About approval of the Regulations on conditions, procedure for providing, accounting and distribution of the sanatorium permits provided to veterans

(as amended on 22-12-2020)

Based on the Law on veterans No. 190-XV of May 8, 2003. (The official monitor of the Republic of Moldova, 2003, No. 84-86, of the Art. 392), with subsequent changes and amendments, DECIDES: the Government

1. Approve Regulations on conditions, procedure for providing, accounting and distribution of the sanatorium permits provided to veterans it (is applied).

2. The realization of requirements of this provision will be enabled within the assignments provided in the government budget for the corresponding year.

Regulations on conditions, procedure for providing, accounting and distribution of the sanatorium permits provided to veterans

I. General provisions

1. This Provision (further - the Provision) regulates procedure for provision and distribution of sanatorium permits to categories of persons to whom operation of the Law on veterans No. 190-XV of May 8, 2003 extends.

2. The right to sanatorium treatment for categories of persons specified in Item of 1 this provision is provided:

a) to receivers of pensions or the public social benefits, or monthly public welfare payments, according to the national legal system, appointed and paid by National cash desk of social insurance (further - NKSS), and also to persons having general working life at least 35 years for women and 40 years for men - through territorial cash desks of social insurance (further - TKSS);

b) to persons with limited opportunities owing to war and to veterans of the Ministry of Defence, Ministry of Internal Affairs, National penitentiary administration subordinated to the Ministry of Justice, Services of information and safety, the General inspectorate of boundary police subordinated to the Ministry of Internal Affairs, the National center for fight against corruption, Service of the state protection, to receivers of pensions or the public social benefits, or monthly public welfare payments, according to the national legal system, – through territorial cash desks of social insurance;

c) to persons specified in subitems a), b), d), e), f) and g) Item 5, to receivers of pensions from category of the military personnel, the personality and which position is provided by conditions of the Law No. 245/2008 on the state secret, - through National cash desk of social insurance.

3. Sanatorium permits are provided to veterans in the rehabilitation centers of the Ministry of Health, work and social protection and in other organizations such which are acquired according to the legislation on public procurements according to specialization of balneoklimatichesky resorts and other profile organizations, taking into account nosological forms of diseases of receivers of permits and medical recommendations on treatment.

3-1. Persons with severe forms of restriction of opportunities owing to war according to article 8 of the Law No. 190/2003 on veterans who according to the conclusion of the National consultation on establishment of restriction of opportunities and working capacity or its territorial structures need the permanent help of other person have the right to maintenance in accordance with the terms of this provision.

Any person having the nationality of the Republic of Moldova which reached 18-year age, expressed consent to be attendant and capable to render services in observation, support and care of the beneficiary during stay on sanatorium treatment can be the attendant.

3-2. In case the attendant of person with severe forms of restriction of opportunities owing to war corresponds to categories of beneficiaries of sanatorium permits and is in queue, the National cash desk of social insurance and/or territorial cash desks of social insurance has the right to issue, according to priority, during the same period the permit to the attendant and person with severe forms of restriction of opportunities owing to war, with observance of conditions of this provision, the queue of the accompanying person remains.

3-3. The attendant of person with severe forms of restriction of opportunities receives the free sanatorium permit in accordance with the terms of this provision.

3-4. To persons specified in Item 5, at which pneumofibrosis, as a result of COVID-19, in the first 9 months after disease according to the direction statement (form No. 027/e) from the Medical card of the inpatient (form No. 003/e-2012) or the Medical card of the outpatient (form No. 025/e) sanatorium permits are issued out of turn irrespective of whether they earlier in accordance with the established procedure received the permit issued by National cash desk of social insurance / territorial cash desk of social insurance.

II. Categories of receivers and frequency of providing with sanatorium permits

4. According to the Law on veterans No. 190-XV of May 8, 2003 citizens of the Republic of Moldova who treat one of the categories specified in Item 5 of this provision, constantly living in the Republic of Moldova have the right to providing with sanatorium permits.

5. Have the right to providing with free sanatorium permits in the rehabilitation centers of the Ministry of Health, work and social protection and other organizations of this kind according to medical indications:

a) persons with limited opportunities owing to war according to article 8 of the Law on veterans No. 190-XV of May 8, 2003 - annually or, at will, instead of the sanatorium permit the monetary compensation every two years in accordance with the terms, established by the Government is paid to them;

b) veterans of war according to article 7 of the Law on veterans No. 190-XV of May 8, 2003 - once in three years;

c) veterans of work, according to article 9 of the Law on veterans No. 190-XV of May 8, 2003, persons except for working and persons performing different types of business activity (except for owners of lands of agricultural purpose) if in the last six months, preceding month in which the permit was selected, person was not engaged in business activity, – once in three years;
