The agreement on features of customs transactions concerning the goods sent in the international mailings

The government of the Republic of Belarus, the Government of the Republic of Kazakhstan and the Government Russian Federation, hereinafter referred to as with the Parties.

based on provisions of the Agreement on creation of single customs area and forming of custom union of October 6, 2007 and the Agreement on the Customs Code of the Customs Union of November 27, 2009,

being guided by the conventional principles and rules of international law,

for the purpose of simplification of customs transactions and customs control concerning the goods moved through customs border of custom union in the international mailings, and also sent between state members of custom union

agreed as follows:

Article 1

This agreement determines the features of customs transactions concerning the goods sent in the international mailings made in case of arrival on customs area of custom union, departure from this territory and also when placing under customs procedure of customs transit.

This agreement does not regulate questions of movement through customs border of custom union of diplomatic mail and consular bag.

Article 2

For the purposes of this agreement the following terms are used:

a) the dispatch - the sack having label, or several sacks and other reservoirs which are sealed up by seal or without it, the containing mailings and (or) container which places (organization) of the international post exchange of postal services of member countries of Universal Postal Union exchange;

b) inner-union mailings - the mailings sent from one state member of custom union to other state member of custom union including through the territory of the state, not being the member of custom union;

c) the appointed operator - any state or non-state organization officially appointed by the member country of Universal Postal Union for ensuring operation of postal services and accomplishment of the obligations relating to them following from acts of Universal Postal Union to its territories;

Other terms used in this agreement are applied in the values established by the customs legislation of custom union and (or) acts of Universal Postal Union.

Article 3

Places of arrival on customs area of custom union and places of departure from such territory of dispatches with the international mailings are check points through the state (customs) borders of state member of custom union determined by the legislation of state member of custom union.

The goods sent in the international mailings arrive to customs area of custom union and decrease from such territory in places (organizations) of the international post exchange determined by the legislation of state member of custom union.

Transportation of the international mailings on customs area of custom union, including with overload (transfer) on the way, is made according to customs procedure of customs transit, according to the procedure, determined by the customs legislation of custom union and provisions of this agreement.

The customs transactions connected with release of the goods sent in the international mailings on customs area of custom union, except for release according to customs procedure of customs transit are made by customs authority of state member of the custom union which is the country of destination of the international mailing according to the procedure, determined by authorized bodies of the Parties, namely: The Ministry of Finance of the Republic of Armenia - from the Armenian side, the State Customs Committee of the Republic of Belarus - from the Belarusian side, the Ministry of Finance of the Republic of Kazakhstan - from the Kazakhstan side and the Federal Customs Service (FCS of Russia) - from the Russian side.

The customs transactions connected with release of the goods sent in the international mailings from customs area of custom union, except for release according to customs procedure of customs transit are made by customs authority of state member of the custom union which is the country of departure of the international mailing according to the procedure, determined by authorized bodies of the Parties, namely: The Ministry of Finance of the Republic of Armenia - from the Armenian side, the State Customs Committee of the Republic of Belarus - from the Belarusian side, the Ministry of Finance of the Republic of Kazakhstan - from the Kazakhstan side and the Federal Customs Service (FCS of Russia) - from the Russian side.

Article 4

In case of arrival of the international mailings on customs area of custom union and (or) their departure from such territory, the data on the moved goods represented by carrier are limited to the data containing in the documents determined by acts of Universal Postal Union and accompanying the international mailings in case of their transportation:

about the name of the sender and receiver of the international mailings (organization of exchange of giving, organization of exchange of appointment);

about the weight of goods gross;

about quantity of cargo pieces.

Data on availability of the goods prohibited and (or) limited to movement through customs border of custom union when importing and (or) exporting are represented by carrier if the carrier has such information.

Other data, the stipulated in Clause 159 Customs Code of the Customs Union, are represented by carrier depending on mode of transport.

For the purposes of observance of prohibitions and restrictions by the appointed operators of member countries of Universal Postal Union the preliminary information about the sent goods can be provided. Procedure for representation and use of the preliminary information for the customs purposes are determined by other acts of the customs legislation of custom union.

The documents confirming observance of restrictions concerning the goods sent in the international mailings are represented by the interested person or the appointed operator to customs authority in the place (organization) of the international post exchange or the interested person in other places determined by customs authority in case of customs declaring and release of goods.

Article 5

Permission to departure of the goods sent in the international mailings from customs area of custom union is drawn up by customs authority in the place (organization) of the international post exchange.

Permission to departure of the international mailings from customs area of custom union is drawn up by customs authority at the check point through the state (customs) borders of state members of custom union based on permission to departure of the goods sent in the international mailings.
