About order of registration and conducting registration accounting of persons of no fixed abode

(as amended on 27-08-2021)

Based on the paragraph of third of part one of Item 12 of the Regulations on registration of citizens at the place of residence and the place of the stay approved by the Presidential decree of the Republic of Belarus of September 7, 2007 No. 413, Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Regulations on order of registration and conducting registration accounting of persons of no fixed abode it (is applied).

2. This resolution becomes effective since September 17, 2010.

Regulations on order of registration and conducting registration accounting of persons of no fixed abode

1. This Provision determines order of registration and conducting registration accounting of persons of no fixed abode in the territory of the Republic of Belarus by the place of their stay.

2. For the purposes of this provision the following terms and determinations are used:

persons of no fixed abode – the citizens of the Republic of Belarus, stateless persons which do not have the registration at the place of residence or the place of stay in the Republic of Belarus which lost socially useful and family relations which are engaged in vagrancy and (or) begging, and also not having permanent source of the income and means of livelihood;

Items of registration and registration accounting of persons of no fixed abode – Items of social adaptation and resocialization, the centers of temporary stay of persons of no fixed abode, in case of lack of such Items (centers) – the places determined by the relevant local executive and administrative organs of basic territorial level;

body of registration of citizens in the place of stay (further – body of registration) – law-enforcement body (in the cities, settlements of city type where there are law-enforcement bodies), rural (settlement) executive committee (in rural settlements and settlements of city type in which there are no law-enforcement bodies);

identity documents, – the passport of the citizen of the Republic of Belarus, the ID card of the citizen of the Republic of Belarus, the residence permit in the Republic of Belarus, the biometric residence permit in the Republic of Belarus stateless persons (further – identity documents).

3. Registration and registration accounting of persons of no fixed abode are performed by body of registration in the location of Item of registration and registration accounting of such persons for the purpose of:

social adaptation and resocialization of these persons with the subsequent integration into society;

confirmations of the personality and belonging of these persons to nationality of the Republic of Belarus;

assistance in receipt of the identity document by them;

registrations of registration in the place of stay and provision of housing for temporary residence.

4. Are registered and put on registration accounting of the person of no fixed abode, being:

the citizens of the Republic of Belarus who do not have registration at the place of residence (stay) in the Republic of Belarus, earlier having registration at the place of residence in the settlement located in the territory of the corresponding administrative and territorial unit, living in place of registration as the owner (employer) of premises or the member of the family of the owner (employer);

the stateless persons having permission to permanent residence in the Republic of Belarus, but which lost registration at the place of residence in case of lack of the bases for their dispatch or deportation.

5. Together with the person of no fixed abode the minor citizens who are constantly staying with it for whom this person is parent can be registered and delivered on registration accounting.

6.  No. 1170 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 01.09.2011

7. Registration and registration accounting of persons of no fixed abode are performed on voluntary basis according to the application in person.

8. For registration and statement for registration accounting of the person of no fixed abode represent to body of registration:

the written application about statement on registration accounting of the person of no fixed abode of any form with indication of the reasons of removal from registration accounting at the place of residence in this settlement;

the passport or other identity document, the certificate of birth – for the minor citizens specified in Item 5 of this provision, who do not have passports and other identity documents;

the document confirming the fact of removal from registration accounting at the place of residence in this settlement (the copy of the judgment, the copy of personal account and others);

the statement for registration in the place of stay in the form established by the Ministry of Internal Affairs – in the presence of the bases for registration in the place of stay;

the document confirming payment by the citizen of the state fee for registration in the place of stay (except as specified releases from its payment, provided by legal acts).

Other necessary documents for registration of the person of no fixed abode are requested in state bodies and other organizations by the official of body of registration during the day after receipt of the statement from the face without certain residence.

9. Registration in the place of stay of the person of no fixed abode is performed for a period of up to one year by entering of information about him into the book of registration of persons of no fixed abode in form according to appendix.

10. The official of body of registration in three-day time after receipt of the documents necessary for registration in the place of stay, fills address leaves of arrival, coupons of migration registration to address leaves of arrival in the forms approved by the Ministry of Internal Affairs.

In day of adoption of the positive decision on registration in the place of stay of the person of no fixed abode by the official of body of registration data are entered into information systems (resources) of the Ministry of Internal Affairs.

11. To the person of no fixed abode registered in accordance with the established procedure the registration certificate in the place of stay in the form approved by the Ministry of Internal Affairs, except as specified registration under biometric identity documents or minors according to certificates of birth is granted.

12. The registration authorities located in Minsk and the regional centers direct address leaves of arrival in address reference bureaus of Main Department of Internal Affairs of the Minsk Gorispolkom, the Departments of Internal Affairs of regional executive committees no later than the next day after registration of the person of no fixed abode in the place of stay.
