1. Approve the enclosed Regulations on procedure for creation of the request for registration and provision of right to use by the name of the place of goods origin.

2. Authorize the State committee on science and technologies till May 5, 2010 to develop and approve forms of statements for registration and provision of right to use by the name of the place of goods origin and about right to use provision by already registered name of the place of goods origin.

3. This resolution becomes effective after its official publication.

Regulations on procedure for creation of the request for registration and provision of right to use by the name of the place of goods origin

1. This Provision developed according to Item 7 of article 4 of the Law of the Republic of Belarus of July 17, 2002 "About geographical instructions" (The national register of legal acts of the Republic of Belarus, 2002, No. 84, 2/876) (further - the Law), are established requirements to documents of the request for registration and provision of right to use by the name of the place of goods origin and the request for right to use provision by already registered name of the place of goods origin.

2. For the purposes of this provision concepts of the values determined in the Law and the following terms, their determinations and reducings are used:

VOIS - World Intellectual Property Organization;

GKNT - State committee on science and technologies;

the conclusion of competent authority - the conclusion of the state body given Council of Ministers of the Republic of Belarus authority to establish borders of geographical object where the goods which special characteristics only or are mainly determined by environment and (or) human factors, characteristic of this geographical object, are made, and also to draw the conclusion that the applicant makes the specified goods in the territory of this geographical object;

the request - the request for registration and provision of right to use by the name of the place of goods origin, and also on right to use provision by already registered name of the place of goods origin;

the declared designation - the designation declared on registration of the name of the place of goods origin;

the patent agent - the physical person certified and registered in the State register of patent agents of the Republic of Belarus.

3. The request shall belong to one name of the place of goods origin.

4. The request shall contain the documents specified in item 4 of article 4 of the Law.

5. The request is submitted in one copy on Belarusian or Russian in the form approved by GKNT.

6. If no data can be placed completely in the request, they are provided in the same form on additional leaf with indication of "watch continuation on additional leaf".

7. Contain in the request:

7.1. the statement for registration and provision of right to use by the name of the place of goods origin or about right to use provision by already registered name of the place of goods origin with indication of:

7.1.1. the information about the applicant (applicants), including:

full name of the legal entity according to the constituent document or surname, own name, middle name (if that is available) physical person, and surname is specified before own name and middle name (if that is available);

the location or residence of the applicant (applicants), including the country of the location or residence, and also phone number (fax) and (or) the e-mail address (if those are available). When specifying the country of the location or residence of the applicant (applicants) the code according to the VOIS ST standard is used. 3, if it is established.

If applicant is the legal entity of the Republic of Belarus, its all-statistical code of the companies and organizations (RCBO), the accounting number of the payer (ANP) and the name of the legal entity to which submits are specified or part of which the legal entity - the applicant is.

7.1.2. addresses of the applicant (applicants) for correspondence in the territory of the Republic of Belarus according to rules of addressing of mailings, the addressee, and also phone number (fax) and (or) the e-mail address (if those are available);

7.1.3. the information about the patent agent if the application is submitted through the patent agent, including:

surname, own name, middle name (if that is available) the patent agent;

registration number of the patent agent, and also phone number (fax) and (or) the e-mail address (if those are available);

7.2. the declared designation executed by standard font (Cyrillics, Latin and (or) the Arab figures without any special graphical execution);

7.3. specifying of goods for which designation registration and provision of right to use by the name of the place of goods origin or right to use provision by already registered name of the place of goods origin, and also specifying of the place of its production (borders of geographical object) are asked;

7.4. description of special characteristics of goods.

The following documents shall be attached to the request:

the conclusion of competent authority that the applicant makes in the territory of certain geographical object goods which special characteristics only or are mainly determined by environment and (or) human factors, characteristic of this geographical object, - for the national applicant (physical person or legal entity of the Republic of Belarus);
