About radiation safety of the population
This Law determines bases of legal regulation in the field of ensuring radiation safety, is directed to creation of the conditions providing protection of life and human health, environment protection against harmful effects of ionizing radiation.
For the purpose of this Law the following basic concepts are applied:
radiation safety of the population (further - radiation safety) - condition of security of these and future generations of people from impact of ionizing radiation, harmful to their health;
ionizing radiation - the radiation which is created in case of radioactive decay nuclear transformations, braking of charged particles in substance and forms in case of interaction with environment ions of different signs;
natural radiation background - the radiation dose created by the space radiation and radiation of the natural radionuclides which are naturally distributed in the earth, water, air, other elements of the biosphere, foodstuff and human body;
tekhnogenno the changed radiation background - the natural radiation background changed as a result of activities of the person;
effective dose - the size of impact of ionizing radiation used as measure of risk of emergence of the remote effects of radiation of human body and its separate bodies taking into account their radio sensitivity;
the sanitary protection zone - the territory around source of ionizing radiation in which the level of radiation of people in the conditions of normal operation of this source can exceed the set radiation dose limit for the population. In the sanitary protection zone permanent and temporary residence of people is forbidden, the regime of restriction of economic activity is introduced and radiation control is carried out;
observation zone - the territory outside the sanitary protection zone on which radiation control is made;
the worker - physical person which permanently or temporarily works directly with sources of ionizing radiation;
radiation accident - the loss of management of source of ionizing radiation caused by defect of the equipment the wrong actions of workers (personnel), natural disasters or other reasons which could give or led to radiation of people above of the established regulations or to radioactive environmental pollution.
1. Legal regulation in the field of ensuring radiation safety is performed by this Law and other regulatory legal acts.
2. The laws, other regulatory legal acts cannot establish the regulations reducing the requirements to radiation safety and guarantees of their providing established by this Law.
3. The conventional principles and rules of international law and the international agreements in the field of ensuring radiation safety are component of system of law according to the Constitution.
If the international treaty establishes other rules, than those which are stipulated by the legislation in the field of radiation safety are applied rules of the international treaty.
1. The basic principles of ensuring radiation safety are:
the principle of regulation - not exceeding of admissible values of individual doses of radiation of citizens safe for their health, from all sources of ionizing radiation;
the principle of reasons - prohibition of all types of activity on use of sources of ionizing radiation in case of which the advantage received for the person and society does not exceed risk of the possible harm done by radiation, additional to natural radiation background;
the principle of minimization - maintenance within values, safe for health of citizens, individual doses of radiation and number of the irradiated persons when using any source of ionizing radiation at perhaps lower level.
2. In case of radiation accident the system of radiation safety of the population is based on the following principles:
expected actions for mitigation of consequences of radiation accident shall provide reduction of individual doses of radiation of citizens according to the established standard rates;
types and scale of activities for mitigation of consequences of radiation accident shall be realized so that the advantage of decrease in dose of ionizing radiation, except for the harm done by the specified activities was maximum.
Radiation safety is ensured:
carrying out package of measures of legal, organizational, technical, ecological, sanitary and hygienic, medico-preventive, educational and educational nature;
implementation by state governing bodies, public associations, other legal entities and citizens of actions for observance of rules, regulations and standard rates in the field of radiation safety;
informing population on radiation situation and measures for ensuring radiation safety;
training of the population in the field of ensuring radiation safety.
In the field of ensuring radiation safety treat powers of the state:
determination of state policy in the field of ensuring radiation safety and its realization;
development and adoption of the laws and other regulatory legal acts of the state in the field of ensuring radiation safety, control of their observance;
development, approval and program implementation in the field of ensuring radiation safety;
determination of the types of activity in the field of the address with sources of ionizing radiation which are subject to licensing;
establishment of procedure for life insurance and health of citizens from risk of radiative effects;
establishment of procedure for determination of types and the amount of compensations for the increased risk of damnification to health of citizens and drawings the losses to their property caused by radiative effects;
ensuring conducting information accounting and control of objects of radiation materials and sources of ionizing radiation, production facilities, transportations, conversions, uses, collection, storage and burial of radioactive materials and sources of ionizing radiation;
establishment of procedure for compensation of the citizens caused harm to health and losses to their property as a result of radiation accident;
creation and ensuring functioning of single system of public administration in the field of ensuring radiation safety, including control and accounting of doses of radiation of the population;
regulation of conditions of life activity and specific modes of accommodation in the territories which underwent to radioactive pollution as a result of radiation accidents;
control of assistance to the population which underwent to radiation as a result of radiation accidents;
