Approve the enclosed Rules of transfer of data on arrival in the place of stay and departure from the place of stay of foreign citizens and stateless persons with use of the means of communication which are part of network of telecommunication.

Rules of transfer of data on arrival in the place of stay and departure from the place of stay of foreign citizens and stateless persons with use of the means of communication which are part of network of telecommunication

1. These rules establish procedure and conditions of transfer by the hotel or other organization rendering hotel services, sanatorium, rest house, boarding house, children's recreation camp, tourist center, camping, the medical organization providing medical care in stationary conditions or the organization of social servicing providing social services in stationary form including to persons of no fixed abode or the organization performing criminal or administrative penalty in body of migration registration of data on arrival in the specified place of stay and departure from it foreign citizens and stateless persons (further - foreign citizens) with use of the means of communication which are part of network of telecommunication.

2. The concepts used in these rules mean the following:

"the receiver of data" - territorial authorities of the Ministry of Internal Affairs of the Russian Federation which according to the federal legislation perform registration of foreign citizens at the place of residence and accounting of foreign citizens in the place of stay;

"the supplier of data" - administrations of the hotels or other organizations rendering hotel services, sanatoria, rest houses, boarding houses, children's recreation camps, tourist centers, campings, the medical organizations providing medical care in stationary conditions or the organizations of social servicing providing social services in stationary form including to persons of no fixed abode or the organizations performing criminal or administrative penalty in which there are foreign citizens.

3. The supplier of data signs with the receiver of data the data exchange agreement the data in which following provisions are provided:

a) mode of information exchange of data;

b) procedure for information exchange of data, including between territorial authorities and (or) structural divisions of the parties;

c) rights and obligations of the Parties;

d) conditions of use of the digital signature when implementing information exchange of data;

e) procedure for permission and (or) restriction of access to the data transferred by the supplier;

e) bases and conditions of agreement cancelation.

4. The supplier of data notifies the receiver of data on arrival of the foreign citizen in the place of stay and its departure from the place of stay with use of the means of communication which are part of network of telecommunication. The form of the specified notification, and also the list of the data containing in it affirm the Ministry of Internal Affairs of the Russian Federation.

5. The supplier of data sends data on arrival of the foreign citizen to the receiver of data within 1 working day from the date of arrival of this foreign citizen in the place of stay, and in case of its arrival in non-working day - within 1 working day following it.

The supplier of data directs data on departure of the foreign citizen to the receiver of data no later than 12 o'clock in the afternoon following behind day of departure of this foreign citizen.

6. Ensuring protection of data in case of information exchange of data is performed in accordance with the legislation of the Russian Federation.
