About state registration of acts of civil status

This Law determines legal and organizational basis of state registration of acts of civil status.

Section I. General provisions

Article 1. Scope of the Law

1. This Law governs the relations connected with carrying out state registration of acts of civil status, entering into assembly records of civil status of changes, their renewal and cancellation, determines bases of activities of bodies of state registration of acts of civil status.

2. Operation of this Law does not extend much carrying out registration of citizenship of Ukraine.

Article 2. Acts of civil status

1. Acts of civil status are events and actions which are inseparably linked with physical person and begin, change, supplement or stop its opportunity to be subject of the civil laws and obligations.

2. The birth of physical person and its origin, scrap, annulment of marriage in the cases provided by the law, change of name, death are subject to state registration according to this Law.

Article 3. Bases of state registration of acts of civil status

1. State registration of acts of civil status in the cases established by the law is obligatory.

Data on the birth of physical person and its origin, adoption, deprivation and renewal of the parent rights, scrap, annulment of marriage, change of name, death are subject to obligatory entering into the State register of acts of civil status of citizens and the Unified state demographic register in the amount determined by the Law of Ukraine "About the Unified state demographic register and documents which confirm citizenship of Ukraine certify person or its special status".

2. State registration of acts of civil status is carried out according to this Law, Civil and Family codes of Ukraine and other acts of the legislation bodies of state registration of acts of civil status.

Section II. System of bodies of state registration of acts of civil status

Article 4. Bodies of state registration of acts of civil status

1. Bodies of state registration of acts of civil status are:

1) the central executive body which realizes state policy in the sphere of state registration of acts of civil status;

2) departments of state registration of acts of civil status of Head department of justice of the Ministry of Justice of Ukraine in the Autonomous Republic of Crimea, head departments of justice in areas, the cities of Kiev and Sevastopol, district, district in the cities, city, gorrayonny justice departments (further - departments of state registration of acts of civil status);

3) executive bodies of village, settlement and city councils.

2. State registration of acts of civil status of citizens of Ukraine who live or temporarily stay abroad, carry out diplomatic representations and consular establishments of Ukraine.

Article 5. Competence of the central executive body which realizes state policy in the sphere of state registration of acts of civil status

1. The central executive body which realizes state policy in the sphere of state registration of acts of civil status:

1) it is excluded;

3) is provided by creation, maintaining and functioning of the State register of acts of civil status of citizens;

4) provides the practical and methodical help to consular establishments and diplomatic representations of Ukraine abroad to rather state registration of acts of civil status;

5) performs other powers provided by this Law and other acts of the legislation in the sphere of state registration of acts of civil status.

Article 6. Competence of bodies of state registration of acts of civil status

1. Departments of state registration of acts of civil status carry out state registration of the birth of physical person and its origin, scrap, annulment of marriage, change of name, death, make changes to assembly records of civil status, renew and cancel them; create the State register of acts of civil status of citizens, keep it, store archival fund; perform other powers according to the legislation.

2. Executive bodies of village, settlement, city councils carry out state registration of the birth of physical person and its origin, scrap, death.

3. Diplomatic representations and consular establishments of Ukraine carry out state registration of the birth of physical person and its origin, scrap, annulment of marriage, change of name, death concerning citizens of Ukraine, adopt and consider statements for modification of assembly records of civil status, their renewal and cancellation.

State registration of change of name and annulment of marriage is carried out by diplomatic representations and consular establishments of Ukraine only concerning the citizens of Ukraine who are constantly living abroad.

4. Bodies of state registration of acts of civil status grant appropriate certificates about state registration of acts of civil status.
