About the basic principles of cooperation of the State Parties of the CIS in the field of tourism

considering freedom of movements necessary by condition of further development of the friendship leading to strengthening of economic cooperation and cultural mutual enrichment
expressing confidence that tourism development is intended to promote formation of civil peace and harmony, mutual understanding strengthening, approval of universal values,
aiming to promote in every possible way rapprochement of normative bases of the State Parties of the Commonwealth in the field regulations of legal relationship and to forming within the CIS of single tourist space,
adopted this referral legal act as set of the basic principles of state regulation which are uniformly understood and divided by all states of the Commonwealth.
In this referral legal act to the following concepts the terminological value which is equally understood by all participants is set.
Tourism - temporary departure of people from the permanent residence for the purpose of vakatsionny, improving, cognitive or professional and business without occupations paid activities in the place of temporary stay.
The tourist - the citizen of any state who temporarily arrived to the country, certain area within the country or the specific settlement within certain area for a period of 24 hours up to six months, the traveler just for the hell of it or with the business purposes and not engaged at the same time in paid activities in the place of temporary stay.
Tour - the tourist trip along certain route to specific terms provided with range of services in the field of movement, housing, medical and cultural attendance.
The tourist voucher - the individual or group document issued by tourism organization, which is form of the contract between the supplier and the consumer of tourist services and confirming their payment.
Tourism organization - the legal entity irrespective of patterns of ownership who is engaged in activities in the field of tourism based on the license or recognized as that in other form established by the law.
Tourist resources - set of the natural, improving, cultural and other resources of this territory capable to satisfy different requests and needs of the tourist for their complex or separately.
The national legal system of the State Parties of the CIS in the field of tourism includes the generalizing legal acts developed and accepted taking into account the principles stated in this referral act, the concretizing normative and legal acts regulating the separate aspects caused by specific circumstances of the certain states. The general orientation in development of the national legal system cannot significantly limit the principles fixed in this referral act.
The national legal system is supplemented with the interstate and intergovernmental bilateral or multilateral agreements developing or concretizing regulations of the national laws. The international multi-lateral agreements and conventions in the field of tourism acquire in the State Parties of the CIS legal effectiveness according to the ratification procedures determined by the national legal system.
The State Parties of the CIS promote tourism development as effective industry of economy and efficient means of rapprochement of the people, guarantee most favored nation treatment in tourist activities, create the legal and regulatory base in the field of tourism, provide equal conditions for implementation of tourist activities by legal entities and physical persons, promote development of international cooperation and professional training of specialists.
Are under authority the State Parties of the CIS on behalf of their state governing bodies:
forming of the regulatory base in the field of tourist activities and coordination of interstate cooperation;
forming of national development programs of tourism;
establishment of procedure for standardization, licensing and certification in the field of tourism;
management of state-owned property in the field of tourism, financing of state bodies and supervision of observance of the rights of tourists;
determination of procedure for provision of privileges to separate categories of tourists;
other actions provided by the national legal system.
By preparation for travel, during transit and on arrival to the region of tourist interest the tourist has the right:
on receipt of data on availability and nature of the license for tourist activities at the accepting organization;
on objective and exact information about the laws and rules of stay in this country or area, about the customs of local population and restrictions connected with departure of the religious practices by them about restrictions for visit of the natural and anthropogenous objects which are on the mode of special protection;
on open entry to any objects of tourist interest, for visit and use of which there are no restrictions of ecological or sociocultural nature set legally;
on protection of the safety, health and property, and also on protection of the personal non-property rights;
on providing living and sanitary conditions not below than the standards average for this area;
on assistance of bodies of local administration in rendering legal assistance and confirmation insurance and others unfortunate or emergencies and circumstances.
During stay in the region of tourist interest, and also throughout transit the tourist shall:
promote the behavior to mutual understanding and the friendly relations between the people;
respect the established political, social, moral, cultural and religious way and procedure, to submit to current laws and rules.
