About procedure for retail sale of medicines in rural settlements

Based on part three of article 25 of the Law of the Republic of Belarus of July 20, 2006 No. 161-Z "About drug circulation", subitems 6.1 and 6.2 of Item 6 of article 307 of the Law of the Republic of Belarus of October 14, 2022 No. 213-Z "About licensing" and subitem 9.1 of Item 9 of the Regulations on the Ministry of Health of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 28, 2011 No. 1446, the Ministry of Health of the Republic of Belarus DECIDES:

1. Approve the Instruction about procedure for retail sale of medicines in rural settlements in which there are no drugstores it (is applied).

2. Declare invalid the resolution of the Ministry of Health of the Republic of Belarus of January 15, 2007 No. 5 "About approval of the Instruction about procedure for retail sale of medicines by health workers of medical and obstetrical centers" (The national register of legal acts of the Republic of Belarus, 2007, No. 66, 8/15831).

3. This resolution becomes effective since December 23, 2009.

The instruction about procedure for retail sale of medicines in rural settlements in which there are no drugstores

1. This Instruction determines procedure for retail sale of medicines in rural settlements in which there are no drugstores.

2. Providing rural settlements with medicines of the population in which there are no drugstores is performed by retail sale of medicines by the health worker of the state organization of health care or its structural division located in rural settlements (further – the state organization of health care), and also such health worker during exit medical examinations of the population to whom the obligation on retail sale of medicines is in accordance with the established procedure assigned (further – the health worker).

3. Retail sale of medicines is enabled based on the contract for the right of retail sale of medicines the health worker signed between the state organization of health care and the trade and production republican unitary enterprises "Pharmation", "Minskaya Pharmation".

The head of drugstore of the first or second category of the trade and production republican unitary enterprise "Pharmation", "Minskaya Pharmation" (further – the head of drugstore) signs the works agreement with the health worker about retail sale of medicines by it to the population (further – the works agreement).

The works agreement shall contain:

the subject of the agreement on performance of works on retail sale of medicines to the population;

procedure and payment due dates for performance of works on retail sale of medicines to the population;

obligations of the contractor on:

to observance of requirements for obtaining, storage, adherence to deadlines of the validity, retail sale of the medicines established by Proper pharmaceutical practice and Proper practice of storage of medicines, and also requirements for accounting;

to timely informing the customer on lack of the medicines included in the minimum list of the medicines obligatory for availability at the health worker for retail sale established according to appendix;

to carrying out information and consulting work with the population on application and storage in house conditions of medicines;

the customer's obligations on:

to timely providing the contractor with the medicines included in the minimum list of the medicines obligatory for availability at the health worker for retail sale;

to training and providing the contractor with the necessary standard operational procedures and regulatory legal acts regulating procedure for obtaining, storage, adherence to deadlines of the validity, retail sale of medicines;

periodic, but at least 1 time a year to control of observance of requirements for obtaining, storage, adherence to deadlines of the validity, retail sale of the medicines established by Proper pharmaceutical practice and Proper practice of storage of medicines, and also requirements for accounting;

inventory counts of medicines, but at least 1 time a year.

4. The state organization of health care for implementation of retail sale of medicines provides:

availability of the necessary room, equipment;

necessary storage conditions of medicines;

accomplishment of rules of retail sale of medicines, medical products and other goods of pharmaceutical assortment, their safety.

5. To the health worker the order of the head of the state organization of health care assigns obligations on retail sale of medicines regarding observance of requirements for obtaining, storage, adherence to deadlines of the validity, retail sale of the medicines established by Proper pharmaceutical practice and Proper practice of storage of medicines, and also requirements for accounting.

6. The health worker enables retail sale of medicines according to the recipe of the doctor, that number to the electronic recipe of the doctor, and without recipe of the doctor on the retail prices specified in commodity-transport delivery notes.

7. The health worker provides acceptance of cash, accounting and the reporting under retail sale of medicines according to the legislation.

8. The head of drugstore on permanent basis organizes training and providing the health worker with the necessary standard operational procedures and regulatory legal acts regulating procedure for obtaining, storage, adherence to deadlines of the validity, retail sale of medicines, the organizations of cash circulation depending on the performed works and services. The head of drugstore provides control of observance by the health worker of the legislation.

9. The head of drugstore provides the health worker on consignment, commodity-transport notes with the medicines including included in the minimum list of the medicines obligatory for availability at the health worker for retail sale and also medical products and other goods of pharmaceutical assortment.

10. The head of drugstore will organize carrying out periodic control (at least 1 time a year) behind observance by the health worker of requirements for obtaining, storage, adherence to deadlines of the validity, retail sale of the medicines established by Proper pharmaceutical practice and Proper practice of storage of medicines, and also requirements for accounting.

11. Inventory count of the medicines transferred to the health worker for retail sale is made according to the procedure, established by the legislation, but at least 1 time a year.
