About creation of the Agency on transplantation

For the purpose of realization of provisions of article 4 of the Law on organ transplantation, fabrics and cells of the person No. 42-XVI of March 6, 2008. (The official monitor of the Republic of Moldova, 2008, No. 81, the Art. 273) DECIDES: the Government

1. Create transplantation Agency - the public organization subordinated to the Ministry of Health, work and social protection.

2. Approve:

Regulations on the organization and functioning of the Agency on transplantation according to appendix No. 1;

Structure of the Agency on transplantation according to appendix No. 2.

3. Establish the extreme number of staff of the Agency on transplantation in quantity of 19,5 of units.

4. To perform financing of the Agency on transplantation at the expense of the means which are annually approved by the law on the government budget and within the established number of staff for the Ministry of Health, work and social protection.

5. To the Ministry of Health, work and social protection in 15-day time from the effective date of this Resolution to appoint the director and to approve the staff list of the Agency on transplantation.

Regulations on the organization and functioning of the Agency on transplantation

Chapter I. General provisions

1. This Provision determines mission, the main functions, obligations and the rights of the Agency on transplantation (further the Agency), and also procedure for its functioning.

2. The agency is the public organization subordinated to the Ministry of Health, work and social protection realizing national policy and programs for organ transplantation, fabrics and cells of the person with providing to patients of equal access to services in transplantation.

3. The agency is legal entity, has seal with the image of the State Emblem of the Republic of Moldova and treasurer accounts.

Chapter II. Mission, main functions and powers of the Agency

4. The mission of the Agency consists in the organization and monitoring of activities in the sphere of organ transplantation, fabrics and cells of the person in all territory of the Republic of Moldova according to the current legislation, and also in the prevention of illegal trade in bodies, fabrics and cells of the person.

5. The main functions of the Agency are:

1) the organization and coordination of activities for withdrawal, transportation and distribution of bodies for transplantation in the territory of the Republic of Moldova;

2) the organization and coordinating of activities for withdrawal, preparation, conservation, validity determination, distribution, storage and transportation of fabrics and cells of the person for transplantation in the therapeutic purposes in the territory of the Republic of Moldova;

3) assessment and monitoring of implementation of provisions of regulations for the purpose of implementation of the specific obligations approved by the Ministry of Health, work and social protection;

4) coordination and monitoring of traceability of reproduction of the person in the medical way;

5) performs the competences and responsibility provided by the Law No. 181/2014 on public finance and budget and tax responsibility

6. For performance of the mission and the main Agency functions performs the following powers:

1) performs actions for donorship and organ transplantation, fabrics and cells of the person according to the current legislation;

2) owns and manages the Automatic information system "Transplant" and the National registry of kidneys, provides permanent traceability of all activities for transplantation and development of statistic reports in the field

Develops 3) and represents to the Ministry of Health, work and social protection on approval of action within national programs for organ transplantation, fabrics and cells of the person;

4) represents offers to the Ministry of Health, work and social protection on enhancement of regulations of regulation of all types of activity on organ transplantation, fabrics and cells of the person;

5) submits for approval to the Ministry of Health, work and social protection medical and sanitary organizations which can perform activities for withdrawal and/or organ transplantation, fabrics or cells of the person, and also doctors who can carry out removal of organs, fabrics or cells of the person, and exercises control of their activities;

Submits 6) for approval to the Ministry of Health, work and social protection, creates and keeps the List of centers/banks of human fabrics and/or cages in which activities for preparation, preservation, validity determination, storage and issue of human fabrics and cages for therapeutic use and control of their activities in the field are performed;

7) it is excluded;

8) installs the single system of coding delivering information on the donor and the receiver concerning "human bodies, fabrics and cages;

9) establishes the single requirements to traceability applicable to all relevant data on the products and materials coming into contact with these bodies, fabrics and cages; single technical requirements to donorship, withdrawal, testing, preservation, transportation and organ transplantation, and also single technical requirements to donorship, withdrawal, testing, processing, preservation, storage, coding, distribution and transplantation of fabrics and cells of the person

10) is coordinated by each case of withdrawal and organ transplantation, fabric or cell of the person;

Registers 11) and analyzes all reactions and collateral hard cases;

12) cooperates with competent organizations in the field of ensuring sanitary and epidemiologic safety of bodies, fabrics, cells of the person and their derivatives for ensuring sanitary safety in case of withdrawal, preparation, preservation, issue, transportation and organ transplantation, fabrics and cells of the person according to the law;

Initiates 13) in cooperation with public institutions, non-governmental organizations, the international structures or physical persons, wages campaigns for promotion of organ donation, fabrics and cells of the person for transplantation or participates in them;
