This Law determines the legal basis of state regulation in the field of nationality, regulates the bases and procedure for acquisition, preserving and termination of nationality of the Republic of Belarus, acceptance, execution and appeal of decisions concerning nationality, determines particular cases of change and preserving nationality, establishes competence of state bodies, and also the rights and obligations of citizens of the Republic of Belarus in the field.

Chapter 1. General provisions

Article 1. Nationality of the Republic of Belarus

Nationality of the Republic of Belarus is the stable legal bond of the person with the Republic of Belarus which is expressed in total their mutual rights, obligations and responsibility, based on recognition and respect of advantage, basic rights and human freedoms.

Nationality of the Republic of Belarus is the integral attribute of the state sovereignty of the Republic of Belarus.

Article 2. Legal regulation of questions of nationality of the Republic of Belarus

Questions of nationality in the Republic of Belarus are regulated by the Constitution of the Republic of Belarus, this Law, other acts of the legislation and international treaties of the Republic of Belarus.

If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.

Article 3. Principles of nationality of the Republic of Belarus

Nationality of the Republic of Belarus is based on the following principles:

everyone has the right to nationality;

nationality of the Republic of Belarus is equal for all citizens of the Republic of Belarus irrespective of the bases of its acquisition;

citizenship of the Republic of Belarus cannot be granted against the will of person;

nobody can be deprived of nationality of the Republic of Belarus or the right to change nationality;

in case of decision making concerning children concerning nationality the best interests of the child are considered;

The Republic of Belarus aims at avoidance of cases of statelessness.

Article 4. Protection and protection of citizens of the Republic of Belarus by the state

The state guarantees to citizens of the Republic of Belarus protection and protection both in the territory of the Republic of Belarus, and beyond its limits.

If in the state of stay of citizens of the Republic of Belarus there are no diplomatic representations and consular establishments of the Republic of Belarus (further – bodies of diplomatic service), protection of the rights and legitimate interests of citizens of the Republic of Belarus according to international treaties of the Republic of Belarus can be performed by relevant organs of other states.

Article 5. Inadmissibility of issue of the citizen of the Republic of Belarus to foreign state

The citizen of the Republic of Belarus cannot be issued to foreign state if other is not provided by international treaties of the Republic of Belarus.

Article 6. Preserving nationality of the Republic of Belarus

Accommodation of the citizen of the Republic of Belarus in the territory of foreign state in itself does not lead to loss of nationality of the Republic of Belarus.

Article 7. Nationality of the Republic of Belarus in case of the conclusion and annulment of marriage

The conclusion or annulment of marriage by the citizen of the Republic of Belarus with the foreign citizen or the stateless person in itself does not attract acquisition by spouses of nationality of the Republic of Belarus or its termination.

Person who got married with the citizen of the Republic of Belarus acquires nationality of the Republic of Belarus in the presence of his desire and observance of the conditions provided by this Law.

Article 8. Citizens of the Republic of Belarus

Citizens of the Republic of Belarus are:

the faces consisting in nationality of the Republic of Belarus on the date of entry into force of this Law;

persons who acquired nationality of the Republic of Belarus according to this Law.

Citizens of the Republic of Belarus on the birth are recognized:

the persons who were born within the modern territory of the Republic of Belarus, being citizens of the former USSR on the birth and acquired nationality of the Republic of Belarus before entry into force of this Law;

persons which acquired nationality of the Republic of Belarus according to articles 9-12 of the Law of the Republic of Belarus of October 18, 1991 No. 1181-XII "About nationality of the Republic of Belarus" or article 13 of this Law.
