About additional measures for enhancement of the mechanism of forming and program implementation of localization of production of finished goods, components and materials on the basis of industrial cooperation
In pursuance of the Resolution of the President of the Republic of Uzbekistan of December 1, 2009 No. PP-1236 and for the purpose of further enhancement of the mechanism of forming and program implementation of localization of production of finished goods, components and materials on the basis of industrial cooperation with accurate distribution of functions and differentiation of powers of the Cabinet of Ministers authorized bodies decides:
1. Approve in the new edition:
Regulations on procedure for forming of the Program of localization of production of finished goods, components and materials on the basis of industrial cooperation, according to appendix No. 1;
Regulations on procedure for issue of the conclusions about reference of the imported processing equipment and spare parts to it, and also components, raw materials and materials to category used in engineering procedure in case of production of localizable products, according to appendix No. 2.
2. During the forming and implementation of annual Programs of localization of production of finished goods, components and materials on the basis of industrial cooperation it is strict to Ministry of Foreign Trade, Ministry of Economics of the Republic of Uzbekistan, State committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition to other departments and business entities to be guided by the provisions and normative requirements approved by the Resolution of the President of the Republic of Uzbekistan of December 1, 2009 No. PP-1236, and this resolution.
3. To the Ministry of Finance, the State Tax Committee, the State Customs Committee of the Republic of Uzbekistan together with the interested ministries and departments, proceeding from the provisions approved by this resolution, in two weeks to introduce the corresponding amendments in procedure for application of the tax and customs privileges provided according to Item 6 of the resolution of the President of the Republic of Uzbekistan of March 23, 2010 to No. PP-1306 to the companies included in the Program of localization of production of finished goods, components and materials on the basis of industrial cooperation for 2010.
5. To the Ministry of Foreign Economic Relations, Investments and Trades, the Ministry of Economics of the Republic of Uzbekistan together with other ministries and departments to bring departmental regulatory legal acts into accord with this resolution.
6. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan R. S. Azimov.

to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of July 21, 2010 No. 154
1. This Provision is developed according to the Regulations on order of interaction of state bodies and initiators of projects in the course of forming of the Program of localization of production of finished goods, components and materials on the basis of industrial cooperation approved by the resolution of the President of the Republic of Uzbekistan of December 1, 2009 No. PP-1236 "About additional measures for deepening of localization of production of finished goods, components and materials on the basis of industrial cooperation".
The provision provides creation of complete system of forming and program implementation of localization of production of finished goods, components and materials on the basis of industrial cooperation (further - the Program of localization), with accurate distribution of functions and differentiation of powers of the Ministry of Economics, Ministry of Foreign Trade and other bodies, and also determines the mechanism of system monitoring of the Program of localization.
2. Approval of the Program of localization of production of finished goods, components and materials on the basis of industrial cooperation is performed in accordance with the established procedure by the President of the Republic of Uzbekistan.
3. The decision on inclusion of new projects in the Program of localization, and also entering of adjustments into adopted agenda of localization is accepted:
The special interdepartmental commission on providing program implementation of localization of production of finished goods, components and materials on the basis of industrial cooperation (further - the Special interdepartmental commission) - regarding entering of adjustments into parameters of drafts of the Program of localization, except for decrease in the established localization level;
The Cabinet of Ministers - regarding modification of parameters and the list of projects of localization, according to offers of the Special interdepartmental commission.
The growth in volumes of production of localizable products to which the privileges provided within Programs of localization extend is performed by initiators of projects within production capacities without approval of the Special interdepartmental commission and the Cabinet of Ministers.
4. Forming of the Program of localization, and also system monitoring of the course of its realization and introduction of adjustments is performed according to the scheme according to appendix No. 1.
5. The program of localization is created by the Secretariat of the Special interdepartmental commission on providing program implementation of localization of production of finished goods, components and materials on the basis of industrial cooperation consisting of number of persons employed of the Ministry of Economics of the Republic of Uzbekistan (further - the Secretariat of the Special interdepartmental commission), taking into account the represented offers:
The Ministries of Foreign Trade of the Republic of Uzbekistan, amounts developed by results of the deep analysis, structure of the imported products, system studying of environment of the foreign markets, in form according to appendix No. 2;
The state committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition, developed proceeding from assessment of level of monopolization and development of competitive environment, saturation of the domestic market by goods (services) taking into account their interchangeability and price factor, in form according to appendix No. 3;
The Ministries of Economics, developed together with the Ministry of agricultural and water economy, the State committee of the Republic of Uzbekistan on geology and mineral resources, Republican design institute "Uzinzhiniring" and other specialized institutes on the basis of the analysis of natural, mineral and raw, potential, scientific and technical and labor production, and also the corresponding infrastructure of regions of the republic;
initiators of projects - the ministries, departments, public authorities on places, economic associations and the companies (further - initiators of projects).
6. The secretariat of the Special interdepartmental commission in week time generalizes the offers on development of new types of localizable products which arrived from the Ministry of Foreign Economic Relations, Investments and Trades, the State committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition, the Ministry of Economics of the Republic of Uzbekistan and sends them to the ministries, economic associations, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent.

8. The ministries, economic associations, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent together with the companies in two weeks study the offers directed by the Secretariat of the Special interdepartmental commission in detail and in coordination with the Ministry of Foreign Trade and the Ministry of Economics of the Republic of Uzbekistan submit for approval to the corresponding complexes of the Cabinet of Ministers of action, the providing stages and terms of development of new types of localizable products (approval of technical parameters and quality requirements of the mastered products, production preparation, release of prototype and its testing, readiness for serial production), and also executives in charge.
The secretariats of the Cabinet of Ministers within three days provide approval of the specified actions by the corresponding deputies and advisers to the Prime Minister of the Republic of Uzbekistan and perform monitoring of the course of development of new types of localizable products.
9. In case of absence of the companies which showed willingness to master production of new types of localizable products, the Secretariat of the Special interdepartmental commission directs the offer in:
The state committee of the Republic of Uzbekistan on investments - about feasibility of attraction of foreign investments for development of recommended types of localizable products;
Academy of Sciences of the Republic of Uzbekistan - about feasibility of development of the acceptable scheme of placement of production of nodes and details for development of more difficult types of localizable products on the basis of industrial cooperation at several companies, and also developments of new effective technologies and carrying out research and development works (Research and Development).
10. The Ministry of Economics based on offers of the State committee of the Republic of Uzbekistan on investments and Academy of Sciences of the Republic of Uzbekistan quarterly submits for approval in the Secretariat concerning the macroeconomic analysis, structural transformations, financial bank system and private entrepreneurship, reforming of bank and financial systems, coordination of activities of free economic and small industrial zones of action, the providing stages of development of projects of localization with attraction of foreign investments, and also schemes of placement of production of nodes and details for difficult types of localizable products, including by formation of the new companies in regions of the republic.
11. The ministries, economic associations, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent provide:
contractual registration of conditions of development of cooperation in development of production on industry and regional industrial fairs;
accomplishment of the approved actions for the localization of production recommended for development;
for inclusion of the project in the Program of localization
- development and submission to the Secretariat of the Special interdepartmental commission of documents according to the procedure, established by this Provision.12. The basis for entering of the offer on inclusion of the project into the Program of localization is compliance of its parameters to the following criteria:
a) availability of capacities and local raw material resources for production organization of localizable products;
b) achievement of level of localization at least 36 percent on products in the first year, at least 45 percent in the second year and at least 50 percent in the third year from the moment of inclusion in the Program of localization at the same time, for products of mechanical engineering and metal working of 36 percent, 40 percent and 45 percent respectively;
c) the share of export of the localized products in net revenue from its realization shall constitute at least 20 percent in the second year and at least 30 percent in the third year from the moment of inclusion in the Program of localization;
e) ensuring change of goods item of end products by the Commodity Nomenclature of Foreign Economic Activity code in comparison with initial raw materials at the level of, at least, one of the first four signs;
e) availability of demand for localizable products in the internal and external markets;
g) availability of import of similar products (except cases of production of new types of products);
h) availability of agreements or preliminary arrangements with potential consumers of products;
i) sales price of localizable products not of high price of the similar imported products (taking into account transportation expenses to the Republic of Uzbekistan, taxes and customs payments).
