About cotton growing

This Law determines legal, organizational and economic basis of cotton growing in the Azerbaijan Republic, governs the relations connected with turnover of cotton raw materials and cotton products.

Section I. General provisions

Article 1. Basic concepts

1.0. The concepts used in this Law have the following values:

1.0.1. cotton growing - the sphere of crop production occupied with cultivation of cotton and production of cotton raw materials;

1.0.2. raw cotton - the fibrous weight which is not separated seeds;

1.0.3. cotton products - the cotton fiber, lint, seed and waste of fiber received during slaughtering of seed cotton (further - cotton);

1.0.4. fiber - the fibrous weight separated cotton seed when slaughtering;

1.0.5. seed - the cotton seed separated fiber during slaughtering;

1.0.6. sowing seed - the cotton seed received in overtime of seed cotton and intended for landing;

1.0.7. cotton slaughtering - drainage, cotton clarification by industrial method, production process of cotton products by department of fiber from seed

1.0.8. examination of quality of cotton and fiber - capture on the analysis of samples for measure definition of the actual quality of cotton and fiber and action for documentation of their quality;

1.0.9. turnover - sale, import and export of cotton and products from cotton.

Article 2. Legislation of the Azerbaijan Republic on cotton growing

2.1. The legislation of the Azerbaijan Republic on cotton growing consists of the Constitution of the Azerbaijan Republic, the civil and agrarian legislation, international treaties which participant is the Azerbaijan Republic, this Law and other regulatory legal acts.

2.2. In case of contradictions between the rules about regulation of production, conversion and turnover of production of cotton, and also quality of cotton products determined in international treaties which party is the Azerbaijan Republic and the rules provided in this Law rules of these international treaties are applied.

Article 3. Law purpose

The purpose of this Law is creation of the legal and economic soil for development of cotton growing in the country, regulations of the relations between production and conversion of cotton in compliance with market economy, growth of competitiveness of cotton and cotton products, integration of cotton growing into the light and food industry.

Article 4. The directions of state policy in the field of cotton growing

The main directions of state policy in the field of cotton growing consist of stimulation of investing activities and cooperation in cotton growing, expansions leasing and agroservices, use of the new equipment and technologies, increase in quality of cotton products and their export, improvement of scientific providing cotton growing.

Article 5. Obligations of the state in the field of cotton growing

5.0. For ensuring development of cotton growing the state performs the following obligations:

5.0.1. adopt regulatory legal acts and regulating documents on cotton growing;

5.0.2. approve state programs on development of cotton growing, and also provide development of cotton growing on the basis of clusters;

5.0.3. accept the technical standard rates concerning production, conversion and turnover of cotton and cotton products;

5.0.4. approve the standards and other regulating documents determining quality of cotton and cotton products;

5.0.5. study the market of cotton and cotton products, prepare forecasts, determine the main directions of development of the spheres connected with cotton growing;

5.0.6. determine agrotechnical regulations on sites of cotton and technology regulations in cotton conversion, exercise control of application of remedies of the plants used during cotton cultivation;

5.0.7. in compliance with the legislation to exercise control of production, conversion of seed cotton and of turnover of seeds;

5.0.8. organize training of specialists in the field of cotton growing, enhancement of their specialization and to finance scientific providing cotton growing;

5.0.9. perform other obligations in the direction of development of cotton growing.

Section II. Production and slaughtering of cotton

Article 6. Cotton production

6.1. Production of cotton is performed by the legal entities and physical persons operating according to the legislation irrespective of pattern of ownership and legal form.

6.2. Cultivation, collection, storage and transportation of cotton on the company of conversion of cotton are performed according to requirements of regulating documents and technology regulations.

6.3. Production of cotton consists of production of seeds and technical cotton.

Article 7. Production of seed cotton

7.1. The legal entities and physical persons included in the register of producers of seeds according to the rule, stipulated by the legislation can be engaged in production of seeds of cotton.

7.2. According to the legislation production of seed cotton consists of production of original, superelite, elite and reproductive seeds.

7.3. According to the rules provided in the legislation, original and superelite seed cotton is grown up, gathers separately on pilot farms of the relevant research and educational institutions, the seed separates from fiber and is stored in workshops of conversion and the received seed for reproduction is used in the corresponding form.

7.4. Collection of elite seed cotton by means of machines and mechanisms is not allowed.

7.5. Production of elite and reproductive seed cotton is performed in the state and family seed productions, processed at the companies of conversion and the received seed is used for ensuring production of repeated seed or technical cotton. Use of the seed not suitable for crops is not allowed.

7.6. Seeds not of rayonizirovanny and imported grades of cotton can be grown up only for the purpose of experiences and testing, under control of relevant organ of the executive authority.

7.7. Seed cotton, held for use in the farms making technical cotton is processed separately at the companies for conversion of cotton and the received sowing seed is used for seed cotton.

7.8. Assessment, certification of seed cotton and quality of seeding of seeds, the organization of network of seed farming and other questions connected with cotton seed farming are regulated by the relevant legislation of the Azerbaijan Republic.

7.9. the fiber, lint and waste of fiber received from seed cotton are used for designated purpose.

Article 8. Production of technical cotton

8.1. The purpose in production of technical cotton is ensuring need for products from cotton guaranteeing development of the light and food industry.
