1. Approve the Instruction about procedure for use of transport (transportation), business and (or) other documents as the declaration on goods it (is applied).

2. This decision becomes effective from the effective date the Agreement on the Customs Code of the Customs Union approved by the Decision of Interstate Council of Eurasian economic community (the supreme body of custom union) at the level of heads of states of November 27, 2009 No. 17.

The instruction about procedure for use of transport (transportation), business and (or) other documents as the declaration on goods

I. General provisions

1. This Instruction about procedure for use of transport (transportation), business and (or) other documents as the declaration on goods (further - the Instruction) is developed according to Article 105, Item 5 of Article 109 and Items 1 - 4 Articles 112 of the Customs code of the Eurasian Economic Union (further - the Code) and determines procedure for use of transport (transportation), business and (or) other documents as the declaration on goods, and also procedure for making of the customs transactions connected with change (amendment) of the data declared in the declaration on goods as which transport (transportation), business and (or) other documents, before release of goods and feature of making of the customs transactions connected with change (amendment) of such data after release of goods were used.

2. In case of customs declaration of goods (further - declaring) with use as the declaration on goods (further - DT) transport (transportation), business and (or) other documents in the cases determined by Sections II and III of this Instruction, the customs applicant or the customs representative together with such documents in customs authority provides the written application (further - the statement) or the inventory (further - the list) according to this Instruction.

3. Giving of DT as which transport (transportation), business and (or) other documents are used is not followed by representation of its electronic type to customs authority if concerning the goods specified in it customs duties, taxes, the special, anti-dumping, compensatory duties are not subject to payment.

By the legislation of state members of the Eurasian Economic Union on customs regulation it can be determined that giving of DT as which transport (transportation), business and (or) other documents are used is not followed by representation of its electronic type to customs authority if concerning the goods specified in it customs duties, taxes, the special, anti-dumping, compensatory duties are subject to payment, and the electronic type of such DT on paper in this case is created by the official of customs authority.

3.1. The electronic type of DT on paper as which transport (transportation), business and (or) other documents are used (further - electronic type of DT) including in case, stipulated in Item the 19th this Instruction, is created according to the structure and format of the declaration on goods and adjustments of the declaration on goods approved by the Decision of Board of the Eurasian economic commission of May 30, 2023 No. 75, and in the scope of information, provided by subitems 2 - the 7th Item 8 of this Instruction.

When forming electronic type of DT in the detail of structure corresponding to the third subsection of column 1 DT the abbreviation of "SD" is specified.

4. Provisions of this Instruction are not applied in the relation:

1) currencies of state members of the Eurasian Economic Union, securities and (or) currency values, travel checks, precious metals and gemstones;
