ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

About approval of Special rules of hygiene of foodstuff of animal origin

(as amended on 27-01-2021)

In pursuance of provisions of the Law No. 221-XVI of October 19, 2007 on veterinary and sanitary activities (The official monitor of the Republic of Moldova, 2008, Art. No. 51-54, 153), with subsequent changes, and the Law No. 306/2018 on safety of foodstuff (The official monitor of the Republic of Moldova, 2019, Art. No. 59-65, 120) DECIDES: the Government

1. Approve Special rules of hygiene of foodstuff of animal origin (are applied).

2. This Resolution becomes effective in 18 months after publication in the Official monitor of the Republic of Moldova.

3. To impose control over the implementation of this Resolution on the National agency on safety of foodstuff.

Special rules of hygiene of foodstuff of animal origin

These Special rules of hygiene of foodstuff of animal origin (further - Rules) shift Regulations (EU) No. 853/2004 of the European Parliament and Council of April 29, 2004 about establishment of some specific regulations of hygiene applied to animal products, No. 2074/2005 of the Commission published in the Official magazine of the European Union by L 139 of April 30, 2004, appendix II-IV and VI to Regulations (EU) of December 5, 2005 about establishment of measures for application to some products, No. 853/2004 of the European Parliament and Council, and the organization of the official checks provided by Regulations (EU) No. 854/2004 of the European Parliament and Council and (EU) No. 882/2004 of the European Parliament and Council regulated by Regulations (EU) in departure from Regulations (EU) No. 852/2004 of the European Parliament and Council and about modification of Regulations (EU) No. 853/2004 and (EU) No. 854/2004 (the document extends to the EEA) published in the Official magazine of the European Union by L 338 of December 22, 2005.

Chapter I. General provisions

1. These rules are established, special regulations of hygiene for the processed and not processed foodstuff of animal origin. These special regulations supplement General rules of hygiene of foodstuff.

2. These rules are not applied to the foodstuff containing the processed products of both vegetable, and animal origin, except for case when exists specially established opposite specifying. At the same time the processed animal products used for production of such foodstuff shall arrive and be manipulated according to requirements of these rules.

3. These rules are not applied to:

a) primary production, held for use in household;

b) to preparation, manipulation and storage of foodstuff for private use;

c) direct implementation of small amounts of primary products by the producer to the final consumer or local retailer directly providing the final consumer;

d) to direct deliveries the producer of small amounts of fowl and the zaytseobrazny animals slaughtered on farm, to the final consumer or local retailer directly providing the final consumer with fresh meat;

e) to the hunters delivering small amounts of game or meat of game directly to the final consumer or local retailer directly providing the final consumer.

4. These rules are applied in retail trade in cases when transactions are made for the purpose of realization of foodstuff of animal origin to other company, except as specified, when:

a) transactions come down to storage or transportation, but in this case it is necessary to observe the special requirements to temperature conditions established in Chapters IV-XVI of these rules;

b) realization of the foodstuff of animal origin received from retailer is intended for other retailer, and in case of the localized and limited activities.

5. In these rules the used terms mean:

meat - edible parts of house hoofed animals, poultry, zaytseobrazny, the shot game, the wild animals who are grown up under production conditions, the small shot game, the big shot game including blood;

hoofed pets are pets of type cattle (including types of Bubalus and Bison), pigs, sheep and goats, and also house one-hoofed animals;

the poultry - bird, is grown up in the conditions of farm including the bird who is not considered house, but is grown up as house, except for ostriches; zaytseobrazny - the domestic rabbits, rabbits who are grown up in the conditions of farm and rodents;

the shot game:

- wild hoofed and zaytseobrazny, and also other land mammals who shoot back for consumption in food and are considered as game, on the basis of the current legislation, including mammals who live in the closed territories, in the conditions of freedom, similar to conditions for the shot game;

- the wild birds shot for consumption in food;

the game which is grown up on farm - not flying birds and land mammals who are grown up on farm; the small shot game - the wild shot birds and zaytseobrazny, living freely in the wild nature;

the big shot game - the wild land mammals who are living at liberty and not falling under determination the small shot game;

fresh meat - the meat not subject to any process of preservation, except chilling, freezing or bystry freezing, including packed into vacuum package or into the controlled atmosphere;

hulk - body of animal after processing on slaughter owing to obesshkurivaniye, imboweling, removal of bodies and some parts of body depending on type;

edible bodies - fresh meat, except ink, including interiors and blood;

interiors - bodies of chest, belly or pelvic cavities, and also trachea and gullet, for birds - craw;

forcemeat - the rolled meat crushed containing less than 1% of salt;

the meat of mechanical boning (MMB) - the product received owing to department of meat from bones after boning or from carcasses of birds by mechanical means by which destruction or change of fibrous structure of muscles is caused;

the processed meat - fresh meat, including the meat cut on pieces to which foodstuff, spices, additives was added or which underwent to the process not capable to change internal structure of muscle fiber and to eliminate characteristics of fresh meat;

slaughter - the company intended for face and removal of interiors of animals which meat is intended for consumption by the person;

the finishing shop - the company intended for boning and/or cutting of meat;

the companies for manipulation of game - the company at which the game and the meat of game received as a result of hunting are prepared for delivery to the market;

double-wing mollusks - lamellar and branchiate mollusks which eat by filtering;

production zone - any sea, lagunny zone or zone in mouths of the rivers containing the natural schools of clams or sites used for cultivation of clams from whom they are brought together live;

the center of sending - the company located on the coast or in the sea for acceptance, conditioning, sink, cleaning, sorting, wrapping and packaging of the live clams intended for consumption by the person;

sea biotoxins - the toxic agents accumulated by double-wing mollusks owing to feeding by plankton containing toxins;

fishery products - fresh-water and marine animals (except for double-wing live mollusks, erinaceouses and live sea Gastropoda, all mammals, reptiles and frogs) either the wild or grown-up under production conditions animal, including all edible forms and parts of these animals;

the judgment plant - the vessel onboard which fishery products before packing or packaging and, if necessary, chilling or freezing are exposed to one or several following actions: to filetirovaniye, cutting, removal of skins, shells, sinks, armors, crushing and conversion;

judgment deep freeze - the vessel onboard which freezing of products of fishery is performed, and if necessary - freezing after preparatory actions, such as: bleeding, beheading, removal of interiors (nutrovka or imboweling) and fins with the subsequent packaging, if necessary; 3

the fishery products which are mechanically divided - the product received by removal of meat from fishery products with use of mechanical means therefore the structure of meat is lost or changes;

fresh products of fishery - not processed fishery products, whole or processed, including the products packed in vacuum or the changed atmosphere which were not exposed to conversion for ensuring conservation, except chilling;

the processed products of fishery (semifinished products) - not processed fishery products which were affected, changing their anatomic integrity, such as: nutrovka, beheading, cutting, filetirovaniye and cutting;

raw milk - the milk received by secretion of mammary gland of farm animals, not heated more than 400 With or not subjected to any other similar processing;

colostrum - the secret of mammary gland received from productive dairy animals within three-five days after the delivery rich with antibodies and minerals which precedes formation of milk;

the company for milk production - the company in which contains one or more farm animals, for production of milk for the purpose of its delivery to the market as foodstuff;

egg - egg in shell, except broken, incubatory or prepared, received from the bird who is grown up in the conditions of farm, and suitable for direct consumption in food by the person or for preparation of products from eggs;

liquid egg - content of not processed egg after removal of shell;

the egg burst - egg with the burst shell, but with the whole cover;

the packaging center - the company at which egg is sorted by quality and weight;

frog legs - lower body of nutrovanny and skin-off frog of type of Ranna spp. (Ranidae family), separated by the cross-section executed from the back of forepaws;

snails are land Gastropoda of type of Helix pomatia Linne, Helix aspersa Muller, Helix lucorum and types of the Achatinidae family;

meat products - the processed products received as a result of conversion of meat or the subsequent conversion of such processed products that cut part specified that the product has no characteristics of fresh meat;

dairy products - the processed products which come from conversion of raw milk or the subsequent conversion of such processed products;

products on the basis of colostrum - the products received as a result of conversion of colostrum or conversion of these products;

products from eggs - the processed products received as a result of conversion of eggs, their different components, egg mixes or the subsequent conversion of such processed products;

the processed fishery products - the processed products received as a result of conversion of products of fishery or the subsequent conversion of such processed products;

the processed animal fats - the fats received as a result of meat topleniye, including bones, intended for consumption by the person;

cracklings - the conversion remaining balance containing proteins after partial department of fat and water;

gelatin - the soluble natural protein, gelatinous or not gelatinous forms received by partial hydrolysis of the collagen made from the bones processed and the raw skins, sinews and sinovialny liquid of animals;

collagen - the main proteinaceous product received from the bones processed and the raw skins and sinews, made according to requirements of these rules; stomachs, bladders and the processed guts - the stomachs, bladders and guts received, cleared and subjected to processing: to pickles, heating or drying;

other foodstuff of animal origin - foodstuff of animal origin, including honey and blood, the live double-wing mollusks, erinaceouses, tunikata and sea Gastropoda intended for consumption by the person and delivery to the final consumer;

tanning - hardening of skin by means of vegetable tannins, salts of chrome and other substances, such as salts of aluminum, iron, silicon acid, aldehydes and quinones or other synthetic hardeners;

identification brand - the seal set by the entrepreneur of the food sector confirmatory that products were received at the companies having veterinary and sanitary authorization according to Law No. 221 provisions - XVI of October 19, 2007 about veterinary and sanitary activities;

visible parasite - any parasite or group of the parasites having one size, color or texture allowing to identify accurately parasite in tissue of fish;

visual inspection - the nondestructive research of fishes or products of fishery conducted with or without optical means of increase and in the conditions of good lighting for human eye including research on light, as necessary;

research on light - (in case of flat fishes or fillet of fish) research counter light of the fish lit with light source in the dark room for detection of parasites;

identification brand - the distinctive marking delivered by the entrepreneur of the food sector confirmatory that products were received at the companies having veterinary and sanitary authorization according to Law No. 221 provisions - XVI of October 19, 2007 about veterinary and sanitary activities;

visible parasite - any parasite or group of the parasites having one size, color or texture allowing to identify accurately parasite in tissue of fish;

visual inspection - the nondestructive research of fishes or products of fishery conducted with or without optical means of increase and in the conditions of good lighting for human eye including research on light, as necessary;

research on light - (in case of flat fishes or fillet of fish) research counter light of the fish lit with light source in the dark room for detection of parasites.
