About the approved development of the international transport corridors passing on the territory of the State Parties of the Commonwealth of Independent States
The governments of the State Parties of the Commonwealth of Independent States which further are referred to as with the Parties
for the purpose of realization:
The priority directions of cooperation of the State Parties of the CIS in the field of transport for the period till 2020 approved by the Decision of Council of CIS Heads of Government of November 14, 2008
The memorandum of cooperation of the State Parties of the CIS in the field of the international transport corridors of September 18, 2003,
Concepts of the approved transport policy of the State Parties of the CIS for the period till 2010 approved by the Decision of Council of CIS Heads of Government of September 15, 2004
The protocol on the international highways of the Commonwealth of Independent States of September 11, 1998;
recognizing need of carrying out coordinated policy on ensuring effective operation and development of sites of the international transport corridors passing on the territory of the State Parties of the CIS, providing optimal transport and economic conditions of their functioning, attraction of additional transit transport flows;
realizing that the international transport corridors passing on the territory of the State Parties of the CIS are compound and integral part of the Euroasian system of transport corridors;
considering international experience of development of regional transport systems,
agreed as follows:
For the purposes of this agreement the following terms are used:
the international transport corridor (ITC) - set of the main transport communications of the different types of transport established by the Parties (except for air) as which are available, and newly created, with the corresponding arrangement, the passengers providing transportations and loads on the directions connecting the territories of the State Parties of the CIS;
subsystems of providing MTK - normative and legal, resource and information and logistic fields of activity of competent authorities of the Parties and bodies of industry cooperation of the CIS on ensuring the approved development of MTK;
harmonization of subsystems of providing MTK - the interstate activities directed to creation of conditions for the approved and balanced functioning and interaction of subsystems of providing MTK for the purpose of increase in efficiency of their use and development;
subsystem of normative legal support of MTK - complex of international treaties and national regulatory legal acts of the State Parties of the CIS in the transport sphere regulating development of MTK;
subsystem of resource providing MTK - set of elements of transport, infrastructure, financial, technological support, and also systems of safety of movement, safety of the loads and environmental protection regulating implementation of the international transport process on the MTK directions;
subsystem of information and logistic providing МТКсовокупность of means and rules of the information and documentary organization of transportation of goods and passengers, their monitoring, data collection and efficiency analysis of use of MTK;
competent authorities of the Parties - the bodies determined by the Parties for the solution of the questions connected with development and use of MTK.
This agreement regulates questions of development and use of sites of MTK passing on the territory of the State Parties of the CIS on the basis of harmonization of subsystems of providing MTK.
The parties determine effective development of MTK as basic component of the steady international transit message and create mutually advantageous conditions for lifting of restrictions for the purpose of ensuring free transportation of goods and passengers on the territory of the State Parties of the CIS.
1. The parties take measures for harmonization of subsystems of providing MTK.
2. Competent authorities of the Parties develop the approved plan of collateral practical actions for harmonization of subsystems of providing MTK for the purpose of realization of the directions determined by this agreement as priority in each of subsystems.
3. The realization of the directions is enabled step by step on the basis of development of the Parties by competent authorities and bodies of industry cooperation of the CIS of the international transport projects.
1. The priority directions of harmonization of subsystem of normative legal support of MTK are:
harmonization of regulatory framework of the State Parties of the CIS with the regulations and the principles of international law and standards enshrined in multilateral agreements and conventions on transport and customs affairs for the purpose of ensuring integration of different types of transport of the State Parties of the CIS into the European and Asian transport systems;
development and acceptance within the CIS of the international treaties creating legal conditions for the approved development of MTK;
unification of the modes and preferences fixed in bilateral international treaties which participants are the State Parties of this agreement, and also transition from bilateral to multi-lateral international treaties;
creation of conditions for the approved elimination of barriers when implementing the international, including transit transportations;
cooperation with the international organizations which activities are connected with questions of the organization of international carriages.
2. Competent authorities of the Parties develop offers on streamlining of the regulatory legal acts raising the questions of the approved development of MTK, and to enhancement of mechanisms of their realization directed on:
unification of provisions of the customs legislation of the State Parties of this agreement in the field of international carriages;
mutual recognition of means of identification and carriage documents;
implementation of information technologies.
The priority directions of development of subsystem of resource providing MTK are:
development of the approved recommendations about priority of development of infrastructure of sites of MTK, increase in efficiency of its use and investment appeal of projects of its development;
broader application of the end-to-end tariff charges when implementing of the combined and multimodal transportation of goods on the MTK directions;
creation of conditions for removal of barriers when implementing international carriages on the MTK directions;
increase in capacities and enhancement of technological equipment of customs check points, enhancement of technology and procedures of customs clearance and customs control;
implementation of systems and devices for increase in traffic safety of vehicles;
