1. Approve the enclosed Procedure for the organization of electronic document management in case of submission of electronic documents with the digital signature in the Federal Service for Financial Markets.

2. The order of FFMS of Russia of 01.09.2004 N 04-442/pz-n "About provision in the Federal Service for Financial Markets of electronic documents with the electronic digital signature" (N 6069) is registered in the Ministry of Justice of the Russian Federation of 19.10.2004, the order of FFMS of Russia of 21.02.2006 N 06-19/pz-n "About report layout of the non-state pension funds directed by e-mail and on magnetic carriers" (N 7992) is registered in the Ministry of Justice of the Russian Federation 28.06.2006, the order of FFMS of Russia of 25.07.2006 N 06-82/pz-n "About procedure for provision (disclosure) for information on the activities of non-state pension fund for the expired month directed by e-mail" (N 8173) is registered in the Ministry of Justice of the Russian Federation 28.08.2006 to recognize invalid.

3. To impose control of execution of this order on the deputy manager of the Federal Service for Financial Markets S. K. Kharlamov.

Procedure for the organization of electronic document management in case of submission of electronic documents with the digital signature in the Federal Service for Financial Markets

I. General provisions

1.1. This Procedure for the organization of electronic document management in case of submission of electronic documents with the digital signature in the Federal Service for Financial Markets (further - the Procedure) determines the general principles of the organization of information exchange of electronic documents with the digital signature with the Federal Service for Financial Markets (further - submission of electronic documents).

1.2. Participants of information exchange of electronic documents for the purpose of this Procedure are professional participants of the security market, joint-stock investment funds, non-state pension funds, managing companies of investment funds, mutual investment funds and non-state pension funds, specialized depositaries of investment funds, mutual investment funds and non-state pension funds, issuers, and also other organizations submitting electronic documents according to the Federal Laws, regulatory legal acts of the Federal Service for Financial Markets and other regulatory legal acts and participating in information exchange, on the one hand, and the Federal Service for Financial Markets - on the other hand.

1.3. Submission of the electronic document is performed by the participant of information exchange according to Chapter II of this Procedure.

1.4. The electronic document is considered outgoing from the participant of information exchange if it is signed by the digital signature (further - the EDS) authorized person of this participant. In case of the direction of the electronic document compulsory use of the certified means of the EDS allowing to identify the certificate holder of key of the EDS which the authorized person of the sender of the electronic document is is required by the participant of information exchange. The certificate of key of the EDS is issued by certification center. The relations between the Federal Service for Financial Markets and certification centers when implementing electronic document management are regulated by the relevant agreements.

The certificate of key of the EDS is considered acting in the period of the term of its action, or until the statement for its invalidity the participant of information exchange and/or certification center, or until publication by the relevant certification center of the certificate revocation list containing data on this certificate. The risk of illegal signing of the electronic document is born by the participant of information exchange on which authorized person the certificate of the corresponding key of the EDS is registered. For the purpose of the information protection containing in the electronic document, participants of information exchange use the certified means of cryptographic protection.

1.5. The participant of information exchange bears responsibility for information containing in the electronic document. In case of need verifications of information containing in the electronic document the Federal Service for Financial Markets has the right to request the copy of the electronic paper document from the participant of information exchange.

1.6. The participant of information exchange provides storage of the electronic document in accordance with the established procedure and terms, but at least 5 years.

II. Procedure for participation in information exchange

2.1. The participant of information exchange prepares electronic documents or by means of current version of the program questionnaire posted by FFMS of Russia in open entry on the official site to the address: www.ffms.ru (further - the website of FFMS of Russia) in the Section "Participants of the Financial Market / Electronic Document Management" (further - the program questionnaire), or by means of own software according to the XML schemes posted on the website by FFMS of Russia in the specified Section and which are part of distribution kit of the program questionnaire (XSD folder).

By preparation and sending electronic documents the participant of information exchange is guided by also Technical recommendations about submission of electronic documents to FFMS of Russia posted on the website by FFMS of Russia in the Section "Participants of the Financial Market / Electronic Document Management".

2.2. The participant of information exchange when forming the electronic document appropriates it reference number, unique for such participant and year of submission of the electronic document, with indication of date of assignment of reference number. Uniqueness of reference number remains within one calendar year.

2.3. In case of modification of the electronic document which is earlier sent to FFMS of Russia before repeated departure of the electronic document it needs to assign new reference number.

2.4. Signing of electronic documents the digital signature (further - the EDS) is performed by the participant of information exchange taking into account the following requirements:

2.4.1. The EDS of the authorized person of the participant of information exchange shall contain in the separate file other than the signed file containing the electronic document.
