About rendering psychological assistance

This Law is directed to determination of legal and organizational basis of rendering psychological assistance for the purpose of providing the rights and legitimate interests of citizens in case of its obtaining.

Chapter 1. General provisions

Article 1. The main terms used in this Law and their determinations

For the purposes of this Law the following main terms and their determinations are used:

psychological assistance - complex of the actions directed to assistance to citizens in the prevention, permission of psychological problems, overcoming consequences of crisis situations, including by activization of own opportunities of citizens for the independent prevention, permission of the arising psychological problems, overcoming consequences of crisis situations and creation of conditions necessary for this purpose, on informing citizens on the reasons of psychological problems and methods, means of their prevention and permission, on development of the personality, its self-improvement and self-realization;

psychological problem - the condition of sincere discomfort of the citizen caused by dissatisfaction with, the professional activity, the interpersonal relations, situation in family and (or) other problems of private life;

crisis situation - the conditions and (or) factors leading to vital changes and emergence of psychological problems with which the citizen cannot cope by methods, habitual for it;

crisis intervention - immediate rendering psychological assistance.

Article 2. The legislation in the sphere of rendering psychological assistance

The legislation in the sphere of rendering psychological assistance is based on the Constitution of the Republic of Belarus and consists of this Law, acts of the President of the Republic of Belarus and other acts of the legislation.

If the international treaty of the Republic of Belarus establishes other rules, than those which are provided by this Law then are applied rules of the international treaty.

Article 3. The subjects performing activities for rendering psychological assistance

The subjects performing activities for rendering psychological assistance are the organizations and individual entrepreneurs.

Article 4. Psychologist. Requirements imposed to the psychologist

The psychologist - the person who is directly giving psychological assistance and meeting requirements imposed by this Article. When implementing activities for rendering the psychological assistance requiring receipt of the corresponding special permission (license), the psychologist shall conform also to other requirements, stipulated by the legislation about licensing.

The psychologist gives psychological assistance as the individual entrepreneur or the worker of the subject performing activities for rendering psychological assistance.

Person can be the psychologist:

the having higher psychological education;

the having higher medical education with qualification the doctor-psychologist, the medical psychologist, the clinical psychologist;

the having higher pedagogical education with qualification the psychologist, the educational psychologist, the practical psychologist in education system;

having academic degree of the doctor or candidate of psychological sciences;

undergone retraining at the level of the higher education in practical psychology, medical psychology, psychology.

Person who got the corresponding education abroad has the right to rendering psychological assistance in the presence of the certificate on recognition of the education document granted by the Ministry of Education of the Republic of Belarus granted in foreign state, and establishment of its equivalence (compliance) to the education document of the Republic of Belarus.

Are not allowed to direct rendering psychological assistance of person, specified in parts three and the fourth this Article, which:

have criminal record for making of intentional crime against the person;

earlier performed educational functions and were dismissed for making of the immoral offense incompatible with continuation of such work;

stay on the registry in psychoneurological and (or) narcological dispensaries.

Article 5. Types of psychological assistance

Treat types of psychological assistance:

psychological consultation - complex of the actions directed to assistance to the citizen (group of citizens) in permission of psychological problems, including in decision making of rather professional activity, the interpersonal relations, to development of the personality, its self-improvement and self-realization, and also to overcoming consequences of crisis situations;

psychological correction - complex of the actions directed to correction (adjustment) of features of the identity of the citizen and his behavior which lead to psychological problems;

psychological prevention - complex of the actions directed to the timely prevention of possible violations in formation and development of the identity of the citizen and the interpersonal relations, assistance to the citizen in preserving and strengthening of condition of his composure;

psychological education - complex of the actions directed to distribution of psychological knowledge, increase in degree of knowledge of citizens of psychology and opportunities of psychological assistance for the purpose of increase in level of their psychological culture and quality of private life.

The psychological diagnostics which is expressed in assessment of individual and psychological properties of the identity of the citizen and directed to identification of psychological problems of the citizen, refining of their features can be component of any kind of psychological assistance.

Chapter 2. State regulation in the sphere of rendering psychological assistance

Article 6. State regulation in the sphere of rendering psychological assistance

State regulation in the sphere of rendering psychological assistance is performed by the President of the Republic of Belarus, Council of Ministers of the Republic of Belarus, the Ministry of Health of the Republic of Belarus, the Ministry of Education of the Republic of Belarus and other state bodies, including local executive and administrative organs, within their powers.

Article 7. Powers of the President of the Republic of Belarus in the sphere of rendering psychological assistance

The president of the Republic of Belarus determines state policy and performs other state regulation in the sphere of rendering psychological assistance according to the Constitution of the Republic of Belarus, this Law and other legal acts.
