About the National program of informatization
This Law determines the general principles of forming, accomplishment and correlation adjustment of the National program of informatization.
In this Law the stated below terms and concepts are used in the following value:
the database - the referred to as data set reflecting provision of objects and their relations in certain data domain;
the knowledge base - information array in the form suitable for logical and semantic processing by the corresponding program methods;
the paragraph the fourth is excluded according to the Law of Ukraine of 13.04.2020 No. 554-IX - becomes effective since January 1, 2021
means of informatization - the electronic computers, program, mathematical, linguistic and other support, information systems or their separate elements, information networks and communication networks used for realization of information technologies;
informatization - set interconnected organizational, legal, political, social and economic, scientific and technical, the production processes directed to creation of conditions for satisfaction of information needs of citizens and society on the basis of creation, development and use of the information systems, networks, resources and information technologies constructed on the basis of use of modern computer and communication facilities;
information service - actions of subjects for providing consumers with information products;
information technology - purposeful organized set of information processes with use of the computer aids providing high processing rate of data, bystry information search, dispersion of data, access to information sources irrespective of the place of their arrangement;
information product (products) - the documentary information prepared and intended for requirements satisfaction of users;
information resource - set of documents in information systems (libraries, archives, databanks, etc.);
information sovereignty of the state - capability of the state to control and regulate information streams because of limits of the state for the purpose of compliance with laws of Ukraine, the rights and freedoms of citizens, guaranteeing homeland security of the state;
localization of software products - reduction of the software products used in Ukraine in compliance with the laws of Ukraine and other regulatory legal acts, regulations and rules existing in Ukraine;
nonresidents - the legal entities, subjects of business activity who do not have the status of the legal entity (branch, representation, etc.), with the location outside Ukraine, created and acting according to the legislation of foreign state, including the legal entities and other subjects of business activity created with the assistance of legal entities and physical persons;
separate task - complex of the projects of informatization interconnected and mutually agreed on realization terms, cast and directed to achievement of specific purposes;
the project of informatization - complex of the interconnected actions, usually investment nature approved on time, use of certain material, information, human, financial and other resources and aiming at creation of in advance determined information and electronic communications systems, means of informatization and information resources answering to certain indicators of quality;
residents - the legal entities, subjects of business activity who do not have the status of the legal entity (branch, representation, etc.), with the location in the territory of Ukraine, performing the activities according to the legislation of Ukraine.
The national program of informatization determines the strategy of the problem resolution of providing information needs and information support of social and economic, ecological, scientific and technical, defense, national and cultural and other activities in spheres of nation-wide value.
The national program of informatization includes:
Concept of the National program of informatization;
set of state programs on informatization;
industry programs and projects of informatization;
regional programs and projects of informatization;
programs and projects of informatization of local government bodies.
The national program of informatization is created proceeding from long-term priorities of social and economic, scientific and technical, national and cultural development of the country taking into account the world directions of development and achievements in the field of informatization and is directed to the solution of the major public problems (ensuring development of education, science, culture, environmental protection and health of the person, public administration, homeland security and defense of the state and democratization of society) and creation of conditions for integration of Ukraine into world information space according to current trends of information geopolitics.
The national program of informatization represents complex of the interconnected separate tasks (projects) of informatization directed to realization of state policy and the priority directions of creation of modern information infrastructure of Ukraine due to concentration and rational use of financial, material and other resources, potential and scientific and technical production of the state, and also coordination of activities of state bodies, local government bodies, the companies, organizations, the organizations of all patterns of ownership and citizens in the field of informatization.
The programs and projects (or their parts) directed to creation, development and integration of information systems, networks, resources and information technologies or the informatizations providing acquisition of means for the purpose of ensuring functioning of state bodies, local government bodies, organizations, organizations which contain at the expense of budgetary funds are carried out as components of the National program of informatization if other is not stipulated by the legislation.
Task of the legislation on the National program of informatization is creation of the legal, organizational, scientific and technical, economic, financial, methodical and humanitarian principles of regulation of process of forming and accomplishment of this Program and its separate tasks (projects).
The legislation on the National program of informatization consists of this Law and other regulatory legal acts.
The coverage of this Law extends to the relations arising in the course of forming and accomplishment of the National program of informatization.
