About application of veterinary and sanitary measures in the Eurasian Economic Union

The commission of custom union solved:

1. Approve:

- The single inventory, subject to veterinary control (supervision) (further - the Single list, Appendix No. 1);

- Regulations on single procedure of veterinary control (supervision) on customs border of the Eurasian Economic Union and on customs area of the Eurasian Economic Union (Appendix No. 2);

- Regulations on single procedure for conducting joint checks of objects and sampling of the goods (products) which are subject to veterinary control (supervision) (Appendix No. 3);

- The single veterinary (veterinary and sanitary) requirements imposed to the goods which are subject to veterinary control (supervision) (further - Single requirements, Appendix No. 4);

- Single forms of veterinary certificates (Appendix No. 5).

2. To the governments of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation since July 1, 2010 to apply the Single list and Single requirements.

3. To authorized bodies of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation since July 1, 2010 to perform:

- veterinary control (supervision) on customs border and customs area of the Eurasian Economic Union according to Appendix No. 2 to this Decision;

- carry out joint inspections of objects and sampling of the goods (products) which are subject to veterinary control (supervision) in the territories of state members of the Eurasian Economic Union and the third countries according to Appendix No. 3 to this Decision.

4. This Decision becomes effective since July 1, 2010.

Regulations on single procedure of veterinary control (supervision) on customs border of the Eurasian Economic Union and on customs area of the Eurasian Economic Union

I. Scope

1.1. This Provision is developed based on the Decision of Interstate Council of Eurasian economic community (the supreme body of the Customs union) at the level of heads of governments of December 11, 2009 No. 29, in development of the Customs union agreement in veterinary and sanitary measures of the December 11, 2009 operating before entry into force of the Agreement on the Eurasian Economic Union of May 29, 2014.

1.2. Requirements of this provision are applied to the goods specified in the Single inventory, which are subject to veterinary (control) supervision (further – controlled goods).

This Provision establishes procedure of control by the state bodies and organizations of state members of the Eurasian Economic Union performing activities in the field of veterinary science (further respectively – authorized bodies of state members, state members, the Union), behind controlled goods on customs border of the Union and on customs area of the Union for the purpose of non-admission of import to customs area of the Union and movement (transportation) hazardous to health of the person and animal controlled goods.

1.3. The procedure of control (supervision) of the organizations and faces performing production, conversion and (or) storage of controlled goods is performed according to Regulations on single procedure for conducting joint checks of objects and sampling (samples) of the goods (products) which are subject to veterinary control (supervision).

1.4. Requirements of this provision are obligatory for execution of state members of the Union by executive bodies (further – state members), executive bodies of the administrative territories of state members, local government bodies, legal entities of any form of business, citizens, including individual entrepreneurs (further – the organizations and persons) whose activities are connected with production, conversion, storage, utilization, destruction, movement (transportation) and realization of controlled goods all modes of transport and departures.

II. Terms and determinations

2.1. In this Provision the following terms and determinations are used:

2.1.1. "veterinary rules and regulations (further – veterinary rules)" – the regulating documents establishing single veterinary (veterinary and sanitary) requirements, and also zoohygienic standard rates which non-compliance creates threat of origin and spread of diseases of animals, including general for the person and animals;

2.1.2. "Single veterinary requirements" – the requirements imposed to controlled goods, directed to non-admission of import and distribution on the territory of state members of causative agents of infectious diseases of animals, including general for the person and animals, and the goods (products) of animal origin dangerous in the veterinary and sanitary relation;

2.1.3. "the veterinary certificate" – the document issued on the controlled goods which are subject to movement (transportation), authorized body of state member, certifying its safety in the veterinary and sanitary relation and wellbeing of the administrative territories of production sites of these goods on infectious diseases of animals, including diseases, general for the person and animals;

2.1.4. "border control veterinary station (further – PKVP)" – the structural division of authorized body exercising border veterinary control at check points through customs border of the Union and other places determined by the legislation of state members;

2.1.5. "the importing country (importing country)" – the country – the receiver of controlled goods;

2.1.6. "the exporting country (exporting country)" – the country from which controlled goods go to the importing country;

2.1.7. "transit of goods" – movement (transportation) of controlled goods on customs area of the Union, the points of departure and which appointments are outside customs area of the Union;

2.1.8. "the import permit (export) or transit of controlled goods" – the document determining procedure and conditions of use of controlled goods, proceeding from epizootic condition of exporting countries during the importing and transit of controlled goods, issued to representatives according to the legislation of state member the official in the field of veterinary science;

2.1.9. "epizootic condition" – veterinary and sanitary situation in certain territory in specifically specified time which is characterized by availability of diseases of animals, their distribution and the illness rate;

2.1.10. "quarantine actions" – complex of the special and organizational and economic measures directed to localization and liquidation of the centers of infectious diseases of animals, including diseases, general for the person and animals;

2.1.11. "medicines for veterinary application (further – medicines)" – the substances applied to prevention, diagnostics and treatments of diseases of animals received from blood, blood plasma and also bodies of animals, plants, minerals by methods of synthesis or using biological technologies and also the substances of plant, animal or synthetic origin having pharmacological activity;

2.1.12. "stern and feed additives" – products of plant, animal, mineral, chemical and microbiological origin, including their mixes used for feeding of animal all types or as components for production of forages;

2.1.13. "competent authority of the exporting country" – state body of the exporting country within which competence questions of veterinary control (supervision) and (or) ensuring wellbeing and protection of health of animals, and also the international veterinary certification are.

2.1.14. "the state (official) veterinarian of the exporting country" - the veterinarian who is the official of competent authority of the exporting country or appointed by such body.

2.2. The terms which are specially not determined in this Provision are used in the values established by other international treaties, including prisoners within the Union.

III. General provisions

3.1. Officials of PKVP when implementing powers interact with officials of other executive bodies, authorized to exercise control at check points, administrations of check points (within the technological scheme of interaction of regulatory authorities at check points through customs area of the Union), shipowners, agentiruyushchy firms and services, other organizations and the organizations, and also with veterinary specialists of check points of the adjacent states.

3.2. The state veterinary inspectors within the powers have the right to freely visit objects of production, storage and conversion of controlled goods.

3.3. On duty officials of PKVP shall have in case of themselves the official ID and wear uniform of the sample established by the legislation of state members.

3.4. Movement (transportation) of controlled goods through customs border of the Union is allowed at the check points intended for these purposes or in other places determined by the legislation of state members which are equipped and equipped with means of veterinary control according to the legislation of state members.

3.5. At check points through customs border of the Union of military vehicles the Ministry of Defence of state member on naval bases, in military airfields and other places will organize veterinary checkpoints.

3.6. Officials of PKVP at check points through customs border of the Union exercise veterinary control (supervision) when importing controlled goods irrespective of appointment state member.

3.7. Controlled goods when importing, exporting, transit, and also when moving in the Union from the territory of one state member on the territory of other state member during the whole time of transportation shall be followed by the veterinary certificates which are drawn up on the paper form or in electronic form if it is provided by Single veterinary requirements. If the veterinary certificate is drawn up in electronic form, officials of authorized body of state member have no right to demand from the owner (carrier) of controlled goods of presentation of the veterinary certificate on the paper form. At the same time the owner (carrier) of controlled goods for implementation of veterinary control (supervision) shall provide to the specified officials at the choice number of the veterinary certificate which is drawn up in electronic form, either two-dimensional matrix bar code of such certificate, or its paper copy. Veterinary certificates are issued by officials of authorized bodies of state members or the state (official) veterinarians of exporting countries.

The veterinary certificates which are drawn up in electronic form by means of the state information system in the field of veterinary science of competent authority of the exporting country are transferred to the state information system in the field of veterinary science of authorized body of state member, and the veterinary certificates which are drawn up in electronic form by means of the state information system in the field of state member veterinary science - to the state information systems in the field of veterinary science of other state members with use of the integrated information system of the Union.

If between authorized body of state member and competent authority of the exporting country the agreement on recognition of the veterinary certificates which are drawn up in electronic form is reached this authorized body provides to authorized bodies of other state members on which territories movement (transportation) of controlled goods, possibility of viewing of such certificates is performed.

3.8. Veterinary certificates when importing controlled goods to customs area of the Union shall be drawn up in Russian, and also in language of the exporting country and/or English. 3.11. Financing of expenses on execution of veterinary certificates, other veterinary shipping documents and carrying out all types of veterinary control is performed according to the legislation of state members.

3.12. Persons guilty of violation of Single veterinary requirements of the established field of activity in case of implementation of international carriages, and also when moving (transportation) on customs area of the Union of controlled goods, bear responsibility according to the legislation of state member in the territory of which violation is revealed.

3.13. Import, transportation and use of medicines and feed additives for application in veterinary science on customs area of the Union is performed on condition of their registration of state members by authorized bodies.

Import, transportation of medicines, and also feed additives of chemical and microbiological synthesis are performed without veterinary certificate accompanied by the document confirming their quality and safety, issued by manufacturer.

3.14. When importing, exporting and transit the following types of control are applied to controlled goods: documentary, physical, laboratory.

3.14.1. Documentary control consists in check:

– the documents confirming safety of controlled goods;

– availability of import permits (export) or transit of controlled goods;

– compliance of contents of the issued documents to Single veterinary requirements.

3.14.2. Physical control includes:

– examination of controlled goods and survey of animals;

– check of compliance of controlled goods to the data specified in the shown documents for the purpose of exception of availability of the controlled goods which are not specified in shipping documents and exception of joint movement of incompatible goods;

– control of compliance of the vehicle to the established veterinary health requirements necessary for transportation of controlled goods;

– control of conditions and mode of movement (transportation);

– control of compliance of packaging and marking to the established requirements.

When importing, exporting, transit and when moving (transportation) of animals within the territory of the Union in Items of watering place and feeding each their batch is subject to survey.

3.15. By results of implementation of the specified types of control by the official of PKVP one of the following decisions concerning controlled goods is accepted:

– about the omission;

– about movement suspension;

– about import prohibition;

– about return.

The decision made on controlled goods is drawn up by the official of PKVP by putting down of the corresponding stamps in form according to appendix No. 3 on veterinary and shipping documents according to the technological scheme of interaction of regulatory authorities at check points through customs area of the Union.
