About the Technological park
This Law regulates organization-legal activities of the Technological park in the Republic of Tajikistan, determines the main objectives and the parties of its activities and is directed to implementation of results of scientific, technological and innovative research in production.
In this Law the following basic concepts are used:
- innovative programs and projects - the result of intellectual potential of physical persons and legal entities promoting use of the new ideas developed for the purpose of development of science and implementation of modern high-quality technologies;
- the technological park - the legal entity or consortium with the property right to single material complex which main activities is provision of the works and services necessary for implementation of innovative and investment projects;
- business incubator - the legal entity created for support of small business entities at stage of their formation by provision of production rooms, the equipment, organizational, legal, financial, consulting and information services;
- infrastructure of the Technological park - set of the office buildings, the production, engineering, transport, communication and social facilities located in the territory of the Park and used by physical persons and legal entities;
- the subject of the Technological park - the legal entity and the individual entrepreneur included in accordance with the established procedure in the register of subjects of the Technological park and performing innovative and technological activities in the territory of the Technological park;
- the register of blocks of transactions (blokcheyn) - built on the basis of the set algorithms in the distributed decentralized information system using cryptographic methods of information security, the sequence of blocks with information on the transactions made in such system;
- digital sign (token) - entry in the register of blocks of transactions (blokcheena), other distributed information system which certifies availability at the owner of digital sign (token) of the rights to objects of the civil laws and (or) is digital asset;
- resulting effects of scientific research - results of scientific research which can be implemented in production.
The legislation of the Republic of Tajikistan on the Technological park is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.
1. The technological park (further - the Park), being non-commercial legal entity (except for the technological park of software products and information technologies (IT Park) (further - the technological park of software products and information technologies), it is created as organization in the special territory, is effective for the purpose of development of science and useful use of high-quality technologies for production requirements satisfaction in use of the latest technologies and implementation of innovative and investment projects.
2. In the territory of the Park the research organizations, design bureaus function, there are production facilities, educational institutions, and also service rooms which unite with the purpose of use of high-quality technologies and implementation of innovative programs and projects.
3. The park can be created by physical persons and legal entities, one or several educational, scientific research institutions, the state and non-state production organizations for the solution of own tasks on the basis of cooperation between the similar organizations.
4. The technological park of software products and information technologies is created as the commercial legal entity by the Government of the Republic of Tajikistan and functions for the purpose of development of information technologies, assistance in the forming of system of digital economy and involvement of partners in development according to the procedure established by the legislation of the Republic of Tajikistan. The subject Parka registered in the technological park of software products and information technologies in accordance with the established procedure performs the activities in the territory of the technological park of software products and information technologies.
5. The park is effective according to the procedure, established by the legislation of the Republic of Tajikistan, within the Charter in which legal status of the Park is determined.
1. In the Republic of Tajikistan the Park can be created in the following forms:
- Technological park of software products and information technologies;
- Innovative and technological park;
- Scientific park (or Research park);
- Technopolis;
- Technological incubator (Business - incubator).
2. The technological park of software products and information technologies is one of types of the park in the territory of which development of information and communication technologies, production of software products and other types of activity regarding information technologies in production of produktion and rendering the services which are not forbidden by the legislation of the Republic of Tajikistan is performed.
3. The regulations on the technological park of software products and information technologies taking into account specifics of its activities affirm the Government of the Republic of Tajikistan.
4. In the technological park of software products and information technologies conditions for implementation in technology of the register of blocks of transactions (blokcheyn) and other technologies based on the principles of distribution, decentralization and safety made with their use of transactions, except for mining of digital signs (token) are created.
5. The regulations on the technological park of software products and information technologies can provide the rights of foreign legal entities and physical persons (nonresidents) to acquisition, ownership, the order and implementation of other corresponding transactions with digital sign (token).
