Rules of filing of application about provision of lump sum payment for the account of means of the maternity (family) capital and procedure for its implementation

1. These rules and procedure (further - Rules) regulate filing of application about provision of lump sum payment for the account of means of the maternity (family) capital by persons who received according to the Federal Law of December 29, 2006 N 256-FZ "About additional measures of the state support of the families having children" (The Russian Federation Code, 2007, N 1, Art. 19; 2008, N 30, Art. 3616; N 52, of Art. 6243; 2010, N 31, the Art. 4210) the state certificate on the maternity (family) capital (daleesertifikat), living in the territory of the Russian Federation, and procedure of lump sum payment to these persons.

2. Persons, personally, their legal representatives specified in Item 1 of Rules or authorized representatives have the right to address to territorial authority of the Pension Fund of the Russian Federation at the place of residence or the actual accommodation for receipt of lump sum payment at the expense of means of the maternity (family) capital by filing of application about provision of lump sum payment for the account of means of the maternity (family) capital (further - the statement) with all necessary documents specified in Item 6 of Rules irrespective of the term which expired since birth (adoptions) of the second, third child or the subsequent children:

no later than December 31, 2010 - if the right to additional measures of the state support arose (arises) from January 1, 2007 to September 30, 2010 inclusive;

no later than March 31, 2011 - if the right to additional measures of the state support arises from October 1, 2010 to December 31, 2010 inclusive.

The statement and documents specified in Item 6 of Rules can be sent to territorial authority of the Pension Fund of the Russian Federation by mail. In this case copies of documents which fidelity is attested in the procedure established by the law go, originals of documents do not go.

The direction of the statement and the documents specified in Item 6 of Rules by mail is performed by the method allowing to confirm the fact and date of departure.

3. If the right to additional measures of the state support arose at child(children) on the bases provided by parts 4 and 5 of article 3 of the Federal Law of December 29, 2006 N 256-FZ "About additional measures of the state support of the families having children" the application can be submitted by child(children) on reaching it (them) age of majority or acquisition by it (them) capacities in full till December 31, 2010 inclusive and if the specified lump sum payment was not received earlier by his parents (adoptive parents) or other законными# the representative.
