Section 1 General provisions

Article 1. Purposes and tasks of the Law

This Law is directed to protection of the rights and interests of the citizens of the Kyrgyz Republic who were injured owing to the Chernobyl catastrophic crash, participating in liquidation of the Chernobyl accident and its effects.

Article 2. The legislation of the Kyrgyz Republic on social protection of the citizens who were injured owing to the Chernobyl catastrophic crash

The relations connected with social protection of the citizens of the Kyrgyz Republic who were injured owing to the Chernobyl catastrophic crash are regulated by this Law and other regulatory legal acts.

Article 3. The rights of the citizens who were injured owing to the Chernobyl catastrophic crash to compensation of damage, receipt of social guarantees and compensations

Citizens of the Kyrgyz Republic have the right to social guarantees and monetary compensations, privileges for the damage caused to their health owing to catastrophic crash on the Chernobyl NPP, and also for risk of radiation damage owing to accommodation and work in the territory which underwent to the radioactive pollution exceeding admissible levels as a result of the specified catastrophic crash.

The foreign citizens and persons without citizenship who were taking part in recovery from the accident on the Chernobyl NPP and constantly living in the territory of the republic have the right to compensation of the damage caused to their health and also on - social guarantees and compensations according to the legislation of the Kyrgyz Republic.

Realization of the rights of the citizens established by this Article is guaranteed by the state.

Article 4. Establishment of social guarantees and compensations

This Law establishes the main types and the amount of monetary and other material compensations provided by citizens, injured owing to the Chernobyl catastrophic crash.

The procedure and the specific amount of the monetary and other material compensations established by this Law are determined by the Cabinet of Ministers of the Kyrgyz Republic.

Article 4-1. Financing of the expenses connected with implementation of this Law

Financing of the expenses connected with implementation of this Law is performed from means republican and local budgets according to the procedure, established by the legislation of the Kyrgyz Republic.

The Section II Status of Citizens, injured owing to the Chernobyl catastrophic crash

Article 5. Categories of citizens

Treat the citizens who were injured owing to the Chernobyl catastrophic crash to whom operation of this Law extends:

1) persons having diseases of the caused effects of the Chernobyl accident, and also person with limited opportunities of health concerning which the causal relationship of the come disability from the Chernobyl catastrophic crash is established;

2) the persons (including temporarily directed or sent) taking in 1986-1987 part in works on recovery from the accident on the Chernobyl NPP within exclusion zone or occupied during this period on operation or other works on the Chernobyl NPP and also the military personnel and persons liable for call-up called on special charges and involved to accomplishment during this period of the works connected with mitigation of consequences of the specified accident irrespective of the place of dislocation and the performed works and also the faces of the commanding and ordinary structure of law-enforcement bodies serving in 1986-1987 in exclusion zone;

3) persons, (including temporarily directed or sent), taking in 1988-1989 part in works on recovery from the accident on the Chernobyl NPP within exclusion zone or occupied during this period on operation or other works on the Chernobyl NPP, and also the military personnel and persons liable for call-up called on special charges and involved to accomplishment during this period of the works connected with mitigation of consequences of the specified accident irrespective of the place of dislocation and the performed works and also the faces of the commanding and ordinary structure of law-enforcement bodies serving in 1988-1989 in exclusion zone;

4) the persons evacuated (which left in voluntary procedure) in 1986 to the Kyrgyz Republic from exclusion zone or the settling out moved, and also left in voluntary procedure zone in 1986 and in the years ahead, including children who on the date of evacuation were in evacuation in pre-natal condition;

5) persons which left in voluntary procedure to the Kyrgyz Republic accommodation zone with the right to settling out after the Chernobyl accident;

6) the military personnel and persons of the commanding and ordinary structure of law-enforcement bodies serving in settling out zone, accommodation zone with the right to settling out and accommodation zone with the preferential social and economic status;

7) the children of the first and two subsequent generations having heritable diseases and anomalies of development owing to genetic changes in the parents who were affected by radiation from among persons specified in Items 1 - the 6th this Article.

Article 6. Social guarantees and compensations - to the persons who got sick and had radiation sickness, to persons with limited opportunities of health concerning which the causal relationship of the come disability owing to the Chernobyl catastrophic crash is established

Persons specified in Item 1 of article 5 of this Law have the right on:

1) free inspection and delivery of health care (in hospital and it is out-patient) according to the Program of the state guarantees for providing citizens of the Kyrgyz Republic with the medical and sanitary help;

1-1) Compensation payment according to the procedure and the size, established by the Cabinet of Ministers of the Kyrgyz Republic;

2) free providing with prosthetic and orthopedic products;

3) allowance payment on temporary disability in the amount of 100 percent of the salary irrespective of work uninterrupted length of service;

4) payment to the working persons with limited opportunities of health of temporary disability benefit to 4 months in a row or up to 5 months in calendar year;

5) providing with living space within year from the date of filing of application on condition of recognition by their persons in need in improvement of housing conditions, and also on additional living space in the form of the certain room;
