About approval of Rules of transportation of dangerous goods by rail

In pursuance of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About transport" of July 27, 1999 the No. 165 Cabinet of Ministers of the Azerbaijan Republic decides:

1. Approve "Rules of transportation of dangerous goods by rail" (are applied).

2. This resolution becomes effective from the date of signing.

Rules of transportation of dangerous goods by rail

Part I. General provisions

1.1. Application of rules

1.1.1. These rules establish safety requirements of transportation of dangerous goods by the railroads in the territory of the Azerbaijan Republic according to the Law of the Azerbaijan Republic "About transport". Consignors, (consignees), legal entities and physical persons (carriers, senders, receivers, loaders, dischargers and keepers of dangerous goods) rendering services forwarding organizations shall observe requirements of these rules and regulating documents for technical safety.

1.1.2. In the part which is not provided by these rules, in transit dangerous goods it is necessary to be guided by appropriate sections of Rules of carriages of goods.

1.1.3. Transportations of dangerous goods in the direct mixed railway water communication are made according to these rules and "Rules of transportations of dangerous goods in water communication".

Transportations of dangerous goods between the countries which railroads are agreement parties about the international freight traffic (SMGS) are regulated by Special condition of carriages of dangerous goods in the international railway service, and between the State Parties of SMGS and the countries which railroads are not members of SMGS, performed on the basis of special agreements.

1.1.4. To legal entities and physical persons, (to carriers, senders, receivers, loaders, dischargers, keepers of dangerous goods) transportation of dangerous goods on railway services according to requirements of these rules, the International and republican legal acts, regulating documents is allowed to forwarding services.

1.1.5. To legal entities and physical persons (carriers, senders, receivers of dangerous goods) who do not have the license, allocation of the car for transportation of dangerous goods is not allowed.

1.1.6. Cargo carriers, consignors, consignees, cargo keepers and the relevant services of management of the railroad bear responsibility for non-compliance with these rules according to the procedure, established by the legislation of the Azerbaijan Republic. Presentation of the claim to the freight forwarder in connection with transport-forwarding services is performed according to Article 861.2 of the Civil code of the Azerbaijan Republic.

1.1.7. Legal entities and physical persons (Cargo carriers, consignors, consignees, cargo keepers) according to the procedure, established by the legislation, upon the demand of the relevant inspectorate of the Ministry of Emergency Situations of the Azerbaijan Republic and relevant organs of the executive authority represent the Declaration of technical safety on development and the implementation of the actions providing performance of works according to standard rates of technical safety, according to the procedure, established by the Law of the Azerbaijan Republic "About technical safety".

1.1.8. Check, enhancement of knowledge of technical safety of the legal entities and physical persons which are engaged in transportation, loading, unloading, storage of dangerous goods and also their certification is provided with services of cargo transportation of the railroad according to the procedure, established by the Ministry of Emergency Situations.

1.1.9. In case of development and application by legal entities, the state and non-state bodies of instructions and conditions on safe transportation of the radioactive materials and materials having on classification of the main loads, caustic, explosive impact and which special activity is in emergency, and also other fire goods their documents shall be approved with the Ministry of Emergency Situations in advance.

1.1.10. Timely and operational informing relevant organs of management of the railroad and the Ministry of Emergency Situations of the Azerbaijan Republic on the happened accidents during transportation of dangerous goods is of great importance.

1.1.11. Import by legal entities and physical persons to the territory of the Azerbaijan Republic of radioactive waste by rail from zarubezh, according to the legislation, is forbidden.

1.1.12. Rules of safe transportation of dangerous goods are established by rail:

a) preparation of locomotives, cars, tanks, their repair and operation, acceptance of trains, mandrel and development;

b) preparation of dangerous goods for transportation;

c) suitability of container and packaging to transportation of dangerous goods;

d) organization of course of carriage for the trunk and industrial railroad;

e) general rules of control of safe transportation of dangerous goods.

These rules are directed to protection of life and human health, environmental protection and material values when transporting dangerous goods.

1.1.13. Consignors, consignees, and also the workers of the main and rail transport participating in transportation, protection and (or) maintenance of dangerous goods all companies and the organizations which are engaged in transportation of dangerous goods, preparation of trains and containers their maintenance, repair, and also forwarding servicing shall be guided by these rules.

1.1.14. These rules do not extend to intra territorial technological transportation of the companies and objects using, making, overworking, liquidating or storing the dangerous goods and special transportations performed according to the decision made at the National level.

1.1.15. The organization of transportation of dangerous goods for the trunk and internal railroad of the company, preparation of cars and containers for their transportation, their repair and operation is performed according to these rules, and also normative and technical documents on safety control of transportation of the dangerous goods approved by the State railway of Azerbaijan in coordination with the Ministry of Emergency Situations of the Azerbaijan Republic.

Changes and amendments in the approved normative and technical documents on safe transportation of dangerous goods are made in coordination with the Ministry of Emergency Situations of the Azerbaijan Republic.

1.1.16. Boilers of tank cars and special containers in which dangerous goods is transported at temperature up to 50 hail. With under pressure over MPa 0,07 (0,7 of kgf/cm 2) or unloading from which is performed by recompression of more 0,07 of MPa (0,7 of kgf/cm 2), shall meet the requirements of "Rules for the Construction and Safe Operation of the vessels working under pressure".

1.1.17. When transporting compressed, liquefied and dissolved under pressure of gases requirements of these rules, general Rules of carriages of goods, and also the specifications and technical documentation concerning safe engineering in case of operation of tanks, production of draining, filling and transportation of specific dangerous goods of this class shall be fulfilled.

1.1.18. Content of constructions, devices, railway vehicles, the organization of train movements shall meet the requirements of the rules and instructions approved by the State railway of Azerbaijan.

1.1.19. Loading rates of dangerous goods, the choice like railway vehicles for their transportation, determination of its suitability for these purposes in the technical and commercial relation, fixture of loads in cars shall conform to requirements of the Charter of the State railway, Rules of carriages of goods, other specifications and technical documentation concerning transportations of dangerous goods.

1.1.20. For issue of permission to use on mainline railway of the specialized cars which are in property (or leased) the legal entities and physical persons transporting dangerous goods, their registration is carried out on the basis of the approved rules according to the International requirements.

1.1.21. The new models of cars and containers for transportation of dangerous goods acquired abroad or the following by en route through the territory of Azerbaijan shall be allowed to operation by the State railway of Azerbaijan in coordination with the Ministry of Emergency Situations based on the certificate of technical expertize constituted in form according to appendix 9.

1.1.22. The companies - owners of cars and containers, legal entities when carrying out repair and engineering certification of boilers of tank cars, their operating and constructive equipment shall apply on text tank car boiler about date of the subsequent engineering certification. On tank cars for transportation of dangerous goods of class 2 texts about terms of carrying out the next internal survey (survey) and hydraulic tests shall be put.

At the same time on these cars the conditional number of the company which was carrying out survey, issued by State body shall be specified.

1.1.23. The used in the text these rules abbreviation, main terms and reducings are specified in appendix 1a.

1.2. Classification of dangerous goods

1.2.1. Substances, materials, products, products, potentially dangerous wastes which in the course of transportation, in case of production of handling works and storage can do harm to the environment belong to properties to inherent dangerous goods, serve as cause of explosion, the fire or damage of vehicles, devices, buildings and constructions, and also poisoning, disease, injuring or death, burns or people, animals and birds.

1.2.2. Dangerous goods according to International Agreements, conventions, codes of the UN and State standards is in the appropriate order divided into the following classes:

* class 1 - the explosive materials (EM);

* class 2 - the compressed gases liquefied and dissolved under pressure;

* class 3 - flammable fluids (LVZh);

* class 4 - flammable solid substances (LVT); igniting spontaneously substances (ISS); the substances emitting flammable gases in case of interaction with water;

* class 5 - the oxidizing substances (OK) and the organic peroxides (OP);

* class 6 - the toxic agents (TA) and the infectious substances (IS);

* class 7 - the radioactive materials (RM);

* class 8 - caustic and (or) corrosion substances (EC);

* class 9 - other dangerous substances.

Dangerous goods of each class according to their physical and chemical properties, types and degree of danger in case of transportation is divided into the subclasses, categories and groups specified in appendix 1.

1.2.3. Reference of dangerous goods to certain class, subclass, category and group is made according to the International and State standards (see appendix 1) the Class (subclass) of the dangerous goods having more than one type of danger, is established according to the table (State standard) of priority of types of danger. For such loads the requirements ordered both for class of priority danger, and for classes of additional danger shall be observed.

The legal, service and physical persons who are engaged in transportation, sending and receipt of dangerous goods shall observe requirements of the corresponding legal acts of the Republic, the conditions and standard rates for technical safety established by the license.

1.3. The dangerous goods allowed to transportation

1.3.1. The dangerous goods named in Index is allowed to transportation across the railroads (appendix 2) and in the List of dangerous goods of class 1 (appendix 10).

1.3.2. Dangerous goods (except specified in item 1.3. 3), not named in Index, but similar on the chemical properties and nature of danger with the loads listed in it are transported on the conditions specified in the license obtained by the consignor and delivery note. At the same time the consignor shall specify in the graph of delivery note "The name of load" the name of the transported load according to the standard or technical specifications, make under it mark: "The load is transported on conditions... (the name of load to which equate this load, according to Index is specified), the joint stock company is enclosed" and to attach the emergency card on the transported load, and also to put down stamp.

1.3.3. Transportation of dangerous goods which cannot be equated to the loads named in Index or which needs to be transported in specialized or leased cars and containers on the conditions which are not provided by these rules is allowed only on permission of railway administration and the relevant inspectorate of the Ministry of Emergency Situations based on the license obtained according to the petition of the consignor - legal entity and physical person. The specified petitions go to railway administration not later than 6 months prior to transportation.

The characteristics of load and emergency cards in forms (appendix 3 to these rules and appendix 4 to Safety regulations and procedure for liquidation of emergency situations with dangerous goods in transit them by the railroads) signed by the head of the company consignor and certified by seal and the copy of the license shall be attached to the petition in duplicate.

In case of need upon the demand of railway administration technical specifications and other addendums shall be submitted.

1.3.4. Chemical reactants and medical supplies from among dangerous goods are transported by the railroads on the conditions established by these rules.

1.3.5. Dangerous goods in the direct mixed railway water communication is transported only at sight by the consignor of station of origin of confirmation about the consent of water transport to such transportation.

Consignors in requests and plans of carriages of goods in the direct mixed railway water communication shall specify features of transportation of this or that dangerous goods.

1.4. Document creation

1.4.1. The consignor shall provide stations of origin on each sending dangerous goods the delivery note filled according to "Rules of carriages of goods".

1.4.2. In the graph of delivery note "The name of load"" the consignor (legal, physical persons) shall specify the exact name of dangerous goods according to Index and number of the emergency card (group of companies), to note series, number of registration, date of the license and to assure the sign and seal.

If the name of dangerous goods by Index has the generalizing nature, for example "The glues containing flammable fluid" the consignor shall specify in delivery note in addition the name of load according to the International standard or technical specifications, for example: "The glues containing flammable fluid. JSC N 32 (glue gutta-percha)".

If in column 2 of Index number of the emergency card is absent, then the emergency card shall be attached to delivery note by the consignor. In delivery note in the column "Name of Load" the consignor shall make mark ""the joint stock company is enclosed", for example: "Alkylphenol. The joint stock company is enclosed".

1.4.3. In case of presentation of the loads allowed to transportation inhibited, flegmatizirovanny, humidified or with certain concentration of the main substance about what in Index the corresponding record is made, the consignor shall in superimposed after the name of load specify its condition, for example: "The zirconium, powder moistened".

1.4.4. At the top the superimposed consignor shall put down provided for this load of stamp of red color. For the loads named in Index are put down stamp, provided in column 7 of Index for this load. In car leaf similar stamp are put down by station of origin.

1.5. Maintenance of dangerous goods

1.5.1. The dangerous goods noted in Index he is familiar "**", are transported accompanied by conductors of the consignor (consignee) or crew of specialists of the consignor (consignee) with observance of requirements of these rules and "Rules of carriages of goods". Without the specified maintenance cars with such loads station of origin are not accepted for shipment.

1.5.2. The conductors accompanying dangerous goods except the obligations provided by Rules shall know the staff instruction on maintenance of this load developed and approved by the consignor dangerous properties of load, measure of first-aid treatment, security measure in emergency situations and to monitor along the line observance of the conditions and security measures established for this load.

1.5.3. The consignor shall supply conductors and staff of protection with necessary individual protection equipment and overalls, the first-aid kit, array of instrumentation, emergency firefighting equipment and decontaminations, and also required auxiliary materials.

1.5.4. In case of detection along the line of defect of the car because of which it cannot go to destination the car is unhooked from the train, moves on specially allocated ways and is under protection of the conductor. If the group of cars is accompanied by one conductor, then from the train all group is unhooked. The fault repair is performed under observation of the conductor according to the procedure, established by Railway Administration

1.5.5. In case of detection along the line of cars with dangerous goods which according to these rules shall be followed by conductors of the consignor or the consignee, but follow without conductors, they shall linger on the station before arrival of the representative of the consignor (consignee). The specified cars are established on specially allocated ways of the station or in other safe place determined in the technical and administrative act of the Station commander station (TRA) at which the car is detained shall report to the consignor (consignee), the relevant inspectorate of the Ministry of Emergency Situations through the station commander of departure (assignment) of load about car delay, and the consignor (consignee) shall send the representatives to delay Item immediately.

1.5.6. Specialists, the job specifications and military guard accompanying dangerous goods submit to requirements of standard rates for technical safety, customs, tax, railways and other legal acts of the Azerbaijan Republic.

Job specifications of the militarized protection of the railroads accompany dangerous goods only within country borders.

Part II. Rules of transportation of dangerous goods in closed cars and containers

2.1. General terms of transportation of dangerous goods in closed cars and containers

Container, packaging and marking

2.1.1. Dangerous goods shall be shown by consignors to transportation in the container and packaging provided by standards or technical specifications on these products or State standards "Dangerous goods. Packaging".

The container and packaging shall be strong, operational, completely exclude leakage and prosypaniye of load, to ensure its safety and safety of transportation. Materials of which the container and packaging are made shall be inert in relation to content.

2.1.2. Dangerous goods which emits flammable, poisonous, caustic, corrosion gases or vapors, loads which become explosive when drying or can dangerously interact with air and moisture, and also the loads having the oxidizing properties shall be packed hermetically.

2.1.3. The loads in retail packaging transported as harmless according to item 2.1.43 of these rules are allowed to be packed into boxes from corrugated fibreboard. Boxes shall have feedwells, inserts, partitions, grids, laying, shock-absorbers.

Walls of boxes shall be above the corked large bottles and cans on 5 cm. In transit dangerous goods in glass container shall be packed by small sendings into dense wooden boxes with covers.

2.1.4. Dangerous goods in metal or polymeric tins, cans and canisters shall be in addition packed into wooden boxes or furrings.

2.1.5. Dangerous goods in sacks and boxes from corrugated fibreboard if such packaging is provided by standards or technical specifications on products, shall be transported by car sendings. In transit dangerous goods in sacks shall be packed by small sendings into tough transport container (metal or plywood drums, barrels, wooden or metal boxes).

2.1.6. In case of presentation to transportation of liquid dangerous goods the container shall be filled to the regulation established by standards or technical specifications on these products.

2.1.7. Joint packaging in one cargo piece is allowed only for that dangerous goods which is resolved to joint transportation in one car according to appendices 4 and 5 to these rules. At the same time each substance is packed separately according to standards or technical specifications on this substance. The packed substances are located in dense wooden box with slots. The box bottom, free intervals in slots, and also wide berth under cover are filled with the corresponding soft non-combustible packaging material. The box is firmly closed by cover. Mass gross of such place shall not exceed 50 kg.

Everything jointly the packed substances shall be named in delivery note with indication of the mass of each substance.

2.1.8. The dangerous goods permitted to transportation in containers shall be packed the same as in transit in closed cars.

2.1.10. Transport marking according to Rules of transportations of dangerous goods and State standards of marking of loads shall be applied on cargo pieces with dangerous goods.

2.1.11. Except the marking provided by item 2.1.10 of these rules, the sender shall apply the marking characterizing type and degree of danger of load and containing on each cargo piece:

a) danger signs on the International and State standards (which form and the description are given in appendix 6 to these rules) according to Index;

b) the name of load according to Index (in case of joint packaging in one cargo piece of several dangerous goods the name is put for each load);

c) classification code;

d) number of the UN.

2.1.12. Drawing danger signs is made: on boxes and transport packets - on three surfaces (side, edge and upper); on barrels - on one of the bottoms and the feedwell (cylindrical part); on piles and bales - on edge and side surfaces; on other types of container (cylinders, etc.) - in the most convenient places clearly visible in case of placement in the car.

2.1.13. Danger signs from paper and cardboard are attached to container by glues. Signs from fabric are sewn. Signs from plywood, metal, plastic are attached by bolts, screws, nails, and also wire if it is impossible to apply other method of attachment (loads in cylinders, etc.).

2.1.14. Directly signs are applied with paint on cliche on container and packaging. In case of coincidence of color of sign to color of container of packaging the sign is applied on contrast background.

2.1.15. Danger signs are divided on:

a) the main, characterizing main type of danger and corresponding to class (subclass) to which the load is carried;

b) the additional, characterizing type of additional danger.

If the load has several types of danger, then the consignor shall apply all signs corresponding to these types of danger on packaging.

2.1.16. In case of joint packaging of dangerous goods of different classes the danger signs corresponding to each load shall be applied on cargo piece.

2.1.17. In transit dangerous goods in transport packets danger signs shall be applied both on packaging, and on packets if in the created packet the danger signs put on packagings are not visible. Requirements to cars and containers and placement in them dangerous goods in transit

2.1.18. For transportation of dangerous goods use the covered goods wagons of the park of the railroads, specialized cars belonging to consignors (consignees) or specially allocated specialized cars of the park of the railroad leased by consignors (consignees).

It is authorized to transport some dangerous goods named in Index on open railway vehicles (in gondola cars or on platforms), and also in ordinary containers of the park of the railroads In this case requirements of item 2.2.23 of these rules shall be observed.

For transportation of dangerous goods consignors (consignees) can be also used specialized containers if such containers are provided by the standard or technical specifications on these products.

The design and parameters of the specialized cars and containers intended for transportation of dangerous goods shall conform to requirements of standards and technical specifications and ensure safety of load and safety of transportation.
