About approval of Rules of preparation by state control (supervision) bodies and bodies of municipal control of annual plans of conducting planned inspections of legal entities and individual entrepreneurs

The government of the Russian Federation decides:

1. Approve the enclosed Rules of preparation by state control (supervision) bodies and bodies of municipal control of annual plans of conducting planned inspections of legal entities and individual entrepreneurs.

2. Declare invalid the Order of the Government of the Russian Federation of October 28, 2009 N 847 "About approval of the Regulations on the direction by state control (supervision) bodies and municipal control in bodies of prosecutor's office of drafts of annual plans of conducting planned inspections of legal entities and individual entrepreneurs, and also forms and contents of the consolidating plan of conducting planned inspections of legal entities and individual entrepreneurs" (The Russian Federation Code, 2009, N 44, the Art. 5244).

Rules of preparation by state control (supervision) bodies and bodies of municipal control of annual plans of conducting planned inspections of legal entities and individual entrepreneurs

1. These rules establish procedure for preparation by state control (supervision) bodies and bodies of municipal control of annual plans of conducting planned inspections of legal entities and individual entrepreneurs (further - annual plans), their coordination and submission to bodies of prosecutor's office, exception of checks of the annual plan, and also standard form of the annual plan according to appendix.

2. Annual plans develop the following state control (supervision) bodies and bodies of municipal control:

a) federal executive bodies (their territorial authorities), State Atomic Energy Corporation "Rosatom" authorized on implementation of federal state control (supervision) in the corresponding fields of activity;

b) the executive bodies of subjects of the Russian Federation authorized on implementation of the powers of the Russian Federation delegated to subjects of the Russian Federation on federal state control (supervision) in the corresponding fields of activity in the territories of subjects of the Russian Federation and also on implementation of regional state control (supervision) in the corresponding fields of activity in the territories of subjects of the Russian Federation;

c) the local government bodies authorized on implementation of municipal control in the corresponding fields of activity in the territories of municipalities.

3. In case of development of annual plans by territorial authorities of federal executive bodies, the executive bodies of subjects of the Russian Federation and local government bodies authorized on implementation of the state control (supervision) and municipal control provide:

a) inclusion of scheduled inspections of legal entities (their branches, representations, the isolated structural divisions) and individual entrepreneurs in the draft of the annual plan for the bases and on conditions which are established by parts 8 - the 9th Articles 9, articles 26.1 and 26.2 of the Federal law "About Protection of the Rights of Legal Entities and Individual Entrepreneurs when Implementing the State Control (Supervision) and Municipal Control" (further - the Federal Law), the Federal Laws determining features of the organization and conducting planned inspections in certain spheres of the state control (supervision) and also regulations on the types of the state control (supervision) performed using risk - the oriented approach according to part 93 of article 9 of the Federal Law;

b) determination of legal entities (their branches, representations, the isolated structural divisions) and individual entrepreneurs whose scheduled inspections join in the draft of the annual plan, taking into account assessment of results of the unscheduled inspections of specified persons, the analysis of condition of observance of mandatory requirements of the legislation of the Russian Federation which are carried out for the last 3 years by them, the subjects of the Russian Federation or requirements established by municipal legal acts, and also assessment of potential risk of the damnification connected with performed by the legal entity or the individual entrepreneur of activities;

c) coordination with other interested bodies specified in Item 2 of these rules, conducting planned inspections of legal entities (their branches, representations, the isolated structural divisions) and individual entrepreneurs if implementation of scheduled inspections is planned together with the specified bodies;

d) creation of the draft of the annual plan for the form provided by appendix to these rules;

e) the direction of the draft of the annual plan till September 1 of the year preceding year of conducting planned inspections for consideration in body of prosecutor's office for the location of legal entities and individual entrepreneurs concerning whom conducting planned inspections is planned;

e) completion of the draft of the annual plan taking into account the offers of body of prosecutor's office which arrived by results of consideration of the specified project according to part 6.1 of article 9 of the Federal Law and its approval by the head of the relevant organ specified in paragraph one of this Item.

3(1). In case of development of annual plans for 2017 and 2018 state control (supervision) bodies and bodies of municipal control send to the federal executive body performing functions on control and supervision of compliance with law about taxes and fees (further - authorized body), with use of single system of interdepartmental electronic interaction request about provision concerning the legal entity included in the annual plan or the individual entrepreneur of data from the unified register of subjects of small and medium business on reference of this legal entity or individual entrepreneur to small business entities.

The authorized body directs the response to the arrived request in time which is not exceeding 5 working days from the date of its receipt.

Interdepartmental requests and answers to them in electronic form are signed by the strengthened qualified digital signature.

3(2). In case of development of annual plans by State Atomic Energy Corporation "Rosatom" it is provided:

a) inclusion of scheduled inspections of legal entities (their branches, representations, the isolated structural divisions) in the draft of the annual plan for the bases and on conditions which are established by Items 1 and 2 of part 8 of article 9 of the Federal Law;
