1. Approve Regulations on payment procedure of pensions to the citizens who left (leaving) on permanent residence it (is applied).
2. Declare invalid the resolution of the Cabinet of Ministers of the Republic of Belarus of September 21, 1994 No. 83 "Ab of zatsvyardzhenna Palazhennya ab paradka of pension payment to gramadzyana, yakiya left on zhykharstvo pastayannaa for myazha" (Collection of presidential decrees and resolutions of the Cabinet of Ministers of the Republic of Belarus, 1994, No. 6, the Art. 150).

1. This Provision establishes payment procedure of pensions:
work pensions on the disability connected with labor accident or occupational disease and on the occasion of loss of the supporter owing to the specified reasons for the citizens who left on permanent residence of the Republic of Belarus till August 1, 2006;
all types of pensions to the citizens leaving on permanent residence of the Republic of Belarus (article 92 of the Law);
1.2. according to the Resolution of the Supreme Council of the Republic of Belarus of February 2, 1994 No. 2740-XII "About procedure for enforcement of the Law of the Republic of Belarus "About modification and amendments in the Law of the Republic of Belarus "About provision of pensions" and about introduction of amendments to the Resolution of the Supreme Council of the Republic of Belarus of April 17, 1992 "About procedure for enforcement of the Law of the Republic of Belarus "About provision of pensions" to the citizens who left on permanent residence of the Republic of Belarus till January 1, 1993.
2. If the international treaty of the Republic of Belarus provides other rules, than those which contain in this Provision then are applied the rules established by the international treaty of the Republic of Belarus.
3. Pensions to the citizens specified in the paragraph the second subitem 1.1 and subitem 1.2 of Item of 1 this provision are translated in the place of their permanent residence outside the Republic of Belarus.
4. Transfer of pensions out of limits of the Republic of Belarus is made by Social Security Fund of the population of the Ministry of Labour and Social Protection quarterly last month of quarter in foreign currency at the single currency rate established by National Bank for date of creation of the pay-sheet in form according to appendix 1, on the bank account or other financial credit institute of foreign state in which the citizen constantly lives.
5. The sizes of pensions of the citizens specified in the paragraph the second subitem 1.1 of Item of 1 this provision are recalculated in cases and procedure, stipulated by the legislation.
6. Transfer of pensions out of limits of the Republic of Belarus is made on condition of submission by citizens to Social Security Fund of the population of the Ministry of Labour and Social Protection till March 1 of each calendar year of the document confirming the fact of finding of the citizen in live for December 31 of previous year.
For pension payment, appointed to the minor citizens and citizens recognized in accordance with the established procedure by court incapacitated whose receivers are their legal representatives, the document confirming the fact of finding of the citizen in live is submitted on the receiver of pension and the citizen who is granted pension.
The document confirming the fact of finding of the citizen in live is issued by diplomatic representation or consular establishment of the Republic of Belarus abroad, the notary in the territory of the Republic of Belarus or competent authority (official) of foreign state.
In case of non-presentation of the document confirming the fact of finding of the citizen in live in the terms provided in part one of this Item, pension payment stops. After submission of the specified document pension payment is resumed according to the Law. At the same time payment of uncollected pension for last time is performed proceeding from the sizes of pension determined according to the legislation for the period for which payment is made.
7. Pension in six months ahead is paid to the citizens leaving on permanent residence of the Republic of Belarus before departure. At the same time six months are estimated since the month following after month of removal of the citizen from registration accounting at the place of residence.
8. The pension amount which is subject to payment in six months ahead is determined in sixfold size of the pension added in month in which the citizen is struck off the registration register at the place of residence.
9. Pension payment in six months ahead is made based on provided by the citizen leaving on permanent residence of the Republic of Belarus to management (department) of work, employment and social protection of city, district executive committee, the management (department) of social protection of local administration of the area in the city (further - body for work, employment and social protection) which granted pension, the following documents:
the citizen of the Republic of Belarus - statements in form according to appendix 2, passports of the citizen of the Republic of Belarus with mark about the state to which the citizen leaves on permanent residence, or the ID card of the citizen of the Republic of Belarus and the biometric passport of the citizen of the Republic of Belarus with mark about the state to which the citizen leaves on permanent residence, and the address certificate of the residence issued by division on nationality and migration of law-enforcement bodies;
the foreign citizen and the stateless person - statements in form according to appendix 2, the passport of the foreign citizen or the stateless person, or other document replacing it, intended for trip abroad and issued by relevant organ of the state of civil accessory or the regular residence of the foreign citizen or the stateless person or the international organization or the biometric travel document of the Republic of Belarus with mark about the term of departure from the Republic of Belarus without the return right according to this document to the Republic of Belarus, or the travel document (The convention of July 28, 1951).
