About food security

This Law according to the social and economic strategy of the President of Turkmenistan Saparmurat Turkmenbasha determines the main directions of realization of state policy in the sphere of ensuring food security of Turkmenistan, and also establishes the legal basis of implementation by citizens of the right to healthy and good nutrition.

Article 1. Food security of Turkmenistan

Food security of Turkmenistan - state of the economy of the state in case of which the necessary production rate of the vital food and food raw materials is provided, and also is guaranteed availability of food to all population in the quantity necessary for active and healthy life.

At the same time the vital food are understood as the food which are on structure and amounts basis of diet of the population of Turkmenistan.

The procedure for determination of the necessary production rate of food is established by the Cabinet of Ministers of Turkmenistan according to existing rules of international law in the sphere of providing with food.

Article 2. Legal basis of food security

The legal basis of food security are the Constitution of Turkmenistan, this Law, the conventional principles and rules of international law, the international agreements of Turkmenistan, and also other regulatory legal acts adopted on their basis on realization of the rights of citizens to requirements satisfaction in food.

Article 3. Ensuring food security

Food security of Turkmenistan is ensured by the Cabinet of Ministers of Turkmenistan, bodies of the local executive authority.

Basis of assessment of level of food security of Turkmenistan is the balance of the necessary and actual production rates of food which is annually constituted by the Cabinet of Ministers of Turkmenistan.

Article 4. The state guarantees in the sphere of food security

Turkmenistan according to state programs in the field of social and economic development, the national legal system, the universally recognized norms of international law guarantees the right of citizens to healthy and good nutrition by means of:

development and implementation of the legal, economic, organizational, technical and other measures directed to production of necessary food and food raw materials;

ensuring uninterrupted receipt of food to places of their consumption in the amounts sufficient for population requirements satisfaction;

ensuring availability of acquisition with the population of food, including on favorable terms, under the existing structure of consumption, price system and level of the income;

creations, updates and replenishments of the state food reserve consisting of not reduced operational inventory of food products;

the state control of compliance to requirements of the state system of the quality standards of the food made and realized to citizens and food raw materials.

In some cases the Cabinet of Ministers of Turkmenistan has the right to establish special procedure for providing the population with necessary food.

Article 5. Powers of the Cabinet of Ministers of Turkmenistan in ensuring food security

For the purpose of ensuring food security Cabinet of Ministers of Turkmenistan, authorized ministries and departments of Turkmenistan:

perform measures for carrying out single state policy in the sphere of food security;

develop and realize the state target programs of ensuring food security;

coordinate activities of the state bodies and services ensuring food security of the state;

create the state incentive system and regulations of production of food and food raw materials;

represent to the President of Turkmenistan offers on structure and competence of the state bodies of the executive authority responsible for ensuring food security of the state;

provide compliance of quality of the food made and realized to citizens to requirements of the state system of standards;

exercise control of the state food reserve, bear responsibility for its safety, use and renewal;

determine the purposes and tasks of bodies of the local executive authority and local self-government by ensuring food security;

will organize collection and data analysis about supply of the population with the vital food, and also preparation of projections of development of the situation in the sphere of food security.

Article 6. Powers of bodies of the local executive authority in ensuring food security

Hyakima of welayats, the cities, etraps and archyna perform the following powers in the territory of the corresponding administrative and territorial units:

realize measures for carrying out state policy in the sphere of food security;

coordinate activities of the companies, organizations and organizations for ensuring food security;

exercise control of quality of the made food and food raw materials;

provide to the central public authorities necessary information in the sphere of food security.

Hyakima and archina bear the personal responsibility for providing the population with food.

Article 7. Information in the sphere of food security

Information in the sphere of food security shall include:

quantity characteristic of the corresponding balances of the necessary and actual production rates of food;

data on production and consumption of food, supply with them;

analysis of condition and tendency of market development of agricultural raw materials and food;

data on accomplishment of the state target programs and on implementation of actions for ensuring food security;

the analysis of condition on control of observance of the state and industry standards, regulations and standard rates in the sphere of food security.

The procedure for provision of information in the sphere of food security is determined by the Cabinet of Ministers of Turkmenistan.

Article 8. State control of ensuring food security

The state control of ensuring food security is exercised for the purpose of execution of this Law, realization of the state guarantees in the sphere of food security, accomplishment of programs and implementation of actions for food security.

The state control of ensuring food security is exercised by the Cabinet of Ministers of Turkmenistan, state governing bodies responsible for ensuring food security of the state, and also other bodies authorized by the Cabinet of Ministers of Turkmenistan.

The state control of ensuring food security is exercised at the companies, in organizations and the organizations, irrespective of the patterns of ownership which are engaged in the territory of Turkmenistan in production, storage and sales of products of food and food raw materials.
