Rules of provision of the right of organization of the private security organization by the legal entity performing other activities except security

1. The decision on provision of the right of organization of the private security organization by the legal entity performing other activities except security (further - the legal entity), is accepted by the Government of the Russian Federation.

2. The legal entity can apply for provision of the right of organization of the private security organization in the presence of one of the following bases:

the legal entity is in accordance with the legislation of the Russian Federation carried to the strategic companies (except for the companies of departmental protection) or to strategic joint-stock companies;

the legal entity is in accordance with the legislation of the Russian Federation subject of natural monopolies;

the legal entity is the state corporation or state-owned company;

the legal entity is the army Cossack society entered in the state register of the Cossack societies in the Russian Federation.

3. For provision of the right of organization of the private security organization the legal entity submits to the Federal Service of troops of national guard of the Russian Federation the corresponding statement with reasons for need of its organization.

Copies of constituent documents of the legal entity are in addition enclosed to the application.

The copies of documents which are not certified notarially are represented along with originals.

The statement and documents attached to it are registered and accepted according to the inventory which copy is handed to the applicant.

4. The Federal Service of troops of national guard of the Russian Federation performs completeness and reliability of the data provided in the statement.

5. After conducting check, stipulated in Item 4 these rules, the Federal Service of troops of national guard of the Russian Federation in time no more than 45 days from the date of registration of a statement prepares the motivated conclusion about possibility (impossibility) of provision of the right of organization of the private security organization by the legal entity. By preparation of the specified conclusion the Federal Service of troops of national guard of the Russian Federation including proceeds from:

creations of the private security organization are more whole;

conditions of criminogenic situation in the locations of objects (and also on objects) for which protection it is supposed to found the private security organization;

possibilities of ensuring protection of such objects by other organizations;

the features of activities of the legal entity assuming availability at persons involved in protection of the specified objects, special knowledge, skills.

In the conclusion the reasons and circumstances which formed the bases for its forming are specified.

The conclusion is approved with the Ministry of Internal Affairs of the Russian Federation, Federal Security Service of the Russian Federation and Federal Guard Service of the Russian Federation.

6. Compliance of the legal entity to requirements, stipulated in Item 2 these rules, and also availability of the conclusion about possibility of provision of the right of organization of the private security organization by the legal entity are the bases for preparation of the corresponding draft decision of the Government of the Russian Federation.

7. The Federal Service of troops of national guard of the Russian Federation prepares the draft decision of the Government of the Russian Federation about provision of the right of organization of the private security organization by the legal entity, approves it with other interested federal executive bodies and introduces the specified draft in accordance with the established procedure to the Government of the Russian Federation.

8. By preparation of the conclusion about impossibility of provision of the right of organization of the private security organization by the legal entity the Federal Service of troops of national guard of the Russian Federation sends to the applicant the relevant information.
