1. Determine that since July 1, 2010 legal entities and individual entrepreneurs perform retail trade through the online stores registered in the Trade register of the Republic of Belarus according to the procedure provided by this resolution.

2. The legal entities and individual entrepreneurs performing retail trade through online stores shall address from June 1 to June 30, 2010 in the procedure established by this resolution for registration of online stores in the Trade register of the Republic of Belarus.

Submission to the licensing body of the data confirming registration of online store in the Trade register of the Republic of Belarus in the presence of special permission (license) for retail trade (including alcoholic beverages and tobacco products) and public catering, this resolution issued before entry into force which effective period expires till November 1, 2010 is not required.

3. Approve the enclosed Regulations on order of registration of the online stores used for implementation of retail trade in the Trade register of the Republic of Belarus and the mechanism of control of their functioning.

4. Make additions and changes to the following resolutions of Council of Ministers of the Republic of Belarus:

4.1. in Item 1 of the resolution of Council of Ministers of the Republic of Belarus of March 17, 2005 No. 292 "About the Trade register of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2005, No. 52, 5/15741):

4.1.1. add subitem 1.1 with part two of the following content:

"In the Trade register of the Republic of Belarus the online stores used for implementation of retail trade, according to the procedure, established by the legislation are subject to registration;";

4.1.2. in subitem 1.3 of the word "provision on the Trade register of the Republic of Belarus" to replace with the word "legislation";

4.2. Ceased to be valid

5. To the republican state bodies and other state organizations subordinated to the Government of the Republic of Belarus, regional executive committees and the Minsk Gorispolkom till May 15, 2010 to bring the regulatory legal acts into accord with this resolution.

6. To the Ministry of Trade till May 15, 2010:

6.1. approve forms:

statements for registration of the online stores used for implementation of retail trade in the Trade register of the Republic of Belarus;

notifications on change of data on the online stores provided for maintaining the Trade register of the Republic of Belarus;

statements for cancellation of registration of the online stores used for implementation of retail trade in the Trade register of the Republic of Belarus;

6.2. determine in coordination with the Ministry of Taxes and Tax Collection procedure for submission of the statement in the form of the electronic document and procedure for confirmation of its obtaining by the body authorized on carrying out registration of online stores;

6.3. together with regional executive committees and the Minsk Gorispolkom to take other measures for implementation of this resolution.

Grant the right to the Ministry of Trade to make explanations about application of the Regulations on order of registration of the online stores used for implementation of retail trade in the Trade register of the Republic of Belarus and the mechanism of control of their functioning.

7. To provide to regional executive committees, the Minsk Gorispolkom since June 1, 2010 registration of online stores in the procedure established by this resolution.

8. This resolution becomes effective since May 1, 2010, except for Item 3 and subitem 4.2 of Item 4, becoming effective since June 1, 2010, Items 5, 6 and this Item, becoming effective from the date of official publication of this resolution.

Regulations on order of registration of the online stores used for implementation of retail trade in the Trade register of the Republic of Belarus and the mechanism of control of their functioning

Chapter 1. General provisions

1. This Provision determines order of registration of the online stores used for implementation of retail trade in the Trade register of the Republic of Belarus (further - registration), modification and (or) amendments of the data on these online stores entered in the Trade register of the Republic of Belarus (further - the Trade register), and also the mechanism of control of functioning of online stores and procedure for cancellation of their registration.

2. Registration is performed by city and district executive committees, local administrations of Minsk in place of registration of the legal entity and individual entrepreneur (further - registering bodies) by the declarative principle.

3. Registering bodies:

perform registration by introduction of data on the online store used for implementation of retail trade (further - online store), in the corresponding territorial database of the Trade register which in the automated mode join in the Trade register;

make changes and (or) additions to the data on online store provided for maintaining the Trade register;

provide systematization and storage of the data provided for maintaining the Trade register;

perform other functions connected with registration and maintaining the Trade register.

4. Registering bodies shall provide documents acceptance for registration according to the schedules approved by them, except for the days off, the public holidays and holidays which are non-working days.
