About prevention of the disease caused by human immunodeficiency virus

Chapter 1. General provisions

Article 1. The basic concepts used in this Law

Human immunodeficiency virus (further - HIV infection) - virus infecting immune system of the person and defiant acquired immunodeficiency syndrome.

Acquired immunodeficiency syndrome (further - AIDS) disease which leads to business disruption of general immune system of organism owing to what the organism becomes susceptible to various diseases.

HIV-positive person - the person in whose organism the human immunodeficiency virus is found. HIV - the infected person, without having external signs of syndrome, is infection source.

Article 2. Service of prevention of AIDS

For the purpose of prevention of infection of the population of the Republic of Armenia with HIV infection, supervision of it the Republican center of prevention of AIDS is created (further - RTsP AIDS). The procedure for management of RTsP AIDS and its financing, structure and powers are determined by authorized state body in the field of health care of the Republic of Armenia (further - authorized state body).

For holding actions for prevention of infection with HIV infection and target and effective use of allocated funds the authorized state body develops the state target program approved by the Government.

Article 3. Coverage of this Law

This Law extends to the citizens of the Republic of Armenia who are not in the territory of the Republic of Armenia foreign citizens and stateless persons (further - persons), and also to the companies, organizations and the organizations (irrespective of pattern of ownership) operating in the territory of the Republic of Armenia.

Article 4. Powers of the government of the Republic of Armenia in the field of the prevention of AIDS

Government of the Republic of Armenia:

a) periodically informs the population on measures for prevention of AIDS;

b) exercises epidemic supervision of AIDS in the territory of the Republic of Armenia through authorized state bodies;

c) approves target programs of qualified specialized medical care and servicing of HIV-positive persons and patients with AIDS in the Republic of Armenia;

d) creates conditions for scientific and preventive research AIDS;

e) performs the actions directed to moral and sex education of minors;

e) creates conditions for training in the field of prevention of AIDS;

g) communicates about prevalence of HIV infection and AIDS according to international treaties of the Republic of Armenia;

h) Voided according to the Law of the Republic of Armenia of 09.11.2017 No. ZR-149

k) establishes procedure of dotestovy and posttest consultation and inspection by medics of the arrested persons and convicts in connection with HIV infection.

Article 5. Financing of programs of prevention and treatment of AIDS

Public financing of programs of prevention and treatment of AIDS is considered as priority, proceeding from need of safety of society, and also life and health of persons.

Financing of the target programs directed to prevention of AIDS, treatment and social protection of HIV-positive persons is made according to the procedure, the stipulated in Clause 25 Laws of the Republic of Armenia "About medical care, servicing of the population".

Actions for prevention of AIDS and treatment of HIV-positive persons are performed at the companies of health care licensed in the procedure established by the legislation of the Republic of Armenia which list approves the Government.

Article 6. Guarantees of protection of the rights and freedoms of HIV-positive persons

The fact of infection of person with HIV infection cannot be the basis for restriction of its rights and freedoms, except as specified, provided by the law.

Article 7. Conditions of entry into the Republic of Armenia of foreign citizens and stateless persons

The foreign citizens who addressed for receipt of a visa on entry into the Republic of Armenia for the term of more than three months and also persons without citizenship show the certificate on survey on HIV infection in the procedure established by the Government of the Republic of Armenia.

Foreign citizens and stateless persons in case of non-presentation of the certificate shall undergo within a month in the territory of the Republic of Armenia laboratory survey on detection of HIV infection.

Provisions of parts one and the second this Article do not extend to the staff of the international organizations and members of their families.

Article 8. Consequences of detection of HIV infection in organism of foreign citizens and stateless persons

After confirmation of HIV infection in organism of the foreign citizens and stateless persons who are in the territory of the Republic of Armenia they are subject to administrative deportation from the Republic of Armenia in the procedure established by the legislation of the Republic.

Article 9. International agreements

If international treaties of the Republic of Armenia establish other regulations, than those which are provided by this Law then are applied regulations of international treaties.

Chapter 2. Conditions and procedure for performing medical examination for the purpose of detection of HIV infection

Article 10. Laboratory survey

The laboratory survey directed to detection of HIV infection is carried out in the procedure established by the legislation of the Republic of Armenia at the licensed companies of health care (irrespective of pattern of ownership).

In case of positive reaction of laboratory survey to RTsP AIDS HIV infection without fail carries out repeated survey.

Laboratory survey on detection of HIV infection is voluntary and anonymous, except as specified, the stipulated in Article 11 these Laws.

Persons whom shall pour in blood, components of blood or biological liquids, to transplant bodies and fabrics, can require their repeated survey for the purpose of detection of HIV infection.

Article 11. Obligatory medical examination

Are subject to obligatory medical examination:

a) blood donors, biological liquids, fabrics and bodies;

b) the health workers adjoining on work with blood, biological liquids, fabrics and bodies;

c) persons which are in places of detention;

d) persons having diseases, sexually transmitted;

e) expectant mothers;

e) the children born from mothers infected with HIV infection;

g) addicts;

h) the persons which came back from office, business and private travels, leaving the Republic of Armenia for the term of more than three months.
