About lands of power and legal regime of special zones of energy objects

This Law determines the legal and organizational principles of provision and use of the parcels of land for placement of objects of power, establishment and observance of legal regime of lands of special zones of objects of power for the purpose of ensuring smooth functioning of these objects, rational use of lands, and also safe life activity and protection of the population and economic objects from influence of possible accidents.

Section I. General provisions

Article 1. Terms and their determinations

In this Law the stated below terms are used in such value:

emergency on power objects - condition of objects of power which is characterized by violation of borders of the parcels of land under these objects and/or conditions of safe operation, but which did not lead to accident;

the earth of power - the parcels of land provided in accordance with the established procedure for placement, construction and operation of the power generating companies, the objects of alternative power engineering, subjects to transfer of electrical and heat energy, production facilities necessary for operation of objects of power, including bases and Items;

zone of influence of the electromagnetic field - space in which tension of electric field exceeds admissible regulations;

zone of observation of nuclear installation and the object intended for the treatment of radioactive waste - the territory, on which perhaps radiation influence of nuclear installation and the object intended for the treatment of radioactive waste on the population living in this zone;

cable power line - the line for transfer of electrical energy or its separate impulses constituted from one or several in parallel the laid cables, cable armature, systems which are supported by cables, and devices of fixture and support of cables and armature;

accident elimination - carrying out complex of the actions including emergency and recovery and other urgent works (including mitigation of consequences of accidents) which are carried out in case of accidents and are carried out on object or in its conservation zone;

linear object of energy infrastructure - complex of objects of energy infrastructure, including the land, elevated and underground objects connected by air and cable lines and intended for transfer and distribution of electrical energy, and also the building and construction up to 200 square meters, including electric substations, transformer substations, distribution points and devices, constructions of supporting frameworks, the service equipment, related single engineering procedure which provide safe and reliable operation, production, transfer and distribution of electrical and heat energy;

the high-level thermal network - complex of pipelines and pumping points which provides transfer of hot water and couple from power plants and boiler rooms in local (local) thermal network;

subjects to transfer of electrical energy - air and cable power lines, transformer substations, distribution points and devices;

power object - power plant (except nuclear part of nuclear power plant) the linear object of energy infrastructure, electric substation, power network connected to the integrated power system of Ukraine and also the boiler room connected to the high-level thermal network, the high-level thermal network, construction of alternative power engineering and so forth;

especially important object of power - object which provides permanent functioning of the integrated power system of Ukraine destruction or damage of which will lead to violation of electric utility service of business entities and the populations, to the possible human victims and considerable loss of property;

the conservation zone of the high-level thermal networks - the part of the land surface, airspace and subsoil along pipelines and objects of thermal networks limited to the conditional planes parallel to its axes on which carrying out economic activity for providing stable service conditions, prevention of damage is limited;

conservation zones of objects of power - zone along air and cable power lines, around power plants, transformer substations, distribution points and devices and the high-level thermal networks, constructions of alternative power engineering and so forth for providing normal conditions of their operation, prevention of damage, and also for reduction of their negative impact by people, adjacent lands, natural objects and the environment;

electricity transmission air-line - the electroinstallation intended for transfer of electrical energy on the wires located under the open sky and attached by means of insulators and fittings to support or brackets and struts on engineering constructions (bridges, overpasses and so forth);

legal regime of special zones of objects of power - the specific mode of use of lands by owners and users of the parcels of land set by the legislation, and also the companies which perform operation of objects of power, aimed at providing normal conditions of their operation and prevention of damage;

glade - strip in forest, forest-park, garden and country arrays on which there passes the electricity transmission air-line cleared of trees and bushes which reduce distance to wires to unacceptable value or threaten with fall on wires and designs of power networks;

clearing of glade - cutting down of samoseyny trees and bushes, and also removal them from the strip which is taken away under glade;

the sanitary protection zone of objects of power - the territory along power lines, around transformer substations, distribution points and devices which is established for protection of the population against the adverse effect of electric fields caused by their certain tension;
