About idea and of exchange of the preliminary information of the goods and vehicles moved through customs border of the Customs union
The governments of state members of custom union within Eurasian economic community which are hereinafter referred to as with the Parties
being guided by the Agreement on the Customs Code of the Customs Union of November 27, 2009 (further - the Agreement),
in view of the Framework standards of safety and simplification of world trade of World Customs Organization;
aiming to establish effective cooperation and coordination of activities of customs authorities of the states of the Parties in ensuring customs control over the goods and vehicles moved through customs border of custom union
recognizing need of idea and exchange of the preliminary information of the goods and vehicles moved through customs border of custom union for the purpose of risk minimization of violations of the customs legislation of custom union and the legislation of state members of custom union, and also enhancement and acceleration of making of customs transactions, increase in efficiency of customs control,
agreed as follows:
In this agreement the following terms are used:
the central customs authority of state member of custom union - the Ministry of Finance of the Republic of Armenia, the State Customs Committee of the Republic of Belarus, the Customs Control Committee of the Ministry of Finance of the Republic of Kazakhstan, the State Customs Service under the Government of the Kyrgyz Republic, the Federal Customs Service of the Russian Federation.
specifications - the document which determines structure and format of electronic messages which customs authorities of state members of custom union with use of information systems, regulations of exchange, methods of exchange, the requirement to program and technical means of information systems, and also to unique identification number of transportation exchange.
technical requirements - the document determining procedure, formats, method and regulations of electronic data exchange between the automated system of customs authorities and information systems of the interested persons providing the preliminary information about the goods and vehicles planned to import to customs area of custom union;
unique identification number of transportation (further - UINP) unique number of the preliminary information which is assigned by customs authority of state member of custom union on each batch with use of information system.
Authorized Economic Operators, carriers, including customs carriers, customs representatives and other interested persons (further - interested persons), can represent to customs authorities of state members of custom union in electronic form the preliminary information about the goods assumed to movement through customs border, the vehicles moving such goods, time and the place of arrival of goods for customs area of custom union or departure from such territory, the passengers arriving to customs area of custom union or decreasing from such territory (further - the preliminary information).
Obligation of submission of the preliminary information is determined by the decision of the Commission of custom union depending on mode of transport on which goods move (further - the decision of the Commission).
The decision of the Commission shall contain:
Date of Introduction of obligatory submission of the preliminary information;
mode of transport on which goods through customs border of custom union concerning which obligatory submission of the preliminary information is entered move;
scope of information of the obligatory preliminary information;
operations procedure of officials of customs authorities in case of lack of the obligatory preliminary information in places of movement of goods and vehicles through customs border of custom union;
other information necessary for implementation of the decision of the Commission.
Submission of the preliminary information without fail is not required in the relation:
the goods and vehicles moved with physical persons for private use;
the goods sent in the international mailings;
the goods and vehicles moved with separate categories of foreign persons according to Chapter 45 of the Customs Code of the Customs Union;
the goods and vehicles moved for natural disaster response, accidents and catastrophic crashes;
military loads.
The commission of custom union and the central customs authorities of state members of custom union provide the publication of the decision of the Commission and its bringing to all interested persons, including with use of information technologies, within thirty days after signing of such decision, but no later than hundred eighty days before Date of Introduction of obligatory submission of the preliminary information.
The preliminary information is provided in language of state member of custom union, except for the symbols used by customs authorities as qualifiers.
Interested persons provide the preliminary information on the imported goods assumed to the room under the procedure of customs transit in places of arrival in volume of the data determined by article 182 of the Customs Code of the Customs Union or part two of Article 3 of this agreement.
If customs procedure of customs transit will not be applied to imported goods and vehicles, interested persons provide the preliminary information in volume of the data determined by article 159 of the Customs Code of the Customs Union.
Submission of the preliminary information is performed in electronic form by interaction of information system of customs authorities of state members of custom union and information systems of interested persons or by means of web portals of customs authorities of state members of custom union.
Technical requirements to information systems of interested persons are developed and published for informing interested persons by customs authority of state member of custom union.
The preliminary information shall be sent to customs authority of state member of custom union by the interested person at least in 2 hours prior to movement through customs border of custom union of goods and vehicles.
In case of the discrepancy of the preliminary information to the scope of information, its structure and format approved by technical requirements, the electronic message on rejection of the preliminary information to consideration with indication of the reasons goes to the interested person.
