About the Concept of the state language policy

Considering need of development of the consecutive and weighed approach to the solution of language questions, for the purpose of ensuring compliance with the constitutional guarantees of rather all-round development and functioning of Ukrainian as state in all spheres of public life in all territory of Ukraine, satisfaction of language needs of citizens of Ukraine, being guided by Article 10 and according to part two of article 102 of the Constitution of Ukraine, in support of initiative of National council on culture and spirituality I decide:

1. Approve the Concept of the state language policy it (is applied).

2. To the Cabinet of Ministers of Ukraine to develop and approve the actions plan in three-months time, aimed at providing implementation of the Concept of the state language policy approved by this Decree, having provided, in particular, actions on:

to development and approval of the State program of development and functioning of Ukrainian and languages of ethnic minorities for 2011-2015, to ensuring its accomplishment;

to enhancement of the legislation on languages;

to development of network and improvement of educational and methodical providing preschool, general education, higher educational institutions for education and training at Ukrainian;

to expansion of application of Ukrainian in mass media, the sphere of culture, science and education.

3. Central and to local executive bodies to provide realization of provisions of the Concept of the state language policy, to provide funds for financing of the relevant activities.

Concept of the state language policy

The language policy takes the main place in system of the state priorities as its strategic task is ensuring steady observance of the constitutional guarantees of rather all-round development and functioning of Ukrainian as state in all areas of public life in all territory of Ukraine, free development, use and protection of languages of ethnic minorities and satisfactions of language needs of citizens of Ukraine.

The concept of the state language policy (further - the Concept) is developed according to the Constitution and the laws of Ukraine, international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine, other regulatory legal acts which govern the relations in the language sphere.

The current state of language situation in Ukraine and determination of problems to which solution the Concept is directed

Ukrainian as the means of communication and intellectual identification of the personality displays identity of the multimillion Ukrainian people and is basis of his spirituality and historical memory. According to part one of article 10 of the Constitution of Ukraine Ukrainian is state language in Ukraine. As N 10-rp on the case of application of Ukrainian is determined in the Solution of the Constitutional Court of Ukraine of December 14, 1999, the regulations on Ukrainian as state contain in the Section I "General principles" of the Constitution of Ukraine which fixes bases of the constitutional system in Ukraine. The concept state (official) language is component of wider on content and amount of the concept "constitutional system". Other its component is, in particular, the concept of the state symbols. The right to determine and change the constitutional system in Ukraine belongs only to the people (part three of article 5 of the Constitution of Ukraine). Full functioning of Ukrainian in all areas of public life in all territory of the state is guarantee of preserving identity of the Ukrainian nation, unity of Ukraine.

Despite of zadeklarirovannost of the state status of Ukrainian, the analysis of language situation in the state confirms availability of political speculation concerning its use that contradicts interests of homeland security of Ukraine, threatens its sovereignty. For elimination of such threat it is necessary to expand scope of Ukrainian, to stimulate forming and protection national language and cultural and language information space. The state shall provide unconditional accomplishment of the constitutional regulation about all-round development and functioning of Ukrainian in all areas of public life in all territory of Ukraine.

According to the Constitution of Ukraine in Ukraine free development, use and protection of Russian, other languages of ethnic minorities of Ukraine is guaranteed. By the legislation in official communication along with state language languages of ethnic minorities in those areas where the number of carriers of such languages make the majority of the population can be applied. The status of Ukrainian language as state does not deprive of citizens of Ukraine of the right to freely use any language for private communication and satisfaction of other requirements. At the same time ensuring development of languages of ethnic minorities shall not interfere with development of state language, its functioning in all areas of public life in all territory of Ukraine.

The state cares also for satisfaction of language needs of Ukrainians who live outside the state, by provision of appropriate assistance to the centers of the Ukrainian culture, public organizations and cultural and educational institutions abroad.

Analysis of origins of language problem and reasons for need of its decision

Independent Ukraine inherited the deformed language situation which developed as a result of assimilation of Ukrainians. In the past under slogans of fight against "the low-Russian separatism" and "the Ukrainian bourgeois nationalism" language and cultural identity of Ukrainians, their natural desire to keep Ukrainian was destroyed, was considered as manifestation of aspiration to the state independence.

The language situation which developed in Ukraine considerably is consequence of broad application of the direct and hidden coercion directed to implementation of restrictions concerning use of Ukrainian for the purpose of its gradual replacement from all spheres of public life. According to the All-Ukrainian population census of 2001, Ukrainians constitute 77,8 of percent of the population of Ukraine whereas Ukrainian recognizes only as native 67,5 of percent. In many regions of Ukraine in city communication, mass culture, information space Russian dominates.

Normalization of language situation in the state stir not only lack of effective state language policy, but also politicizing of language question, political speculation from determined inside - and foreign policy forces which consciously aim to cause artificial opposition in society. Provision of the status of state language to other languages will inevitably entail not only bystry replacement of Ukrainian from official communication, and and further narrowing of the sphere of its use.
