About folk art and applied art of Turkmenistan

This Law according to the strategy of the President of Turkmenistan Saparmurat Turkmenbasha in the spiritual and moral sphere determines legal, economic and organizational basis of revival, preserving and development of folk art and applied art of Turkmenistan.

Chapter I. General provisions

Article 1. Concept of folk art and applied art

Folk art and applied art is the historically created type of activity connected with creation of the products reflecting original art traditions of the people of Turkmenistan.

Article 2. Bases of state policy in the field of folk art and applied art

The main directions of state policy in the field of folk art and applied art are:

- realization of legislative and organizational measures on the state support of folk art and applied art;

- forming of financial sources for development of folk art and applied art;

- provision of opportunities of use by the companies, organizations and citizens of necessary material and information resources, and also scientific and technical developments and technologies;

- the organization, preparation and advanced training of personnel in this sphere;

- promotion of folk art and applied art, including by means of development of the international exchange and foreign economic activity;

- assistance to development of commercial, scientific and technical, production and information intercourses of the companies, organizations and citizens which are engaged in folk art and applied art;

- the organization of specialized trade in products of folk art and applied art according to the procedure, established by the legislation of Turkmenistan;

- creating favorable conditions to the companies, the organizations and citizens for procurement and acquisition of raw materials and the materials necessary for production (production) of products of folk art and applied art;

- implementation of other measures directed to revival, preserving and development of folk art and applied art.

Article 3. The legislation of Turkmenistan in the field of folk art and applied art

1. The legislation of Turkmenistan in the field of folk art and applied art consists of this Law and other regulatory legal acts of Turkmenistan.

2. If international treaties of Turkmenistan establish other rules, than those which contain in this Law then are applied regulations of international treaties.

Article 4. State regulation in the field of folk art and applied art

1. State regulation in the field of folk art and applied art is performed by the Cabinet of Ministers of Turkmenistan, the Ministry of Culture of Turkmenistan, bodies of the local executive authority and local self-government, and also other authorized state bodies.

2. The Cabinet of Ministers of Turkmenistan in the field of folk art and applied art:

- pursues single state policy in the field of folk art and applied art;

- develops and adopts state programs on preserving, revival and support of folk art, provides their realization;

- performs legislative and organizational measures on legal and social security of the citizens, the companies and organizations which are engaged in folk art and applied art;

- will organize the state training system and advanced trainings in this sphere;

- promotes development of material and financial resources of the companies, organizations and citizens which are engaged in production (production) of national products;

- resolves other issues carried to competence of the Cabinet of Ministers of Turkmenistan by the legislation of Turkmenistan.

3. The Ministry of Culture of Turkmenistan in the field of folk art and applied art:

- realizes state programs of support and development of folk art and applied art;

- will organize carrying out the corresponding scientific research;

- carries out experimental work on problems of revival traditional and to creation of new types of products of folk art;

- creates the cultural centers of folk art and applied art;

- will organize exhibitions of the products having historical, art, scientific or other cultural value;

- provides forming and development of system of succession in the field of folk art and applied art;

- will organize production of souvenir products;

- resolves other issues carried to competence of the Ministry of Culture of Turkmenistan by the legislation of Turkmenistan.

4. Bodies of the local executive authority and local self-government provide necessary material and organizational conditions for preserving, revival and development of folk art and applied art.

Chapter II. Activities in the field of folk art and applied art

Article 5. Core activities in the field of folk art and applied art

Core activities in the field of folk art and applied art are:

- rug weaving;

- production of felt products with use of national ornaments and drawings;

- jewelry;

- national embroidery and knitting;

- ceramics;

- production of national fabrics;

- production of national musical instruments;

- production of traditional products from skin and fur;

- production of products from tree.

Article 6. Organizational bases in the field of folk art and applied art

Activities in the field of folk art and applied art can be performed on professional or amateur basis in the form of individual business activity, home work, creation of the companies and the organizations which are engaged in production of folk art and applied art and other forms, stipulated by the legislation Turkmenistan.

Article 7. The companies and the organizations performing activities in the field of folk art and applied art

1. The companies and the organizations performing activities in the field of folk art and applied art are the companies and the organizations in which total production of products (works) of product (work) of folk art and applied art constitute 50 and more percent.

2. At the companies and in the organizations performing activities in the field of folk art and applied art experimental laboratories and creative groups on development of new types of products and enhancement of engineering procedures of their production can be created.

Article 8. The rights of the citizens performing activities in the field of folk art and applied art

The citizens performing activities in the field of folk art and applied art have the right on:

- protection of the creative intention;

- occupation scientific research;

- exhibiting and other forms of public display of results of the activities;

- remuneration for public use of results of the intellectual activities;

- access to funds in the field of culture;
