About procedure for establishment of requirements to programs in the field of energy saving and increase in energy efficiency of the organizations performing regulated types of activity

According to article 25 of the Federal law "About Energy Saving and about Increase in Energy Efficiency and about Modification of Separate Legal Acts of the Russian Federation" Government of the Russian Federation decides:

1. Approve the enclosed Rules of establishment of requirements to programs of energy saving and increase in energy efficiency of the organizations performing regulated types of activity.

2. Determine that requirements to programs in the field of energy saving and increase in energy efficiency of the organizations performing regulated types of activity with starting date of action in 2010 are subject to establishment within 3 months from the date of entry into force of this Resolution taking into account the following:

1) requirements to programs in the field of energy saving and increase in energy efficiency of the organizations performing regulated types of activity in 2010 are established in the form of target indicators of energy saving and increase in energy efficiency which achievement will be provided with the regulated organization as a result of program implementation, without specifying of values of such indicators;

2) requirements to programs in the field of energy saving and increase in energy efficiency of the organizations performing the regulated types of activity established in 2010 for 2011 - 2012 are subject to adjustment till April 1, 2011;

3) requirements to programs in the field of energy saving and increase in energy efficiency of the organizations performing regulated types of activity are established taking into account arrived within 30 days from the date of entry into force of this Resolution from the organizations performing regulated types of activity in federal executive body, executive body of the subject of the Russian Federation or local government body in the field of state regulation of rates which performs functions on state regulation of the prices (rates) concerning the relevant organization, offers in part:

the target indicators of energy saving and increase in energy efficiency and actions having the greatest energy saving potential and increases in energy efficiency, determined by the organization performing regulated types of activity proceeding from the approved production and investing programs and the prices (rates) for goods (services) of such organization;

indicators of energy efficiency of objects, creation or upgrade of which is planned by the production program, investing program of the organization performing regulated types of activity.

Rules of establishment of requirements to programs of energy saving and increase in energy efficiency of the organizations performing regulated types of activity

I. General provisions

1. These rules determine procedure for establishment of requirements to programs in the field of energy saving and increase in energy efficiency of the organizations performing regulated types of activity (further - the program).

For the purposes of these rules subjects of natural monopolies and the organization of utility complex concerning which price regulation (rates) is in accordance with the legislation of the Russian Federation performed (further - the regulated organizations) belong to the organizations performing regulated types of activity.

2. Requirements to the program are established by federal executive body, executive body of the subject of the Russian Federation or local government body which in accordance with the legislation of the Russian Federation about state regulation of the prices (rates) performs price regulation (rates) for goods (services) of the relevant regulated organization (further - regulating authority).

3. In case of establishment of requirements to programs the regulating authority determines the term of reduction by the regulated organizations of the programs in compliance with the established requirements constituting at least 3 months.

II. Principles of forming by regulating authority of requirements to the program

4. Requirements to the program include:

1) target indicators of energy saving and increase in energy efficiency which achievement shall be provided with the regulated organization as a result of program implementation (further - target indicators);

2) list of obligatory actions for energy saving and increase in energy efficiency and terms of their carrying out (daleeobyazatelny actions);

3) indicators of energy efficiency of objects, creation or upgrade of which it is planned by production or investing programs of the regulated organization (further - indicators of energy efficiency of objects);

4) values of target indicators and other indicators (if necessary).

4.1. Requirements to programs shall provide finishing use by the regulated organizations of lighting devices with use of LEDs to level:

in 2017 - at least 10 percent of total amount of the used lighting devices;

in 2018 - at least 30 percent of total amount of the used lighting devices;

in 2019 - at least 50 percent of total amount of the used lighting devices;

in 2020 - at least 75 percent of total amount of the used lighting devices.

4(2). Requirements to programs of electric power producers (capacity) which generating subjects function in technology isolated territorial electric utility systems and (or) in the territories which are technology not connected with Power pool system of Russia and technology isolated territorial electric utility systems shall provide in 2019 - 2025 decrease in specific consumption of conditional fuel, except for nuclear fuel, for one percent at least annually concerning the level reached in 2018.

5. Target indicators are created separately concerning each regulated type of activity.

6. Target indicators are created in measure type, reflecting results which achievement is provided during program implementation, and indicators reflecting results which achievement is provided during realization of the obligatory actions (separate events or groups of actions) created by regulating authority.
