumers of the fulfilled mercury-containing lamps, and also their accumulating in the places which are common property of owners of rooms of the apartment house, except for placements in places of primary collection and placement and transportation to them is not allowed.

7. Consumers of mercury-containing lamps (except physical persons) for accumulating of the damaged fulfilled mercury-containing lamps shall use container.

8. Local government bodies will organize collection and determine the place of primary collection and placement of the fulfilled mercury-containing lamps at consumers of mercury-containing lamps (except the consumers of mercury-containing lamps who are owners, employers, users of rooms in apartment houses and having the agreement of management of apartment houses or the agreement of rendering services and (or) performance of works signed by owners of the specified rooms on content and repair of common property in such houses), and also their informing.

8(1). At the consumers of mercury-containing lamps who are owners, employers, users of rooms in apartment houses, collection and placement of the fulfilled mercury-containing lamps are provided by persons exercising control of apartment houses based on the agreement of management or the agreement of rendering services and (or) performance of works signed with owners of rooms of apartment houses on content and repair of common property in such houses, in the places which are common property of owners of apartment houses and containing according to the requirements to content of common property provided by the Rules of content of common property in the apartment house approved by the order of the Government of the Russian Federation of August 13, 2006 No. 491.
